tanong po muli ako s inyo sir jrtorres,pasensya n po...kc nabasa ko po doon s pinadalang info ni kabayang kurapika about s nsabing revised bill eh ang date po ng promulgation eh october 9,2009 and it will take into force acc to him/her 2 months after promulgation so meaning to say it will take effect on dec 10,2009..paano po kaya yon eh ang sched po ng uwi ko eh dec 17 maapektuhan p kaya po ako noon...di ko po alam eh nalilito ako...kung ako po eh maapektuhan eh cguro much better kung magpaalam n lng po ako ng mas maaga kso may tiket n po ako...cguro nman pwede png ipa cancel ang date and change it as early as dec 17,,,advise nman po uli sir...pasensya n po and God bless us all...

in my opinion cguro nde kna sakop nun kz naprocess na papers mo eh kung cguro i process pa lng b4 ng implementation nde kna covered dun sa dati(3+3)..so since naaus na dun ka sa una patakaran ka covered...opinyon ko lng yan ha....

kabayan...tama si kabayang jane...posible na di ka na masakop ng bagong batas..pero mas maganda sana kung mas maaga ka makauwi,,,mas playsafe,,,mahirap na kasi di pa natin alam kung ano ang mga sasaklawin ng bagong batas...syempre bago pa lang ipapatupad yan so maraming magiging dapat isaalang alang talga..pero sa iyo pa rin ang desisyon...ang saakiy opinyon lang ....ingat lagi..at andito lang me...just pm me or pwede mokong twagan...pag may maitulong ako...slamt po

MGA SIR,

Kung sa Dec 10 po bka maimplement na ito puede po ba ako magrequest sa employer ko na iprocess ung renewal ko sa Dec 1 para makuha ko ung another 3yrs instead of +2yrs...tsaka para po makuha ko na ung kookmin at dejikom ko...para po pagbalik ko mas mahaba ang stay ko..posible po ba makuha ko ung dejikom at kookmin ko pati ung +3yrs kung gagawin ko ito?

Nabasa ko lang ito sa Labor News Q & A. This is related to the above inquiries..............

This is the National Labor Consultation Center.

The Revised reemployment system will apply to the case that an employer will apply for reemployment permit from Dec,10,2009.


So 1) In the case of an employer who summits reemployment documents on Dec. 8, 2009 to reemploy the worker who completes working period on Jan, 15, 2010 and gets reemployment permit, the foreign worker shall have to leave Korea for one month, then may reenter Korea and work for another 3 years.

[The revised law does not applied to this case.], However

2) In the case of an employer who summits reemployment documents on Dec,10,2009 to reemploy the worker who completes working period on Jan, 15, 2010 and gets reemployment permit, the foreign worker doesn't have to leave Korea, may work continuously at the same company and work within another 2 years

[The revised law applies to this case.]

Please Keep in mind that according to enforcement regulation of the Act on Foreign workers'' employment, reemployment application shall be done from 90 days before the completion date of working period to 30 days before the completion date of working period.

We hope that this counceling will help you solve your questions.

salamat po sir jr...sir emart ask ko lang po ulit e pano po sa case ko e sa JANUARY 24 po ang 3yrs visa ko..posible po ba na magparecontract agad ako sa Dec1 para makapagbakasyon ako ng 1 buwan at maiuwi ko muna ung tejikom at kookmin at +3yrs na visa ulit...kc mu medyo nalito ako sa JANUARY 15 na date e...covered ba ako o hindi na...salamat po ulit

tanong lng po maglilimang taon na po ako nitong dec.8 2009 na rehired na ako bali mttpos kona yon dawalang taon po.sabi po pojang namin may isang taon pa po ako!bali pagnatpos kona po ika tatlong taon ko wala na po ba!onather visa!totoo po bang yon balita ngayon na pwdi kang mag aply ng residence visa!sa iisang companya nmn po ako nagtrabho!pakisagot naman po agad maraming maraming salamt po!

sister lovely sa ngayon po ay wala pang batas na nagsasabi na pwede p tayo makabalik..bale 3 + 3 pa lang sa mga narehire na at straight 5 years sa mga aabutin ng bagong batas ..tungkol nmn sa nabanggit mo na ibang way para mkblik ka ..siguro ay kung magshift ka ng visa,,from E9 to E7...sa mga past forum napagusapan yan..nabanggit ni kbyang airlinehunk na possible ito kung irequest ka ng sajang mo..at kung apruban ng imigrasyon..so marami pang proseso at wala pang katiyakan...pero pwede itry..

sir tanong ko lang po ,,,, bale 3 release na po ako ung pagdsating ko yong unang factory ne release kami after 6 months ,, tapos nakakuha ako ng work sa suwon tapos umalis din ako dahil pala mura yong manager namin,,, ngayon nandito ako sa choengchungnamdo welder trabaho ko mahirap trabaho namin mainit tsaka grabi usok,,, akala ko po 3 release dapat hindi 3 company ,,, ngayon re hire kami hanggang 5 taon sa bagong batas,, gusto ko pong umalis may chance pa po ba akong umalis,,, tnx

kabayan kailan ka ba narehire...baka ibig mong sabihin ay naabot ka ng bagong batas..sa ngayon kabayan wala pang guidlines kung magdagdag ng relis kasi 5 years na nga...pero kung ikaw ay nakaexit na another 3 releas ang available sayo..pakilinaw kabayan kung kailan ka dumating

so abot ka pala sa bagong batas batas na 5 years..sa ngayon kabayan di pa malinaw..kung may extrang 2 releas na ibibigay ..walang binabanggit sa announcement ng bagong batas..kaya status quo yang 3 release...napagusapan na dati yan dito..sana nga ay mayron pang extra para makalipat kapa..dahil kung wala na ay yan na ang huli mong company..so tyaga ka muna..hanggat wala pang linaw..

Ibig po rin ba sabihin nito e..kelangan umuwi before December 10 or kelangan lang ay maprocess ung papel...di kc malinaw kung kelangan ba mag exit agad o kung ok lang tapusin ung contract next year basta naayos lang ung reemployment before December 10...at kung ok lang tapusin ung actual visa until next year ilang araw or buwan ba ung kayang i-allow ng re-employment documents..kasi ako sa January..ung iba kong kasama sa Feb at April....

kailangan mo magexit o umuwi bago mag december 10..yan po ang dapat mong gawin..yung mga kasamahan mo..abot na sila ng new law..much better magearly exit ka..para maavail mo ang 6 years..naprocess na ba yung papel mo.kasi nakalagay na 3months bago magexit ay naprocess na ang reemployment mo..hope will help..

download nyo po ung attached file..ito po ung kabuuang laman ng NEW EMPLOYMENT REGULATION..

partial implementation po sa Dec 10 ito nga po ung re-employment procedure...Sir Jr di ata necessary na magearly exit..kc tlgang wala ako ng makita na mentioned regarding sa early exit..and sinasabi kasi pag naprocess mu..e kelangan mu magexit...pero kundi nman..ok lang na tuloy tuloy...

and according din d2...ang employment period ay kung kailan ikaw mag3yrs..so ok lang tapusin mu contract mu basta may hawak kang re-employment ok lang....

thank you sir Jr...tama ka medyo naguluhan lang ako dun sa early exit na sinabi mu hehehe..pasensya na po..anyway..sa magtatapos ng 3yrs contract(sojourn period) sa Dec 10 onwards..

sa pagkakaintidi ko po...kelangan po ma-iprocess ang re-employment before Dec 10 para po +3yrs re-employment visa--> exit Korea for 1month after finishing the sojourn period--> re-enter Korea --> work for another 3yrs

pero pag hindi na-process before Dec 10 the new regulation na po ang susundin sa inyo...

....di lang po ako sure kung hanggang kelan dapat ung maximum sojourn(what month?) period next year 2010 ng isang EPS worker para puede ma-apply ito (bka d2 papasok ung 90 days to 30 days d k pa sure...ung exact month)

...ksi dalawang condition ung nandito...sa pinadala ni sirJr ....palagay ko ginamit lang po ung January 15 as a sample date...para maipaliwanag ang condition 1 ng taga NLCC.

1st condition ay kung ang expiration ng visa ng isang EPS worker ay mula Dec 10 and onwards

2nd condition ay kung ang employer ay naipasa ang reemployment documents sa JobCenter sa Dec 10 at lampas pa dito.

kapag itong dalawang conditions na ito ay pasok sa inyo...NEW REGULATION ang susundin at magiging basehan nyo..ito ung 5yrs diretso...

...kaya kung tulad ko...January 24 ang expiration ng visa ko... pasok ako sa 1st condition however kung hindi ko susundin ung 2nd condition at i-apply ko ung re-employment before Dec 10 ay di ako tatamaan ng NEW REGULATION...


....sa iba po kasi malaking abala rin ung biglaan uwi or early exit sa isang EPSworker atsaka po baka po magkaroon po ng ibang problema kung ipipilit po ang early exit ng isang EPSworker sa kanilang employer...MORE POWER sa SULYAP PINOY at maraming salamat po ulit forum....

Ito po ay kumporme sa mapapagdesisyunan ng employer nyo...meron po kasi na pumapayag at meron din po na hindi...makipagusap po tayo ng maayos...di naman po masama kung magrerequest tayo ...wala naman po sigurong mawawala kung magbabasakali na pakiusapan ang employer...kung nais lamang po natin ng OLD regulation..di ko po pinipilit ito.

Nasa sa inyo na rin po kung mas gusto nyo na ituloy na lang hanggang 5years ang visa.

At yung mga lumampas ang working visa ng March 9, 2010 ay automatic NEW REGULATION na po ang susundin.

Sa mga nakabalik na at tatapusin ang 5years..may nagtatanong po kung puede pa madadagdagan ang sojourn period nyo...ang sagot po ay POSIBLE...di po lalagpas ng 2taon a extension ay maari mapagkasunduan ng employer at EPS worker ang extension ng isang extended employed worker...

kabayang drew kung dika irenew ng amo mo sa march 27 ay pwede ka pa makahanap ng ibang work..punta ka lang sa nodongbu..kasi ikaw ay automatic lang na relis..dahil may 2 years ka pa na visa..di tulad ng dating batas na kapag di ka nabigyan ng reentry ay dikana makakabalik sa korea..yan ang isa sa mga maganda ring naidulot ng bagong batas..kung dika manbigyan ng panibagong kontrata ay automatic na may work ka pa rin dito sa korea...sana naliwanagan ka sa mga sinabi ko..ingat and always visit sulyapinoy

ask ko lang po kasi patapos na po 3 years ko this feb 5 kong sakali po ba na hindi na ako ma re hire pwede paba akong mag hanap ng trabaho kahit wala na po akong release,at kong sakaling ire hire po ako ng sajang namin pwde pa po ba akong mag parelease ayaw kasing makipag usap ng amo namin ng maayos hindi tuloy namin alam kong ano ang plano nila tapos marami pong problema dulot samin pati na rin sa mga kasamahan naming koreans paki advise lang po ng pwedeng gawin namin God bless sa inyo

kabayang dong kung sakali na dika bigyan ng kontrata mo sa feb. ay automatic na relis ka..at punta ka lang sa labor para makahanap ng ibang work..pero unahin mo muna ang imigration..sa araw na matapos ang kontrata mo ay pumunta ka sa imigration na pinakamalapit sa inyo ..para makakuha ka ng 2 months visa extension....kasi may 2 years kp dahil sakop kn ng 5years n new law..

sir,

hindi ko alam kung matutuwa ako sa extend na 5yrs na yan .... nakakahinayang yung isa pang taon .. sana makakabalik pko dto ng another 3yrs pra makaipon pa kaso nasakop ako ng 5yrs... kamalas nmn kaya 2yrs na lng pagbalik ko.. saglit lng yun.. tanong ko po kung natpos ko po yung 5yrs na yan .. hindi n apo ba kami makakabalik dto sa korea? may paraan paba pra makapag work pa kmi dto.. same company? kagaya sa taiwan 3yrs work tapos bumalik another 3yrs so 6yrs na then nagkaroon ng batas na pwede pang bumalik another 3yrs so 9yrs basta kung sino may gusto sana ganun na lng ginawa dto sa korea... ngayon 5yrs lng pangnasakop ka doon kung hindi ka nasakop doon sa 5yrs.. pasok ka sa 6yrs hay syang ang 1sang taon makakaipon pa sana.. sana may maipatupad na batas na another 3yrs pa lahat ng foreign works dto sa korea kung ayaw na edi uwi na kung gusto pa mag work edi continues pa......

kabayang yhurika,,,sayang nga ang 1 year na nawala,,,pero di hamak na maswerte pa rin sa mga 3 years lang na di na kanabalik...by the way pwede kapa ulit magapply sa korea after 1 year ng pagexit mo dito sa korea..so kung magkaroon ng klt at nakaone year kn ..eligible kn na magapply ulit..at kung mkpasa ka ulit ay pwede ka mahire ulit ng dati mong company,,,sa ngayon habang andito ka..aral lang ng aral ng hangul...

2. Workers in Korea who are in their first (three year) sojourn period – If the worker is re-employed by his employer, plus less than two years without need to exit Korea. However, if the employer files the application for re-employment not later than 09 December 2009 and within the prescribed period (30 to 90 days before the end of sojourn), plus three years, but must leave and re-enter Korea.

3. (Re-employed) workers in Korea who are in their second sojourn period – the remaining portion of their three year sojourn period.


We shall furnish you a copy of the official English translation of the new law as soon as the same becomes available.

MGA KABAYAN...tama si PISCEAN...sa mga magrerenew this year...kumuha po tayo ng kopya at ipakita sa employer...i-followup palagi ang inyong re-employment....marami po sa mga magrerenew ngaun JANUARY ang mapapauwi dahil sa paglabag sa NEW REGULATION...importante po na maintindihan po natin mabuti ang re-employment procedure...ang extension po ng visa(+2yrs) ay hindi AUTOMATIC...ito po ay naayon sa request ng employer sa iimmigration/jobcenter at ito po ay dapat maisagawa 90 days to 30 days before completion of your first 3years sojourn period...and if your employer does not apply for reemployment permit, after completion of your first 3 year employment period, you are not allowed to work in Korea any more and have to go back to your country.

Ang +2yrs na sojourn period ay dadaan sa re-employment procedure ng inyong employer..di po puede ung after first 3yrs nyo e di nalang basta pipirma at kukuha ng release paper at mag-aapply ulit dahil tingin natin approved na ung 5yrs e 5yrs na ung sojourn period/working visa natin...di po ganun ito...kelangan dumaan muna sa re-employment procedure para ma-avail nyo ung +2yrs na extension at ito ay dapat maisagawa ng mas maaga(atleast 31 days before). Kapag walang re-employment diretso uwi...un ang naging problema ng mga ibang kasama dito...nakakalungkot marami s akanila nagTNT na lang...kasi nga bago ang batas medyo malabo...MORE POWERS sulyappinoy
