my 3 yr sojourn period will supposedly end by january 2010. will the newly approved 5 yrs sojourn period affect my status?will that mean that i can not avail the benefits i am suppose to get for 3 yrs only if i will go on vacation on my third year?

mam opo abot po kayo ng bagong batas na straight 5 years..so kahit dika na magexit ng one month dito.at ang gukmin at tegicom ay pag nag5 years mo na maavail...maliban na lang kung kayo ay magparelis sa present company mo..don maiibigay sayo ang tegicom mo...

ganun po ba? so that means pag di ako nag early exit, makukuha ko lang ang kukmin ko after 5 years. possible po ba na pag nagpa alam ako sa sajang ko n mag exit muna by december para makuha ko kukmin and makuha ko din plus 3 years?

dapat po 3 months before kayo magexit ay naprocess na yan..baka kulangin na kayo sa panahon..november na ngayon..pero try mo pa rin baka sakali may magawa pang paraan....

kabayang mikaela, u can early exit pero make it clean muna sa boss mo if u can make early exit....ung iba kc na case is binigyan ng early exit pero di biniday tgcom, be sure to ask tht, meron namn po mababait na mga boss. so try to ask sa ofis nyo..

The Revised re-employment system will apply to the case that an employer will apply for re-employment permit from Dec,10,2009.
So 1) In the case of an employer who submits reemployment documents on December 8, 2009 to reemploy the worker who completes working period on January 15, 2010 and gets reemployment permit,
*** the foreign worker shall have to leave Korea for one month, then may reenter Korea and work for another 3 years.
[The revised law does not apply to this case.],
However;
2) In the case of an employer who summits reemployment documents on Dec,10,2009 to reemploy
the worker who completes working period on Jan, 15, 2010 and gets reemployment permit,
*** the foreign worker doesn’t have to leave Korea, may work continuously at the same company and work within another 2 years.
[The revised law applies to this case.]

Note: Please Keep in mind that according to enforcement regulation of the Act on Foreign workers'' employment, reemployment application shall be done from 90 days before the expiry date of working period to 30 days before the expiry date of working period.

pahabol pwede po kau mag early exit pero within the 90 days application, u should have 85 days, meron po kc if exact na 90 days di binibigyn ng release form for the exit. tnx

if you will go home only for vacation, that wont affect your status you'll be covered by the 5yrs sojourn...but if u want to have 3 yrs more...you should exit earlier...(early exit).and you can apply 90-30 days before your contract expires.

ask ko lamang po. ang sojourn period nmin ay mttpos sa feb. kaso d kmi bingyan ng re entry. d kmi nagparelis. panu po ung 5 yrs? sakop b kmi kht wlang re entry? slmat po!! hoping to get a positve response...

kabayan wendel if di kau mag exit you will be covered by the new law.kse like what is posted here in the site...any application done on dec.10 2009 onwards,no need to exit.but if the company is kind enough u can ask for them to apply your re-employment prior to the said date.so that you can still avail of another 3yrs.more.

bakit kau release?bankrupt ba?makakahanap pa rin kau ng company kse nga 5yrs na.pero mas maganda kung makakahanap kau ng company na magre-employ sa inyo,pra maka avail kau ng another 3yrs.if wla kayo mahahanap...sad to say straight 5yrs na kau.no need to exit Korea.ilan ba kau pinoy jan sa company nyo?

kabayan gnob, 3 pinoy kmi d2. ganda nman company nmin. tao trato sa amin kso pg binigyan kmi ng rentry sabay sabay kmi uuwi. wlang hahawak sa machine nmin. kya kumuha cla ng kapalit nmin. pro ngaun, sobra n sa tao kya sabi ng sajang nmin no other choice kundi umuwi. salamat sa information. mabuhay kau kabayan!!

share ko lang po about sa situation na ganito para maiwasan maulit ang nagyari kina bossing wendell...
kahit sabay sabay po kayong dumating sa isang company hindi po ibig sabihin nito na sabay sabay din po kayong magbakasyon o mag exit pag patapos na ang 3 year's sojourn nyo. kasi po pag ganito ang gagawin eh talagang matitigil ang operation ng company. kaya po ang advice ko po pwde po paisa isa ang UWI gamitin po natin yong 90 days application period ng RE-EMPLOYMENT. basta ang mahalaga dapat exit po before the expiration ng 3 year's sojourn. sayang naman bossing wendell maganda pa naman sabi mo company nyo....

pro gs2 nla sabay2 kming umuwi. sad to say pro walang alam ung sajang nmin sa labor law. kht ung re entry kng d nmin cnabi d rn niya alam. base kc sa pagka2intindi ko 2ngkol sa 5yrs, dpat my company na magre2new sa inyo. tama po ba ako? correct me f im wrong. kaso sa sitwasyon nmin ngaun wla eh. meron pa nmang more than 2 mos sa 1st sojourn period nmin.
