Question:
How many years can we stay and work under EPS if rehired/reemployed?

Answer:
Under the current EPS law, in case employers submit an application for rehiring/reemploying foreign workers whose previous 3-year sojourn period expires, the concerned workers have to leave and stay out of Korea for 1 month before they reenter Korea. When they reenter Korea, they are allowed to work for another 3-years.

However, a new bill has created which allows foreign workers to work for up to five years without having to leave and stay out of Korea. This policy will be implemented after the Act on the Employment of Foreign Workers is revised. At this moment, the bill is under review and still to be approved by the National Assembly in South Korea. Expected implementation and more details of this new bill are expected to come out early next year.

pa finish contract din po ako / kami pala sa october
bale 5 years na po.meron pa ba kaming another 1 year extension?
kase dati po kaming e8 na naging e9.lam nyo naman po yun di ba?
kasali po ba kami sa 3 plus 3 extension?

yung 2-years E-8 visa ninyo hindi po yun kasama sa counting ng sojourn period under E-9 or EPS Visa... if patapos na po ang 3-years sojourn ninyo under E-9 visa and your current employer will rehire you... then you are entitled for another 3-years sojourn under rehire or reemployment condition... thank you.

E-8 din po ako dati, yung 3 yrs contract ko ended last January 2008 (from January 26, 2005 - January 2008) , na rehire po ako same company nakabalik March 03, 2008.

Nagparelease po ako last November 2008. May contract will end this December 28, 2009 (kasama sa bilang nila nung nag-exit ako. January 2008 - December 2009).

Depende po ba sa amo ibigay ung plus 3yrs or yun na po talaga ang sa batas nila plus 3yrs?

Another case din po, dun sa isang inapplayan ko tumawag yung sadjang sa Immigration tinatanong if 3 years ang visa ko. Sabi daw 2 yrs lang visa ko which means may 1 year nlang ako natitira - November 2008 ako nagparelease. Gusto kasi ng sadjang ung mahaba pa visa..

clarification lang... ilang taon po kayo under E-8 Visa? and kailan po kayo naging E-9 Visa?

hindi po depende sa amo ang sojourn period... it's an Immigration Law...

please refer below...

-> years of sojourn under E-8 (do not inculde it in counting of sojourn period under E-9)
-> years of sojourn under E-9: 3 years (first sojourn) + another 3-years (if rehired)

if ma-approve na ang 2-years new bill:
-> sa mga hindi pa narehire: first 3-years + 2 additional year = 5-years sojourn, then after 5-years hindi pa natin alam if meron pang rehire...
-> sa mga na-rehire na: first 3-years + 5-years (3-yrs after rehired + 2 additional yrs) = 8-years

if so... nung narehire ako from E8 to E9 meron pa akong another 5 years?

so sa mga nakabalik as E9 meron pa 5 years depende kung extend again more 2 yrs?

hindi ko po masyado naintidihan ang statement mo...

again, under E-9 visa, meron kang 3-years sojourn + another 3-years if ma-rehire po kayo... huwag mo na icount yung E-8 visa mo...

now, if ma-approve na ang 2-years additional sojourn...

para sa mga hindi pa narehire, maging 5-years na ang total sojourn nila... so they can work in Korea for 5-years before they get rehired if meron pang rehire in the future...

para sa mga nahired na, since natapos na ang kanilang 3-years under E-9, meron pa silang another 5-years stay sa Korea...

but as i've said, let's wait for further details until meron nang formal announcement about additional 2-years sojourn from the MOL. thanks.

Dear Foreign job-seekers of sending countries & HR managers,
This is the National Labor Consultation Center.
Many foreign job-seeks ask the same question frequently on reemployment procedures for forein workers. Therefore, we would like to provide relevant information as follows :
※ Remployment procedure 재고용절차

① applying for reemployment of a foreign worker to a job center(employer) 고용지원센터 재고용 신청(사용자) →② issuing an reemployment confirmation and notifying the Ministry of Justice and the HRD Korea of this(Job center) 외국인 근로자 재고용확인서 발급 및 법무부.한국산업인력관리공단 통보(고용지원센터) → ③ making a list of job-seeker to be reemployment[HRD Korea] & issuing a visa issuance certificate[Ministry of Jistice] 재고용 구직자 명부 작성(한국산업인력관리공단) 및 사증발급인정서 발급(법무부) → ④ departing from Korea and then reentering Korea(Foreign worker) 외국인근로자 출국 및 재입국 → ⑤ reporting the reemployment of the foreign worker[employer] 외국인근로자 재고용 신고(사용자)

① Applying for reemployment of a foreign worker to a job center
고용지원센터에 재고용 신청
- If an employer intends to reemploy a foreign worker whose employment period is due to expire, he/she should renew the labor contract with the foreign worker before the end of the sojourn period and then submit it to the competent job center with an alpplication for reemployment of a foreign worker who voluntarily departs from Korea after expiry of his/her employment period
사용자는 취업기간이 만료된 외국인근로자들을 재고용하고자 하는 경우 해당 외국인그노자의 체류기간 만료일 전에 근로계약을 체결한 후 “취업기간 만료 자진 출국자 재고용 신청서” 및 첨부 서류를 고용지원센터에 제출하여야 합니다.
② Issuing an reemployment confirmation and notifying the Ministry of Justice and the HRD of this
- After receiving an application for reemployment from an employer, the head of the job center checks out facts and then issues two copies of a reemployment confirmation(a letter confirming reemployment of a foreign worker whose employment period has expired), one for the employer and the other for the foreign worker. If a reemployment confirmation is issued, the head of the Job center should immediately notify the Ministry of Justice and the HRD Korea of this.
고용지원센터장은 사용자로부터 재고용신청서를 제출받은 경우 사실관계확인후 해당 사용자 및 외국인에게 “취업기간 만료자 재고용확인서”를 각 1매씩 발급합니다. 고용지원센터장은 재고용확인서가 발급되는 경우 이를 법무부 및 산업인력관리공단에 즉시 통보합니다.
③ Making a list of job-seeker to be reemployment & issuing a visa issuance
재고용구직자 명부 작성 및 사증발급인정서 발급
- The HRD Korea makes and manages a list of job-seekers to be reemployed based on reemployment confirmations provided by job centers. After receiving notiication of employment confirmation by a job center of the Ministry of Labor , the Ministry of Justice checks out this and then issue a visa issuance certificate to employer can receive the visa issuance certificate from the Immigration Office directly and through their agent.
한국산업인력공단은 고용지원센터로부터 통보받은 재고용확인서에 따라 재고용구직자 명부를 별도로 작성 관리합니다. 법무부는 노동부 고용지원센터로부터 재고용확인서를 통보받은 경우 이를 확인한 후 해당 외국인근로자의 사증발급인정서를 발급합니다. 이때 해당 외국인근로자 또는 사용자가 직접 출입국관리사무소에서 해당 외국인근로자의 사증발급인정서를 직접 발급받을 수 았으며, 대행기관에게 대행을 시킬 수 있습니다.
④ Departing from Korea and then reentering Korea
외국인근로자 출국 및 재입국
- A foreign worker whose reemployment is confirmed by his/her employer should leave for his/her home contry, carrying the employment confirmation issued by the Ministry of Labor and the visa issuance certificate issued by the Minisrty of Justice. A foreign worker whose reemployment is confirmed by his/her employer can reenter Korea if one month has passed since departure to his/her home country. The foreign worker can receive an E-9 visa if submitting the reemployment confirmation and visa issuance certificate mentioned above to the Korea’s Embassay in his/her country.
사용자로부터 재고용 확인을 받은 외국인근로자는 노동부로부터 발급받은 “취업기간 만료자 재고용 확인서”와 법무부로부터 발급받은 “사증발급인정서”를 소지하고 자국으로 출국해야 합니다. 사용자로부터 재고용 확인을 받은 외국인근로자는 자국으로의 출국일로 부터 1개월 경과하면 대한민국으로 재입국할 수 있으며, 입국전에 재외공관에 위 확인서 및 인정서를 제출하면 E-9비자를 받을 수 있습니다.
※ A forein worker whose reemployment is confirmed by his/her employer does not need to obtain any separate confirmation or permission form the sending orgarnization in his/her home country when he/she tries to reenter Korea, and is exempt from the Korean Language Proficiency Test and employment training.
사용자로부터 재고용 확인을 받은 외국인근로자의 재입국시에는 자국송출기관으로부터 별도의 확인 및 허가를 받을 필요가 없으며, 한국어 능력시험과 취업교육이 면제됩니다.
※ The Act on Foreign workers’ Employment etc, is under amendment in order to enable employers to reemploy foreign workers without requiring one-month stay outside Korea before reentry.
외국인근로자 재고용시 1개월 의무출국절차를 개선하여 출국절차없이 재고용이 가능하도록 외국인고용법이 개정중에 있습니다.
⑤ Reporting the reemployment of the foreign worker
외국인근로자 재고용 신고
- If a foreign worker reenters Korea to be reemployed, the employer should submit a reemployment report(a report on reemployment of foreign worker after expiary of his/her employment period) within 10 days the reentry date to the completent job center.
사용자는 외국인근로자가 재입국시 입국한 날로부터 10일이내에 고용지원센터에 “외국인 (취업기간만료) 재고용 신고서”를 제출하여야 합니다.

> TRAINEE PO KAMI JANUARY 2005 galing agency D-3 po visa namin
> then after 1 yr E-8 na po 'INDUSTRIAL TRAINEE EMPLOYMENT' from JANUARY 2006-2007
> then last June 2007 sabi po kasama na kame sa EPS wala na daw po kasi agency. January 2008 end of 3 yrs contract namin.
> exit kame for 45 days balik kame March 3, 2008 at same company. E9 VISA namin problem is 'till December 2009 nlang visa namin??? Ibig sabihin hindi ba po kame rehire? 5 years lang kame..

This is confusing
-> sa mga na-rehire na: first 3-years + 5years (3-yrs after rehired + 2 additional yrs) = 8-years

Ano ibig sabihin po if rehire? same company po kumuha sa kanila? Before po kasi after 3 year contract need to exit.
or rehire means OFW nakabalik ng korea nag-apply ulit sa POEA?

3yrs tapos exit + 5 (kasama dito additon 2 yrs) yun po ung mga umuwi pagkatapos ng contract at nag-apply po ulit??

gandang araw po mga kababayan... un din po sana gusto ko itanong kong pag natapos po ung 5 years may natitira pang extension na another 1year . this DEC. 2009 5 years straight po ako sa Company. plano ko po sana mag pa release kung mayroon pa akong natitirang another 1 year working Visa.. paki inform naman po ako SALAMAT PO!!
