Latest Revision for Paid Vacation Leave Benefits...
1) effective July 1, 2007, for workplace with 20 or more regular workers (under 40-hrs workweek system), workers are entitled for 15-days annual paid leave... however the 1-day monthly paid leave was removed for this workplace category only...
2) for workplace with 5 ~ 19 regular workers (under 44-hrs workweek system), workers are entitled for a 10-days annual paid leave only but at the same time they must also be given a 1-day monthly paid leave benefits...
REMARKS:
1) companies with below 5 regular workers including Koreans, hindi po obliged to give a paid leave benefits to their workers...
2) Korean version of Monthly Paid Leave System is 월차유급휴가
3) Korean version of Annual Paid Leave System is 연차유급휴가
4) kung hindi po kayo binigyan ng ganyang benefits, pwede po kayo magreklamo sa amo ninyo... if ayaw pa rin magbigay, you can file a petition at the Regional Labor Office directly covering your workplace.

Sir Dave, hi po magandang Monday morning po sa inyo. tanong ko lang po sana if pwede akong gumawa ng request letter sa company ng asawa ko dahil napag-usapan namin na magbakasyon siya this coming June 2009. nahire po siya last January 19, 2009 sa bagong trabaho niya(nagparelease po siya sa dating company niya). possible po ba yun Sir Dave para lang po payagan siyang makapagbakasyon? more than 5 regular workers po sila sa company where he works.

per standard procedure, as an employee your husband must personally request the vacation leave to his employer... but it is possible for you as his wife to send a formal letter to your husband's employer in support to his vacation request... but with regards to the approval matter, the employer has an authority to approve or disapprove your husband's vacation request especially if your husband absence from work will affect the productivity of his business... thank you.

sir dave gud eve po.nagun ko lang po kasi nalaman ang tungkol sa leave.more than 100 employees po kami pati korean.umpisa pa po eh di kami nakaranas na magleave hanggang ngaun po mag 3 years na kami.kung sakali po ba at di nagamit un leave convertible to cash po ba un?thanx po

if hindi nyo nagagamit ang yearly leave nyo dahil hindi pumayag ang amo then your employer must convert it to cash... bago mag-end ang 3-yrs ninyo, sabihin nyo sa amo ninyo na kelangan nyo na i-avail ang yearly paid leave nyo... if ayaw pa rin pumayag or ayaw magbayadn ng cash, then pwede kayo magfile ng petition sa labor office...

depende... if ur vacation was paid, then you just count kung ilan na natitira... yung 3rd year mo, u should use your leave before expiration of ur visa... if hindi magagamit, then you must receive the cash convertion before ka aalis ng company...
pls refer below more details i got from the ministry of labor on how to determine your number of leave per year depending on your company status...
1. Calculation Method of Annual paid leave vary with the number of workers of your company...
① Workplaces with 40-hour work week system (workplace with 20 workers or more)
- 15 days of paid leave is granted to a worker who has attended at work by the rate of at least 80 percent in one year.
- An additional 1 paid day per every 2 years of consecutive work
- 1 paid day per month of full attendance, for workers who work shorter than 1 year
For example, in case of a worker who joined the company on Jan .1.2008 and has worked until July.7.2009 with full attendance, 15days shall be granted as annual paid leave...
- 08.1.1-08.12.31 for a full year, attendance rate is higher than 80% = 15 days
- 09.1.1-09.7.1 = no annual paid leave, because the period does not meet the condition of 1 year
② Workplaces with 44-hour work per week system (workplace with 19 workers or fewer, in case of workplace with 4 or fewer no paid annual leave)
- 10 days of paid leave is granted to a worker who has fully attended at work in one year, while 8 days of paid leave is for a worker who has attended at work by the rate of at least 90 percent in one year (Available to employees who have worked for 1 year or longer)
- An additional 1 day per year of consecutive work.
For example, in case of a worker who joined the company on Jan .1.2007 and has worked until July.7.2009 , annual paid leave shall be counted as follows:
- 07.1.1-07.12.31 for a full year, if attendance rate is full attendance = 10 days
- 08.1.1-08.12.31 for a full year, if attendace rate is 95% = 8days + 1day
- 09.1.1-09.6.30 no annual paid leave, because the period does not meet the condition of 1 year
2. In case of a EPS worker, after completion of the first 3 years, he/she have to return to his/her home country. So in this case consecutive service years are terminated authomatically. After reemployment, consecutive work to calculate annual paid leave is recounted.
For example, in case of a worker who worked the company with 44 work week system from Jan .1.2005 to Dec.31.2007, was reemployed on Feb 1. 2008, and has worked until July.7.2009 , annual paid leave shall be counted as follows:
- 05.1.1-05.12.31 for a full year, if attendance rate is full attendance = 10 days
- 06.1.1-06.12.31 for a full year, if attendace rate is 95% = 8days + 1day
- 07.1.1-07.12.31 for a full year,if attendance rate is 100% -> 10days + 2days
After reemployment,
- 08.2.1-09.1.31 for a full year, if attendance rate is 100% -> 10ays
- 09.2.1-09.7.7, no annual paid leave
3. If the worker quits his/her workplace without using paid annual leave, the employer shall pay unused paid annal leave allowance to the worker concerned. And if you meet condition to be allowed paid annual leave, but your employer doesn't pay such payment, you may file your case with the competent local labor office.

sir dave, di po maopen yung link. please help po. mas maganda po sana kung may korean version/para po ipakita sa chajang namin..kasi po last time na in asked ko to..ang sbi niya at di daw kasali ang company namin.( that time ang pinabsa ko ang yung manual na galing sa traiing center na provided samin.). kasi ang sat and sun is holiday paid n daw...
Hindi po ba ito na din yung.. one day sudang namin.. every week kapag perfect attendance? 3yrs na po kami may 7 2010..
pinagbkasyon kasi kami ng one month last year pero wala kami natanggap na ganito from employer..sana po malinawan niyo ang aming katanungan . more power and god bless.
