Dear Dave,

This is the National Labor Consultation Center.

Regarding your questions, we would like to explain the maternity leave stipulated in Labor Standards Act (LSA) as follows:

According to Article 74 of the LSA, an employer shall grant a pregnant female worker 90 days of maternity leave before and after childbirth. In such case, 45 days or more shall be allocated after the childbirth. And an employer shall pay leave benefits for 60 days of the leave period, while Employment Insurance Fund will cover the benefits for the remaining 30 days upon application to the Job center. This provision is applied regardless of the female worker’s nationality.

If the employer violates Article 74 of LSA, he/she shall be punished by imprisonment of up to 2 years, or by a fine not exceeding ten million won.

More so, an employer shall not dismiss a worker by reason of only pregnancy, because according to Article 23 of the LSA, no employer shall dismiss a worker without justifiable reasons. Especially, no employer shall dismiss any female worker during a period of temporary interruption of work before and after childbirth as provided in article 74 and within 30 days thereafter. If the employer dismisses a female worker the aforementioned period, he/she shall be punished by imprisonment of up to 5 years, or by a fine not exceeding 30 million won.

kabayan,
applicable po ang maternity leave sa lahat ng regular female workers dito sa Korea... if ikaw po ay hindi nabigyan ng ganitong benefits during your maternity period, pwede mo habulin and benefits mo kung willing po kayong magfile ng petition against your employer thru the Ministry of Labor... if hindi mase-settle sa Ministry of Labor level, they will advise you to file a case in the Civil Court...

just be sure you have all proof of evidence such as medical certificate during your maternity period, medical receipts, etc...

try to file a petition for your Maternity Benefits... per policy kasi, dapat meron ka makuhang 60-days Paid Leave from your employer... and if member po kayo ng Employment Insurance (goyong boheom "고용보험") the time na nag-maternity leave kayo, meron din po kayong makukuhang 30-days Paid Leave... dapat sa Labor Office (job center) po kayo nagfile ng Employment Insurance noon...

by the way, yung goyong boheom "고용보험", yan po ang Employment Insurance... actually voluntary membership lang po yan... it will depend on the company... so yung iba walang ganyan... ang contribution mo dyan ay .45% of your average monthly salary plus another .45% from your employer... ang benefits po dyan are maternity paid leave and allowance for unemployment such as company shutdown or less working hours...

ask ko lng po,about my case nanganak po ako d2 pero nagpareles po ako sa dati kung employer 5 months na tyan ko pero hnd alam ng employer ko na buntis ako, sa employer ko hnd ko pwede e claim yon hnd alam at nagpareles ako. Ask ko lng ung tungkol sa Insurance Fund will cover the benefits for the remaining 30 days upon application to the Job center. kung my makuha ako d2.thank you po

if ngparelease po kayo bago kayo nanganak, wala po kayong makukuhang maternity benefits kasi hindi naman kayo nakapag maternity leave while working in the said company...

for luv96,
same situation pa rin, if nagparelease po kayo bago kayo nanganak at hindi na kayo nakapagtrabaho until your delivery, you cannot receive any benefits from the Employment Insurance because hindi po kayo connected with any company... and for that reason, you're not a member of Employment Insurance anymore...

sir hindi po ganun ang case ng misis ko..kasi nagbuntis sya at nangank habang nasa previous company pa sya. After nya makapangank,nakapagtrabaho pa sya ng 6 months sa dati nyang company.

hello po sir Dave,ask ko lang po kung kailan pa na implement iyang batas na yan about sa Maternity?anong year? kasi 2007 nagpreggy ang wife ko d2 sa korea, and then nung 7 months na ung tiyan nya nirelis sya ng amo nya, and kinausap namin kung bkit,ang sabi sa amin they don't allowed pregnant women sa company nila, ni wala man lang 1 month notice sa wife bago sya inirelis, then lumapit kami kay father Glenn, ang sabi ni Father Glenn, my karapatan ang comp. sa ganun sitwasyon, as long as nasa bylaws ng comp. and Fr.Glenn tried to talk d comp. wala din nangyari, and then pumunta kami sa Labor sa Anyang, meron na dun sa computer nila na application for termination sa wife ko, sabi ko bakit ganun w/out any notice basta-basta nalang irerelis ang wife ko, ang sabi lang sa amin ng labor "pwede naman sya manganak d2 sa korea and then after nya manganak makakahanap ulit sya ng work" provided na covered sya ng law of korea for maternity leave, sabi din sa amin 90b4-90after prenancy, at meron pang 30 days extension kung hindi pa daw kaya ng wife ko mag work, basta pumunta lang daw sa Labor para sa extension ng leave, tingin ko lang ha! hindi din nasusunod ung ganun, minsan d2 sa korea may discrimination sa mga foreign workers, anyway for good din naman kasi nasa pinas na ung mag-ina ko, they were both healthy and happy...more power! Very Happy

per Korean labor law, hindi po talaga pwede iterminate ang isang worker kahit foreign worker for the reaosn na buntis siya... pero may mga employer kasi na madiskarte at hindi takot sundin ang batas.. alam kasi nila na by the time na mag maternity leave na ang worker for 90-days, syempre hindi na siya magtratrabaho at isa pa, kung hindi po ipina-member ng employment insurance ng employer ang worker, with pay po ang 2-months maternity leave shouldered by tne company... yun ang iniiwasan nila... so, gumagawa po sila ng reasons sa labor kahit hindi naman totoo para mairelease lang ang worker...

sa case mo, i suggest, uunahan mo ang employer mo.. punta ka sa labor office as soon as possible na may jurisdiction sa location ng company nyo, at ipaalam dun na may balak ang company na irelease ka dahil buntis ka... dalhin mo ang prenatal receipts mo from the hospital as proof na buntis ka... in that way, i hope the labor office will protect you your employer's plan...

hi imee,

kung irerelease po talaga kayo ng employer nyo, you can ask the labor office to extend your release period until manganganak na po kayo at pwede na makapagtrabaho uli... then, if meron na po kayong release paper approved by labor, punta ka sa immigration office dala ang release paper mo para irenew ang ARC mo within 2-months before expiration...

but take note hindi po kayo pwede makauwi ng Pinas while nakarelease po kayo...

one more thing, as i've said before, you should visit the labor office now or visit any migrant center na pwedeng tumulong sayo para i-explain sa labor office ang situation mo regarding sa plan ng employer... per labor law, hindi po talaga pwede i-release ang isang EPS worker sa kadahilanan na buntis siya...

try to contact Seoul Global Center @ 02-2075-4149 baka pwede silang tumulong sayo... or try contact Korea Migrant Cebter @ 1644-0644... may mga Filipino-Koreans na nagvolunter dyan at pwede din kayo mag ask ng help...

gudpm po.itanong ko lang po if paano ba talaga procedure ng magparelease kasi yong unang release ko sa jeju yong employer ko po kasama ako nag asikaso ng papers ko punta labor at immigration pero now sa second employer ko may pinapirmahan lang sakin tapos wala na.yan din po ginawa nila sa mga dati na umalis sa kanila.ako daw ang pumunta sa labor para humingi ng release.nagstop na po kasi ako sa work ko dahil sa sitwasyon ko.malayo po kasi ang work ko sa haws.nahirapan na po kasi ako magbiyahe kahit na ilang buwan pa lang yong pagbubuntis ko at saka lagi masama pakiramdamdam ko.mahirap magtrabaho kaya ako nagdecide na magparelease at plan naman ng company na iparelese ako after 4months.kahapon last day ko at sa monday ako punta sa labor.dito pala ako sa incheon.ganito ba talaga ang procedure sa pagpaparelease?tinanong ko yong dating nagparelease sa labor lang daw sila pumunta di na sila pumunta sa immigration.ano po ba ang tama at dapat ko gawin.salamat po.

pwede din po ang ganun punta na lang po kayu sa labor na malapit sa inyo at sabihin nyu sitwasyun nyu and tatawag lang po sila sa amu nyu apra mabgyan ka ng release paper i fax lang naman po yun sa pagkaalam kopo eh kailangan pumunta ka ng immig kasi nga buntis ka para mabigyan ka ng mahabang extension .kailangan nyu lang po ang mga docs na magpaptunay na buntis kayu.. pwede paki pm nyu ang cp# nyu sakin para mabigay ko complete details po.... kasi 2 sa friends ko eh ganyan ang nangyari sa kanila para po mabgyan po kayu ng complete info...

gudpm!galing po kami ng asawa ko sa labor pero wala pa naman nafax yong company ko sa labor.matanong ko lang po ano ang name ng papers na yon na galing sa employer.bakit di nila agad nagawang ifax sa labor.baka tagalan nila ang pagfax till na hindi na ako pwede mabigyan ng extension ng labor.bakit po ba ganun.kong release paper po yong galing sa company bakit di ako binigyan noong last day ko.humingi ako para may ibigay ako sa labor.

sayang ngayon ko ako nkapagregister dito s sulyap pinoy forum.. sana nalaman ko n my law pla pra s mga nabuntis n eps workers,,isa kc ako dun last 2010 kaso natakot ako marelease ng boss ko pg nalaman nya n buntis ako kaya hindi ko pinaalam s knya 4months n akong buntis nung ngdecide akong mgresign nlng at umuwi ng pinas..Hindi ko alam n pwede pala taung mag maternity leave,,,tsk,tsk,tsk! poor me..hindi ko nlng tinapos ung contract ko kesa pauwiin ako ng boss ko,,sana nalaman ko agd noon n hindi pla pwede mapauwi ang mga eps workers khit buntis,, ang laki ng hinayang ko.. anyway THANK U po s info,atleast ngaun alm
