good day po..ask ko lang po sana kung pwede p pong iapply ung maternity pay ko s labor kahit nanganak n po? kasi hndi ko po naapply nung buntis po ko..o ung sajang po b dpt mgapply non? thanks po...

yes, you can still apply... just ask your employer on how to get your maternity benefits...

please refer below for more information...

According to Article 74 of the Labor Standards Act, an employer shall allow 90 days of maternaty leave before and after childbirth. In this case, 45 days or more shall be allocated after the childbirth.

And according to Article 74(3) of the same Act, the first 60 days leave shall be with pay. These articles mean
1) that an employer shall allow maternity leave to the pregnant worker because this leave is a legal leave and if the employer violates this article, he/she shall be punished by a fine not exceeding 10 million won or by imprisomment.
2) that for the first 60 days maternity leave, an employer has a responsibility to pay ordinary wage to the worker in leave and that the rest of maternity leave (30days) may be with unpaid or paid based on agreement between an employer and the worker.

However, according to Article 12 of Enforcement Decree of Employment Insurance,
1) when the employer falls into the scope of preferrentially supported
business
and
2) when the worker's insured period is 180 days or more before the completion of the leave period, the government will give 90 days benefits up to 1.35mil won a month to the worker. (In this case, if monthly maternity leave benefit less than ordinary wage, the employer shall pay the difference for the first 60 days.)

Companies belong to scope of preferrentially supported business:
1) Manufacturing: Companies with 500 workers or fewer
2) Construction: 300 workers or fewer

good eve po, yung s benefits n dpt ibbgy ng boss ko mkhng malabo po..pero nung buntis po ako,pngleave n po ko 5 months plng ang tiyan ko..at wla p po kong isang taon s company q..s labor po kya? paano po kung hndi aq tulungan ng boss ko pra mkuha ko un?sorry po hndi ako mktwg,wla po kong card eh..sncya n po,..slmt

so sa ibang company ka na pala ngayon? actually kahit wala ka pang 1-yr sa company, u can still avail the 60-days paid maternity leave to be paid by the company granting na hindi ka insured ng Employment Insurance...

yung sinabi mong benefits from labor, un nga ang 90-days or 30-days maternity leave to be paid under ng Employment Insurance granting na insured ka thru paying monthly contribution na dinideduct sa sahod mo... pero if hindi ka insured, wala po kayong makuhang benefits sa Korean government thru Employment Insurance...

if nalilito ka pa rin sa sagot ko, you better call me nalang para ma-explain ko sayo ng detalye...

sir dave un bang insurance na cnasbi mo eh ung goyong bohom kung wala po akong kaltas non every month wala akong makukuha sa korean goverment................kc nakuha ko po ung 60 days sa boss ko ung sa korean goverment po ang wala kc wala nmn ako kaltas ng goyong bohom

yes... tama po kayo... 고용보험 (employment insurance) pero sa ibang company iba din ang nakalagay sa payslip nila like 장기요양보험료...


kaya if di kayo sigurado if insured kayo or hindi, you better call the Labor Office for confirmation... just ask by giving your ARC number... phone number is 031-345-5000 (english)

to sir dave po.....need help two months pa lng po ko sa company namin...mag 7 months na po tiyan ko next month.....ngayon po gusto ko sana umuwi pinas at dun manganak....kaya lang po ayaw ng company namin...ang sabi po irelease po nila ko kung di ko na kaya mag work and kung gusto ko bumalik sa kanila after manganak ok lang daw...ang kaso,di po ata ako pwede umuwi na release,kc ang employer po ang magbibigay ng re entry....pls help.....pwede po bang ako mismo mag apply ng re entry ko sa immigration with out employer?....thank you

di po pwede basta nalang irerelease ang isang EPS worker dahil siya ay buntis... yung sinabi ng amo mo na irelease ka tapos after nanganak ka pwede ka magapply uli sa kanila, halatang gusto lang ng company mo na tatakasan ang responsibility na magbayad ng paid maternity leave...

my suggestion is, magpaprenatal ka ng any hopsital dito, tapos hingi ka ng medical certificate na magproprove na buntis ka at ilang buwan na ang tiyan mo...

punta ka sa labor at sabihin mo na irerelease ka daw ng company dahil buntis ka... im sure tatawagan ng labor ang amo mo at sabihin na di pwede yan at violation sa labor law...

you should avail the paid maternity leave na 60-days if di kayo member ng Employment Insurance...

pag pumunta ka ng labor office, huwag ka magsabi sa employer mo...
