tanong lang po ung vacation leaved kung pd namin makuha kc 3 yrs po ako alang absent babayaran ba yun ng emloyer namin mga magkano naman kaya ang computation nun sa 3 yrs..tnx

if hindi nyo na-avail ang paid leave ninyo within 3-years, you must get the cash conversion... ang 1-day paid leave is equivalent to 1-day regular work salary... please refer below for you to know kung ano pong category kayo na-belong...

Latest Revision for Paid Vacation Leave Benefits...

1) effective July 1, 2007, for workplace with 20 or more regular workers (under 40-hrs workweek system), workers are entitled for 15-days annual paid leave... however the 1-day monthly paid leave was removed for this workplace category only...

2) for workplace with 5 ~ 19 regular workers (under 44-hrs workweek system), workers are entitled for a 10-days annual paid leave only but at the same time they must also be given a 1-day monthly paid leave benefits...


REMARKS:
1) companies with below 5 regular workers including Koreans, hindi po obliged to give a paid leave benefits to their workers...
2) Korean version of Monthly Paid Leave System is 월차유급휴가
3) Korean version of Annual Paid Leave System is 연차유급휴가
4) kung hindi po kayo binigyan ng ganyang benefits, pwede po kayo magreklamo sa amo ninyo... if ayaw pa rin magbigay, you can file a petition at the Regional Labor Office directly covering your workplace.

sir Dave,
ngayon ko lang po naunawaan ang ganitong benefits.. maari po bang mag claim nito gayung naka 2 years na ko dito sa work ko ? nagtanong po ako sa isang kasamahan galing sa ibang co. (release) wala daw po siyang natanggap na ganitong benepisyo.. gayun din po sa isang ksama na 2 and 10 mos na dito sa isang co... ano po bang magandang approach sa Kwajang para itanong ito?

if hindi mo nagamit ang Paid Leave benefits nyo because your employer does not initiate, after 1-year, you can ask for a cash refund or your employer must provide you with a vacation using your leave benefits...

kung meron din kayong temporary plant shutdown pwede nyo rin yan gamitin... and if ever hindi talaga nagamit within 3-years, before you will go back to Phil. you should receive the cash conversion of your paid leave benefits...

but take note, ang paid leave benefits ay applicable lang po sa mga companies with 5 or more regular employees...

let's say you've started working in Korea in the year 2007... your ANNUAL PAID LEAVE must be...

1) if under 40-hrs workweek system:
-> 1-day paid Leave is equal to 8-hrs minimum wage
-> 1st Year (15-days Paid Leave) + 2nd Year (15-days Paid Leave) + 3rd Year (16-days Paid Leave) = 46-days within 3-years with perfect attendance
-> Minimum Wage Per Hour: 2007 was 3,480won/hr, 2008 was 3,770won/hr, 2009 is 4000won/hr.
-> Paid Leave Equivalent: Year 2007 (15 x 3,480 x 8) + Year 2008 (15 x 3,770 x 8) + Year 2009 (16 x 4,000 x 8)
-> Equals: 417,600 won + 452,400 won + 512,000 won = 1,382,000 won (Total Vacation Leave Equivalent to Cash)

2) if under 44-hrs workweek system:
-> 1-day paid Leave is equal to 8-hrs minimum wage
-> 1st Year (10-days Paid Leave) + 2nd Year (11-days Paid Leave) + 3rd Year (12-days Paid Leave) = 33-days within 3-years with perfect attendance
-> Minimum Wage Per Hour: 2007 was 3,480won/hr, 2008 was 3,770won/hr, 2009 is 4000won/hr.
-> Paid Leave Equivalent: Year 2007 (10 x 3,480 x 8) + Year 2008 (11 x 3,770 x 8) + Year 2009 (12 x 4,000 x 8)
-> Equals: 278,400 won + 331,760 won + 384,000 won = 994,160 won (Total Vacation Leave Equivalent to Cash)

3) if under 44-hrs workweek system, meron pang Monthly Paid Leave if you have perfect attendance each month...
-> 1-year = 12 months
-> Paid Leave Equivalent: Year 2007 (12 x 3,480 x 8) + Year 2008 (12 x 3,770 x 8) + Year 2009 (12 x 4,000 x 8)
-> Equals: 334,080 won + 361,920 won + 384,000 won = 1,080,000 won (Expected Total Monthly Paid Leave for 3-years)
