Bill submitted to improve migrant worker visa rules

A governing party lawmaker has submitted a revision bill seeking to ease restrictions on renewing work visas for migrant workers and prevent them from being deported due to unfair treatment or law violations by employers.
“I have proposed the bill to protect diligent migrant workers and encourage them to return to Korea while adhering to the government’s policy of rotating them and preventing their permanent stay,” Rep. Kang Sung-chun of the ruling Grand National Party (GNP) said.
The GNP lawmaker claimed that his bill would prevent employers from abusing the existing “three-changes-and-out” policy as it exempts migrant workers who have been exploited or unfairly treated from the controversial regulation.
Under the current law, migrant workers are permitted to change their workplaces only three times during their stay here. Those leaving their third workplace have to return to their home country whether or not the employer infringed on their rights.
The revision bill states that exceptions should be made if “the employer breached work conditions or if migrant workers cannot continue to work in their workplace due to reasons that they are not responsible for.”
Pro-immigrant activists have been demanding the government scrap the regulation on the grounds that it infringes upon the freedom of job choice and the general pursuit of freedom guaranteed in the Constitution.
The Constitutional Court ruled last month that the three-changes-and-out policy does not violate the basic law, saying it promotes balanced national development, allows effective management of foreign laborers and protects the rights of Korean workers.
Kang added that should his bill be approved, foreigners will also only have to stay abroad for one month to renew their work visa, instead of the current six months, from the time their five-year work permit expires.
There have been mounting calls for a revision to the law as non-Korean nationals are allowed work permits for no more than five years, and must stay abroad for a minimum of six months before being able to work here again.
The bill stipulates that the previous employer must express his or her willingness to rehire departing migrant workers for a minimum of one year to the Ministry of Labor.
Those returning to Korea upon the employer’s request would be exempt from a Korean language test and job training course that migrant workers had to undergo again even if they had extensive work experience here.
