The Ministry of Justice has eased penalties for employers hiring illegal foreign workers.

This softer policy comes at a time when small- and medium-sized firms are suffering from manpower shortages but is against its overall policy of reducing illegal immigrant workers.

Under the new rule, companies will face a one-year ban on hiring additional foreign staff if they are caught employing illegal foreign workers. Currently, the ban is three years.

This rule will be applied retrospectively, making it possible for nearly 3,030 companies to hire foreign workers again this month.

``It will help ease the chronic workforce shortage at small companies,'' the ministry said. But side effects are expected as firms might hire more undocumented foreigners due to the lighter penalty.

The ruling comes at a time when the government is facing growing criticism from small companies that say the drastic cut in foreign worker quotas earlier this year is a major culprit behind illegal employment.

In March, the Ministry of Labor slashed the number of work visas ― H-2 and E-9 ― issued to foreigners from 100,000 to 34,000, a measure aimed at providing more job opportunities for Koreans amid the worsening job market situation.

``Increasing the quota would be a better solution,'' Cho Jae-woo, president of Sammyung Engineering, a small plastics manufacturer at an industrial complex in Incheon, told The Korea Times.

Cho's company benefits from the new rule. ``Virtually no Korean wants what people call 3D jobs ― dirty, dangerous and difficult. In this context, businessmen have no choice but to seek foreign workers, whether legal or not. But the quota reduction made it harder for them to seek legitimate foreign workers.''

The government has no immediate plan to hike the quota, at least until next March.

The justice ministry said the new rule will not affect the ongoing crackdown on foreigners overstaying their visas, which will continue until the middle of next month.

``The deregulation is to help revive the sagging economy,'' said Yoo Byeong-gil, a ministry official.

The government estimates nearly 184,000, or 15.9 percent of 1.16 million foreign residents, have overstayed their visas.

Since September, the Ministry of Labor and the Small and Medium Business Administration have been on a nationwide campaign that encourages undocumented foreigners to leave the country on their own and so far more than 2,500 have left the country voluntarily. Those who leave are exempt from fines and are allowed to return one year after their departure, the ministry said.

magbibigay lang po ng konting komento, sa ginawa po ng Ministry of Justice na bawasan ung penalty instead of 3 yrs to 1 yr lang, malaki ang epekto nito sa illegal worker, lalo lamang dadami ang mga illegal worker sa korea, iisipin ng mga mapagsamantalang employer na "ok lang na mag-hire ako ng illegal tutal naman 1 yr lang naman ang penalty at makakakuha ako ulit ng tao" (legal pa!) eh bakit nga ba sila naghihire ng mga illegal? kasi walang masyadong aasikasuhin, madali lang start agad!sabi ng ibang amo, kaya daw sila nakuha ng illegal kasi wala dw korean national ang nagtsatsaga sa mga 3d's work, ang mga legal (EPS) eh marunong na daw umangal at marereklamo, sa isang banda, nakikita ko na hindi kaya ng Ministry of Justice ang tantrums ng mga Small Business owner, kasi aminin natin na most of the company sa korea ay small or family business lang, eh bakit hindi kaya gawin ng Ministry of Justice na gumawa sila ng isang resolusyon na makakapagbigay lunas sa mga illegal worker, instead sa taunang crackdown! tapos kapag umaangal na ang mga small businesses bigla naman sila magbibigay ng option... pabor sa mga mapansamantalang amo, eh paano naman ung mga nahuli na nag-excert ng effort nila? kawawa naman tayong mga migrante, suhestiyon lang po!
