merong bagong offer ang Korean government thru immigration ngayon para sa mga TNTs... according to the news, all irregular migrants can leave Korea without any penalties basta mag voluntary exit sila starting May 5 ~ Aug. 31, 2010... meaning wala nang 5-yrs ban and fines... so pwede na silang makakabalik ng Korea under normal visa application process...

Illegal immigrants given until Aug. 31 to leave S. Korea

(Yonhap) -- South Korea will introduce a temporary grace period to allow foreigners staying here illegally to leave without punishment, the Justice Ministry said Monday, while promising to crack down on those who fail to depart ahead of the Seoul G-20 summit.

The measure will go into effect from Thursday until Aug. 31 under a government effort to reduce the number of foreign nationals staying here without permission, the ministry said. About 180,000 are estimated to be residing in South Korea illegally.

Illegal aliens who voluntarily leave the country during the grace period will be exempt from fines and a five-year ban on future entry, the ministry said, noting they will be allowed to reenter the country through the normal screening process later.

Local businesses that report undocumented migrant workers to immigration authorities will also have fines waived and receive high priority for a pool of substitute workers provided by the Labor Ministry, officials said.

Under current law, those who employ unregistered foreigners are subject to a fine of up to 20 million won (US$17,900) and a ban on future employment of foreign residents for up to three years.

After the grace period expires, the Justice Ministry said it will join hands with police to step up a crackdown on illegal aliens and their employers.

"The voluntary departure program will go side by side with the government's clampdown on the illegal aliens to minimize side effects from the law enforcement and enhance security in preparation for the G-20 summit," Seok Dong-hyun, chief of the Korea Immigration Service, told reporters. Seoul will play host to the fifth summit of the Group of 20 advanced and emerging economies in November.

Similar measures were adopted in 2003 and 2005, resulting in 1,793 illegal foreign residents leaving the country in 2005 alone, Seok said.

Mr. Dave ano po kaya un, kapag nasa Airport na po ung Volunteer, wala na din po bang itatatak sa passport nila? kasi meron po mga umuwi dati tinatakan din po passport nila.mahirap din kasi maniwala sa mga korikong hanggang salita lang din palagi.

matagal na po yan o yan po lagi ang cnasabi nila mga grace period to leave the country kesyo wla na daw penalty or ban pag umuwi ka wid in that period pero mwwala din agad yan ng prang bola and then another agreement na nman ang lalabas..kumbaga prang irregular din ang mga batas ng korea...

magkaiba po ang rules ng amnesty ngayon kesa dati like what you have said na na-avsil ng pinsan mo... ito may chance lang po kayo makakabalik if mag-aply kayo under EPS (E-9 Visa) and other visa like tourist visa, E-7 visa, etc granting qualified po kayo sa mga requirements...

hi.. im new here.. gusto ko po itanong pano i-process ung "departure program " ng south korea, pno po mg-apply for re-entry?.. how can we apply for the KLT(kc requirement for taking exam,dpat alang immigration violation).. ttanggapin po b kc sa POEA without any discrimination?.. how sure are we,n exempted sa re-entry ban un mga volunteers n ng-exit ng korea? ... pls . any reply wud do.. tnx.

gud pm poh...bago po aq sa site na 2 en thanx dhl merung forum natulad nito! nahuli po kami last june 2010 bnayaran po lahat ng sajang nmn penalty at gusto nya kami uli kuhanin! ask lng po kng may problema po ba sa papers kng sakali change name po kami at mag apply kami as e7 visa? knuha po kc fingerprints nmn...willing po ang amu nmn na kuhanin kami uli un nga lng po d po nmn alam kng panung proseso ang ggawin para makapasok uli kami ng korea may visa man o wala pero sana po kht e7 visa ...sana po matulungan nyo kami ! maraming salamat po en more power! godbless ! =)

if nakuhanan po kayo ng fingerprints, there is high possibility na madedetech kayo ng immigration check if ever magchange name kayo at makabalik ng Korea... mag-iimplement na po kasi ang immigration ng fingerprinting check starting this month yata... (not sure when)

mga kabayan check nyo mabuti info tungkol dyan saka dapat kung susuko mga TNT make sure na marami kasi pagkunti lang baka magkaroon ng discrimination kasi TNT din dati ko sa taiwan nung nag bigay ng offer ang taiwan gov humanap kami ng mga kasama para sumuko yun mas nakabuti, kaysa mahuli kayo malaking pera yang 17k usd may detain pa yan....kung makakabalik kayo ng nasa procedure much better,,,,

di bale, meron namang klt exam para maging legal, pero pag di pumasa, meron pang ibang paraan.. aside from tourist visa na change name, magentertainer nalang. dami ata gumagawa nun. pinsan ko, nagentertainer, after 1 week, eskapo... he he he joke lang..wag natin gayahin. maigi pa rin ang maging legal

hello po! gusto ko po sanang umuwi ng pinas. Nag work ako dito as entertainer pero ang kasamaang palad instead of 450 dollars ang sinasahod nmin binibigay lang promoter ay 300t won. hndi man lang nmin nahawakan passport namin at alien card. (pagkakuha pa lang ng passport namin sa pinas kinuha na agad ng manager). hindi pa kmi nka address sa nasabing lugar d2 sa pyongtaek kaya tinatago din kmi sa immigration. so naisipan kong tumakbo. ngayon sana gusto kong umuwi na lang kesa mahuli ako. pero dko alam ang pasport number ko. meron lang ako nung photo copy nuung nauna ko pang passport. Gusto ko sna mag apply for loss passport kesa maghabla pa sa promoter. Saan ba ako pede makakuha ng affidavit of loss. Me pinoy law firm ba sa seoul na pde makakuha nun gaya sa pinas. salamat.

magandang hapon po, ako po ay EPS E-9 visa po dati nakarating po ako ng korea december ng 2005, ngunit sa kasamaang palad nag TNT po ako at umalis po ako sa factory namin dahil sa lagi po akong pinapahirapan ng amo ko, dahil po sa hirap ng dinanas ko ay nag pasya po akong umuwi ng dec.2006 pabalik ng pilipinas. bali 1 year lang po ako sa korea, nung umuwi po ako ay derecho lang po sa incheon airport wala pong harang sa akin, basta tinatakan po ako ng departed incheon, korea nakalagay sa passport ko, tanong ko po ay, balak ko pong mag-exam ulit sa EPS-KLT ngayong Nov. dto sa pinas, sir dave may record po kaya ako sa immigration nila dahil matagal na naman ito at kung sakaling makapasa ay 2011 pa kami makakaalis.. pede pa po ba akong makabalik ng korea? may record po kaya ako sa immigration na bawal na akong bumalik sir, salamat po...

in my personal view sa situation mo, wala na pong problema kasi nagvoluntary exit po pala kayo... tapos 1-yr lang po kayo naging tnt... pag nahuli kasi ang isang tnt, automatic 5-yrs po ang entry ban... pero since nagvoluntary exit po kayo, i think pinakamababa nyong entry ban is 1-yr but definitely not more than 5-yrs...

shiro12, follow-up lang ako dun sa sagot ni Mr.Dave, kung medyo alangan ikaw pwede ka pumunta ng korean embassy sa pinas, ipa-check mo dun ung name mo kung nasa watchlist or blacklisted ka,meron kasi ako friend umuwi xa Oct.2009,(voluntary exit) then gusto nya mag-exam this Nov.sabi sa kanya ng POEA much better na iconfirm nya muna kung nasa watchlist pa xa ng korean embassy, since ang 1 year ng friend ko e sa Oct.22,2010 pa base dun sa list ng korean embassy, sabi sa kanya nung taga embassy, its up to POEA kung iaaccept nila ang application anyway after ng Oct.22,2010 ok na ung status nya, sabi sa embassy, pero not sure pa, kasi base dun sa letter kay Manalili (see at POEA website)

only inclusion on the available list of jobseekers available for employment.
Those who fail to pass the medical examination, has record of illegal stay in Korea,

only inclusion on the available list of jobseekers available for employment.
Those who fail to pass the medical examination, has record of illegal stay in Korea,
cannot be selected as job seekers."

mga kabayang may record as TNT sa Korea,

gusto ko lang linawin ang statement na to from POEA (refer above)... hindi po ito ibig sabihin na lahat na may record as TNT in Korea hindi po qualified sa KLT-Exam... ang ibig sabihin po dito, after KLT-Exam, if HRD Korea have found out na hindi pa tapos ang ENTRY BAN PENALTY ng isang applicant, yun ang di qualified for job selection...

wala pong discretion ang POEA to check the OVERSTAY status of an aplicant in Korea... only the HRD thru Immigration record...

so kung ang isang applicant natapos na po ang 5-years entry ban niya or yung mga nagvoluntary exit na merong lang less than 5-years entry ban, wala pong problema yan...

pero the best way to confirm your status if cleared na po kayo sa blacklist/watchlist, better visit the Korean Embassy in Manila...

that means wala po silang nakitang problema sa status and sa mga papers nyo... but i cannot still say na 100% okay na ang entry ban nyo unless you can verify your status at the Korean Embassy...

hi.. about sa departure program this year.. un mga volunteers n mgexit ng korea will have only 1 year entry ban, right?... from an inquiry POEA about 7tH KLT exam.. kelangan after a year p raw pwede mkpgtake exam ung mga volunteers n un..so, hndi po papayagan n mkpgtake this 7th KLT.. prang malabo po yata, hindi po ba dapat payagan kmi mkpag-exam and then after a year lng kmi pde mkbyahe to korea kng mgka-employer n.. ang point po kc dito, wlng nkkaalam kung kelan ulit ang next KLT after ng 7TH KLT.. just like before the 6TH KLT, 3 years n hindi cla ngconduct ng KLT.. pano po un, hindi malinaw ang pgdisperse nila ng info. at my possibility n d mbigyan ng chance ang mga volunteers n ito n mkpgtrabaho ulit s korea.

hi.. about sa departure program this year.. un mga volunteers n mgexit ng korea will have only 1 year entry ban, right?... from an inquiry POEA about 7tH KLT exam.. kelangan after a year p raw pwede mkpgtake exam ung mga volunteers n un..so, hndi po papayagan n mkpgtake this 7th KLT.. prang malabo po yata, hindi po ba dapat payagan kmi mkpag-exam and then after a year lng kmi pde mkbyahe to korea kng mgka-employer n.. ang point po kc dito, wlng nkkaalam kung kelan ulit ang next KLT after ng 7TH KLT.. just like before the 6TH KLT, 3 years n hindi cla ngconduct ng KLT.. pano po un, hindi malinaw ang pgdisperse nila ng info. at my possibility n d mbigyan ng chance ang mga volunteers n ito n mkpgtrabaho ulit s korea.

yung nakapag-avail ng amnestry program (departure support program ng Korean government) which was started last May 6 ~ Aug. 31 this year), wala po silang entry ban kahit 1-year... so automatic pwede po sila makapag-exam ng 7th EPS-KLT provided qualified po sila sa age limit na 38, and other requirements...

pero yung nag voluntary exit before May 6 this year, i think 1-year po ang minimum of entry ban... so, if wala pa po silang 1-yr, they cannot take the exam yet...

i just called POEA at 722-1146... at cnabi nilang d kmi ppayagan mka-exam this 7th KLT.. after 6mos or a year p raw po. i think i availed the amnesty program kc umwi ako last july 3,2010... pero bakit po ganon, ang labo po.. i really hope n payagan kmi mgtake ng KLT this time.. at tuparin un pangako nila n walang entry ban..nkaregistered din po ako sa poea e-registration... pls. help.. tnx.

im sure di po alam ng nakasagot from POEA sa tawag nyo ang details ng Foreign Workers Employment Act... sabihin nyo sa kanila na hindi naman kayo legal... TNT po kayo... yan po ang pinaasa ng Korean government sa inyo na pwede po kayo mag-exam uli pag nag-avail ng amnesty...

sabihin nyo sa kanila, na ang 6-months requirement bago pwede mag-exam ay applicable lang po sa mga legal EPS workers (E-9 Visa) na kakauwi lang... but for other visa holder and TNT hindi po applicable yan...

suggest ko tawagan nyo ang POLO Office dito sa Korea to ask help... dapat ma-explain ng POLO ang agreement na yan...

walang namang problema yan kasi malalaman din naman ng HRD ang naging status nyo dito sa Korea kasi iveverify po nila ang names nyo sa kanilang centralized immigration record system...

pero para iwas gulo dyan sa POEA, huwag mo nalang ilagay... kasi pag nakita na naman yan ng POEA, baka kukulitin ka na naman sa mga tanong at baka sabihin na naman hindi kayo allowed to take KLT exam...

kung meron kayong work experience dati excluding yung TNT status , yun nalang siguro ilagay nyo...

another problema rin po khit d ilagay sa resume... d b, sa pre-screening iccheck po b nila passport?..atbp.. so mkkita rin nla un entry at exit ko sa korea.. big deal p rin po ba un pra pigilan kmi kumuha ng exam.i think, the reason y is, discrimination itself, pasintabi n rin po. sana nmn tuparin nila un nsa amnesty program..

email me at sulyap.managing@gmail.com... i will send you the official notice from the Korean Immigration stating that whoever may avail the amnesty program shall be exempted from any penalties like entry ban... in that way, they can take KLT exam again and apply for E-9 visa thru POEA...

Kabayan pakiusapan nyo nlang tlaga sila…

Sa EPS kasi dalawang parties ho iyan, “the sender and the receiver”, so ibig sabihin nakadependi parin ho sa bawat isa. Kahit sabihin pa ng receiver na okay! Eh, ang kanila paring magagawa ay ang tumanggap kung ano ang pinapadala ng sender.

Ito po ang memorandum nila,

Parasraph3. Sending Agency and Receiving Agency

1. The Department of Labor and Employment of the Philippines (hereinafter referred to as
the "DOLE') is the government agency primarily responsible for sending Filipino workers to
Korea under the EPS.

2. The Ministry of Labor is the government agency primarily responsible for receiving
Filipino workes who are send to Korea under the EPS. The MOL will activelv exclude
employers not qualified under the Foreign Employment Act.

3' Upon agreement of the parties, the DOLE designates the philippine overseas
Employment Administration (hereinafter referred to as the "POEA"), an attached agency
thereof, to exclusively serve as the sending agency.

4' The MOL designates the Human Resources Development Service of korea (hereinafter
referred to as the "HRD Korea"), an affiliated agency thereof, to exclusively serve as the
receiving agency.

but there must be the legal basis of POEA's decision to exclude TNT returnees from KLT exam even qualified po sila under Korean government policy...

if ayaw nilang payagan ang mga TNTs nag-avail ng amnesty to take exam this coming Nov. 14, 2010 then its a clear discriminatory act on their selection process... sad to say, sariling gobyerno natin ang gumagawa ng diskriminasyon sa mga kababayan natin...

ano kaya ang legal basis nila to make such decision? maliwanag po sa Foreign Worker's Employment Act na ang sakop lang ng requirement na "after 6-months from the date of departure in Korea" tsaka pa pwede magtake ng KLT exam ay yung mga legal EPS workers (E-9 Visa)... other visas and TNTs are excluded...

hope God will enlighten those people in POEA... wala na ngang maibigay na trabaho ang Philippine government, tapos pipigilan pa ang kapwa nating naghahangad na maiunlad ang buhay at pamilya sa pamamagitan ng pagtratrabaho sa ibang bansa...

nakaka-depressed po isipin kung gagawin talaga nila yan...

I believed, and their basis is to regulate, dahil sa dami nga gusto mag apply.
Ang tanong ngayon, “i heard, kc mdmi raw aplikante so, ska nlng dw kmi nxt KLT..” Sigurado ba makpag exam kayo sa susunod? Baka at that time another time nalang kayo…
Suggestion sa inyo ngayon, if tingin nyo ay tama bakit di nyo gawin ang karapatan niyo?
