contract violation?

aneonghaseyo, eps po ako. sa contract po namin libre kain sa umaga, tanghali at gabi. pero bigas lng po bigay samin. nitong nakaraan linggo di binigay un bigas samin. sabi nila nag labas daw labor na pwede na tanggalin food. KBIz po tawag nila sa naglabas no. ano po un KBIs at legal po ba yung ginawa nila? saka sa contract free din bahay at koryente, pero kinukuhanan kami ng hati sa bahay. thanks po!!!

KBIZ ia a name of Korean Federation of Small and Medium Business/Companies...

actually, there is no Standard Law in the Korean Labor Standard Act which mandates Korean employers to compulsory provide Free Food and Accomodation (bahay, koryente, etc)... pero karamihan kasi sa mga Korean employers since start of EPS, nagbibigay po sila ng libreng pagkain at bahay... but lately, ang KBIZ ay nagplano na tanggalin na nila ang benepisyong ito dahil na rin sa global crisis...

but still the Ministry of Labor will not make a Standard Policy for this non-provision of Free Food and Accomodation, so in this case depende pa rin ng employers kung magproprovide sila ng libreng pagkain or accomodation o hindi... it will be decided between an employer and a worker during signing of new contract...

pero sa case mo, if yung napirmahan ninyo na contract ay merong nakasaad dun na libre talaga ang pagkain at bahay, dapat yun ang susundin ng employer mo until the contract is over... kung hindi nila sinunod yan, its already a breach of contract... sabihin ninyo sa amo nyo na habang hindi pa tapos ang kontrata ninyo, he is obliged to provide the said free food and accomodation...
