This is the National Labor Consultation Center.
Many foreign job-seeks ask the same question frequently on reemployment procedures for foreign workers. Therefore, we would like to provide relevant information as follows:

Reemployment Procedure 재고용절차
① applying for reemployment of a foreign worker to a job center(employer) 고용지원센터 재고용 신청(사용자) → ② issuing an reemployment confirmation and notifying the Ministry of Justice and the HRD Korea of this(Job center) 외국인 근로자 재고용확인서 발급 및 법무부.한국산업인력관리공단 통보(고용지원센터) → ③ making a list of job-seeker to be reemployment[HRD Korea] & issuing a visa issuance certificate[Ministry of Justice] 재고용 구직자 명부 작성(한국산업인력관리공단) 및 사증발급인정서 발급(법무부) → ④ departing from Korea and then reentering Korea(Foreign worker) 외국인근로자 출국 및 재입국 → ⑤ reporting the reemployment of the foreign worker[employer] 외국인근로자 재고용 신고(사용자)

Applying for reemployment of a foreign worker to a job center 고용지원센터에 재고용 신청
- If an employer intends to reemploy a foreign worker whose employment period is due to expire, he/she should renew the labor contract with the foreign worker before the end of the sojourn period and then submit it to the competent job center with an application for reemployment of a foreign worker who voluntarily departs from Korea after expiry of his/her employment period
사용자는 취업기간이 만료된 외국인근로자들을 재고용하고자 하는 경우 해당 외국인그노자의 체류기간 만료일 전에 근로계약을 체결한 후 “취업기간 만료 자진 출국자 재고용 신청서” 및 첨부 서류를 고용지원센터에 제출하여야 합니다.

Issuing an reemployment confirmation and notifying the Ministry of Justice and the HRD of this
- After receiving an application for reemployment from an employer, the head of the job center checks out facts and then issues two copies of a reemployment confirmation(a letter confirming reemployment of a foreign worker whose employment period has expired), one for the employer and the other for the foreign worker. If a reemployment confirmation is issued, the head of the Job center should immediately notify the Ministry of Justice and the HRD Korea of this.
고용지원센터장은 사용자로부터 재고용신청서를 제출받은 경우 사실관계확인후 해당 사용자 및 외국인에게 “취업기간 만료자 재고용확인서”를 각 1매씩 발급합니다. 고용지원센터장은 재고용확인서가 발급되는 경우 이를 법무부 및 산업인력관리공단에 즉시 통보합니다.

Making a list of job-seeker to be reemployment & issuing a visa issuance 재고용구직자 명부 작성 및 사증발급인정서 발급
- The HRD Korea makes and manages a list of job-seekers to be reemployed based on reemployment confirmations provided by job centers. After receiving notification of employment confirmation by a job center of the Ministry of Labor, the Ministry of Justice checks out this and then issue a visa issuance certificate to employer can receive the visa issuance certificate from the Immigration Office directly and through their agent.
한국산업인력공단은 고용지원센터로부터 통보받은 재고용확인서에 따라 재고용구직자 명부를 별도로 작성 관리합니다. 법무부는 노동부 고용지원센터로부터 재고용확인서를 통보받은 경우 이를 확인한 후 해당 외국인근로자의 사증발급인정서를 발급합니다. 이때 해당 외국인근로자 또는 사용자가 직접 출입국관리사무소에서 해당 외국인근로자의 사증발급인정서를 직접 발급받을 수 았으며, 대행기관에게 대행을 시킬 수 있습니다.

Departing from Korea and then reentering Korea 외국인근로자 출국 및 재입국
- A foreign worker whose reemployment is confirmed by his/her employer should leave for his/her home country, carrying the employment confirmation issued by the Ministry of Labor and the visa issuance certificate issued by the Ministry of Justice. A foreign worker whose reemployment is confirmed by his/her employer can reenter Korea if one month has passed since departure to his/her home country. The foreign worker can receive an E-9 visa if submitting the reemployment confirmation and visa issuance certificate mentioned above to the Korea’s Embassy in his/her country.
사용자로부터 재고용 확인을 받은 외국인근로자는 노동부로부터 발급받은 “취업기간 만료자 재고용 확인서”와 법무부로부터 발급받은 “사증발급인정서”를 소지하고 자국으로 출국해야 합니다. 사용자로부터 재고용 확인을 받은 외국인근로자는 자국으로의 출국일로 부터 1개월 경과하면 대한민국으로 재입국할 수 있으며, 입국전에 재외공관에 위 확인서 및 인정서를 제출하면 E-9비자를 받을 수 있습니다.

※ A foreign worker whose reemployment is confirmed by his/her employer does not need to obtain any separate confirmation or permission form the sending organization in his/her home country when he/she tries to reenter Korea, and is exempt from the Korean Language Proficiency Test and employment training.
사용자로부터 재고용 확인을 받은 외국인근로자의 재입국시에는 자국송출기관으로부터 별도의 확인 및 허가를 받을 필요가 없으며, 한국어 능력시험과 취업교육이 면제됩니다.

※ The Act on Foreign workers’ Employment etc, is under amendment in order to enable employers to reemploy foreign workers without requiring one-month stay outside Korea before reentry.
외국인근로자 재고용시 1개월 의무출국절차를 개선하여 출국절차없이 재고용이 가능하도록 외국인고용법이 개정중에 있습니다.

Reporting the reemployment of the foreign worker 외국인근로자 재고용 신고
- If a foreign worker reenters Korea to be reemployed, the employer should submit a reemployment report (a report on reemployment of foreign worker after expiry of his/her employment period) within 10 days the reentry date to the competent job center.
사용자는 외국인근로자가 재입국시 입국한 날로부터 10일이내에 고용지원센터에 “외국인 (취업기간만료) 재고용 신고서”를 제출하여야 합니다.

Gusto ko lng po malaman na may chance pa po ba akong mkabalik jan sa Korea kahit nakansel ung visa ko? One month pa lang po kac mula ng makauwi me d2 sa pinas. Me CCVI po me kaso after 2 weeks 2mawag po ung amo ko at cnabing kinansel po ung visa ko. Is there any possibility na makabalik me jan? if ever....pls..give me some info...

i'm sorry for your situation...

by the way, did you try to visit Korea Embassy in Makati to confirm if totally cancelled na ba talaga ang Visa mo? baka kasi sa level lang ng amo mo ang cancelled but the documents in process by the immigration ay hindi... if you can still get your visa, pwede ka pa makabalik at hanap ka nalang ng bagong employer pagdating mo ng Korea...

but in case cancelled na talaga, im sorry to say, hindi ka na makabalik ng Korea unless you can take and pass KLT exam and get hired again by a Korean employer... but for now wala pa pong KLT exam schedule...

i suggest you to try to confirm your visa issuance at the Korean embassy... thanks.

magtatanong lang po, bout sa situation ng dalawa kung friend. kararating lng nila from phil. natapos na nila 3 yrs contract, bali re-hire sila. gusto na nila umalis kasi sa computation din ng sahod kulang saka 4k won lang ang /hour rate ng ot nila. at haba ng pasok nila from 08:30 - 20:00 ala daw ot yun araw2 taliwassa napirmahang kontrata nila na 08:30 -17:30 na kontrata sa sahod na 1mil. won. mon-sat pasok nila. Ang tanong nila pupwede raw ba sila magpa re-lease kahit ala pa sila allien card?

kabayan, much better po wyet nyo muna ang alien card ninyo then release, kc po ayon sa law 2 weeks lang po ang stay ng bagong dati sa kore dpat i aply agad sya or report in immigration na dumating na po kau....hntay lang po kau lien card then u cn release.tnx

yes. pwede po kayong magbakasyon as long as papayagan ka ng amo mo... wala po muna kayong makukuhang benefits like toejigeum and kukmin kasi nga meron ng bagong policy sa EPS extension procedure...

iparenew muna ng employer mo ang ARC mo saka ka magbabakasyon... siguraduhing merong reentry sticker ang passport mo... pwede ikaw lang magproprocess ng reentry sticker sa Immigration office ng Incheon airport... daan ka lang dun before ka papasok sa departure area...

di na po ba compulsary ang paguwi after 3 years?

hindi na po... pero if gusto nyo pa ring umuwi, makiusap nalang sa employer mo na magbakasyon after your visa sojourn extension for 1-yr and 10-months is completed...

very obvious that you still belong to old policy kasi na reemploy kana last year pa... from Feb. 10, 2010, meron ka pang 2-yrs na natitira... your sojourn is valid until Feb. 2012...

magandang araw po,ako po ay nakapag exit last dec 6 2009...at nakabalik ng jan 21..2010...bale ung 3 yrs ko ay tapos ko na..ask ko po ako ba ay valid sa 3 yrs extension...?...thanks a lot..

the new EPS policy was implemented effective Dec. 10, 2009... so malinaw po na you still belong to old policy... meaning +3-years extension (total of 6-years)...

hi marsanin,

still you need to take and pass klt exam again... visit POEA website and you should register online as soon as possible... then paregister ka in person sa Sept. 20~23 for Nov.14 exam schedule...

good morning po sa lahat.nag exit po me last aug.2010 after 6yrs then try to take KLT8 nareject po kc 42 na po me.sb ng director by july daw po lahat ng x korean mkkbalik pero nid to take CBT. ano po means ng CBT (CORRECT ME IF IM WRONG) pls po give us idea pra sa mga over age na para mkapag prepared..thanks po GODBLESS TO ALL

KABAYAN halimbawa pag ma re hire ulit ng employer, ilang taon na naman ba ang employment period? May narinig kasi ako 1 year lang daw? Totoo po ba ito??

sir dave ask ko po kc un friend ko umuwi po ng pinas kahapon feb.12,2012 po may dala po xa recommendation letter galing sa amo nya.posible po ba na magamit nya yon pabalik dito sa korea kc sabi ng amo nya after 3mons.
