paano po pala pag compute Toe Jik Guem halimbawa si juan ay 2 years & 11 months??? pareho lang po ba sa example nyo? kc for sure yung 2 years automatic mayrong Toe Jik Guem .. yung 11 months po paano po yun?

In that case you can use equation by cross multiplication to get the equivalent number of days for 2-years and 11-months of working period. Please refer below...

For example:
1) Juan have worked in a company from January 2005 to November 2008. His last 3-months
GROSS SALARY
are as follow...
  • September (30 Calendar Days) ~ 1,200,000 KRW
  • October (31 Calendar Days) ~ 1,100,000 KRW
  • November (30 Calendar Days) ~ 1,300,000 KRW
2) Get the average ~ [1,200,000 + 1,100,000 + 1,300,000] / [30+31+30] = 39,560 won

3) Get the equivalent number of days for 2-years and 11-months of working period...
Note: Retirement allowance or "toejigeum" is paid in the amount of average wages of 30-days for working period of one year. So, 1-year or 12months is equivalent to 30days. 2-years is equivalent to 60-days. How about the 11-months for his 3rd year working period?

Solution:
Let X = equivalent days for 11-months
a) So, 12months/30days = 11months/X
b) By cross multiplication, 12months(X) = 11months(30days)
c) X = 27.5

4) Retirement Allowance or "toejigeum" = 39,560 won x [30days(1st year) + 30days(2nd year) + 27.5(11months)

5) So, your total retirement allowance or "toejigeum" is 3,461,500won.

Note:
1) Samsung Fire & Marine Insurance Company shall only pay your "toejigeum" base on your basic salary computation. So, the excess amount due to overtimes must be paid by your employer. How to determine? Just deduct the Samsung payment to the computation result based on the above formula.
2) There must be also tax deduction for the "toejigeum" paid by both Samsung and your employer. But the deduction must not be so big. Please click HERE for sample computation...

may ipapakita lng po akong computation d2 sa company nmin e2 po ang toejigeum nang kasama ko na umuwi kanina lng d n sya nka reklamo dahil binigay lng sa ganya pag alis nya. dami kasi ang kaibahan at dami ang kaltas d nmin maintidihan dahil korean baka po alam nyo at mapa liwanag sa amin para po may alam kami ned ur advice po sir admin thnk u n advance.

tama po... ang gamitin na salary for computation ay yung gross salary nyo sa July, Aug. and Sept... walang problema yan kasi lalabas din naman ang ave. per day based on formula... please refer nalang sa sample computation above... pero syempre, magvavary din ang total toejigeum nyo...

for ex. if you work for the whole month of Sept. esp if merong OT mas malaki ang toejigeum nyo... but if Sept. 10 lang talaga kayo matatapos, then no choice, you have to follow the date...

ang Samsung is the Insurance company handling the "toejigeum" or Departure Guarantee Insurance and Return Cost Insurance or yung 400K won...

yung kukmin or NPS Lump-sum Refund is handled by NPS (National Pension System)...

kbyan tanong k lng poh kung halimbawa isang taon lng poh ako sa company k ngyun at ng pa release n poh ako paano ang computation ng tajecom k poh sana mtulongan m ako kc mg file n poh ako nsa labor sa monday para po mallman k kung magkaano ang makukuha k salamat godbless!!!

maliwanag po sa batas nag ang employer (amo) lang ang dapat magbayad ng certain amount para sa Samsung Insurance Company for our Toejigeum or Separation Pay provided that yung number of legal workers ay merong 5 or more employees...

hindi po pwede na magdeduct sila ng any certain amount for our toejigeum kahit may 13th month pay pa kayo... ung 13th month pay ninyo ay bonus yan... siguro nakasaad yan sa contract na pinirmahan ninyo pero ung kung sino ang magbayad ng Samsung Insurance for our toejigeum, nasa Korean Labor Law po yan... at hindi po pwede hindi susundin kahit nakasaad pa yan sa contract na pinirmahan ninyo...

last 3-months gross salary pa rin po pero 5 x 30days na ang multiplier mo to get your total toejigeum in 5-years...thanks.

how many regular workers kayo in that company including Koreans? if 5 or more, then you should have departure guarantee insurance or "toejigeum" benefit... granting that you're qualified with the said benefit, you may contact Samsung Insurance Co. office at 02-2119-2400.. just prepare your ARC number to let them verify your toejigeum status...

helo po..maitanong kolang po tungkul sa bagong batas na pd na straight 5 years ung hnd pa na ka exit after 3 years..ako po ay mg 3 years na this coming august 6 at this year at wla akong plano mgbakasyon..ano po ba ang tamang proseso dhil nblitaan ko kc na meron na daw naging tnt dhil late na daw ung application nang employeer doon sa labor at hnd na daw tinatanggap sa labor ung application dhil kapus na daw sa oras...gaano po ito ka totoo 2 mnonhs nalang po mg 3years na ako aukorin po na maging tnt ako na wla sa oras..tulungan mo po ako kung ano ang dapat kung gawin..mrming slmt po..GODBLESS PO.

kabayang cole,

if you're working in ur current company for more than 3-months, your employer must process your reemployment for your 1-yr and 10-mos extension 90-days to 15-days before the expiration date of your 1st 3-yrs sojourn period... take note that the basis for counting of your 3-yrs sojourn period must be your arrival date in Korea...

to be safe, tell your employer now to process your reemployment as soon as possible...

gusto ko lang sana hingin ang payo mo...nagbase kc ako s computation
n binigay mo regarding s tejicom and i found out n kulang ang nkuha ko,
but my problem is nakauwi nko ng pinas at nakabalik n d2 at s katunayan
patapos n din ang last sojourn ko ma possibility p po bang mahabol ko ang
kakulangan ng natanggap kong tejicom on my 1st sojourn if dadalhin ko sa
labor ang problema ko?
kasi ng ginaya ko ang computation s taas lumalabas n dapat 3.9M ang
mkukuha kong tejicom eh ang nkuha ko lng is 1.7M...

hi marianne,

magfile po kayo ng petition habang may time pa... mas better sana may malapitan kayong migrant center na makapag-assist sa inyo... if malapit ka lang sa paju, meron me sana irerecommend sayo na migrant center...

if hindi pa lumampas ng 3-yrs ang violation case ng employer nyo from the date na nangyari yung violation, pwede pa yan mahabol at i-entertain ng labor...

sir dave.. ask ko lang po regarding sa first sojourn ko.. bale dapat jan 9 2009 ang uwi ko dahil ito yung validity ng arc ko.pero pinili ko umuwi ng dec 20 2008 dahil sa balita noon na automatic na mapapasok yung nps sa sss sa jan 2009. kaya meron akong 19 days na kulang. yung tigeicom po..pano po ang computation noon?? start po ba ng oct-dec salary o di kasama yung december dahil di nabuo yung december? kasama rin po ba yung overtime? i mean..gross salary po ba dapat ang computation??

In that case you can use equation by cross multiplication to get the equivalent number of days for 2-years and 11-months of working period. Please refer below...

For example:
1) Juan have worked in a company from January 2005 to November 2008. His last 3-months
GROSS SALARY
are as follow...
  • September (30 Calendar Days) ~ 1,200,000 KRW
  • October (31 Calendar Days) ~ 1,100,000 KRW
  • November (30 Calendar Days) ~ 1,300,000 KRW
2) Get the average ~ [1,200,000 + 1,100,000 + 1,300,000] / [30+31+30] = 39,560 won

3) Get the equivalent number of days for 2-years and 11-months of working period...
Note: Retirement allowance or "toejigeum" is paid in the amount of average wages of 30-days for working period of one year. So, 1-year or 12months is equivalent to 30days. 2-years is equivalent to 60-days. How about the 11-months for his 3rd year working period?

Solution:
Let X = equivalent days for 11-months
a) So, 12months/30days = 11months/X
b) By cross multiplication, 12months(X) = 11months(30days)
c) X = 27.5

4) Retirement Allowance or "toejigeum" = 39,560 won x [30days(1st year) + 30days(2nd year) + 27.5(11months)

5) So, your total retirement allowance or "toejigeum" is 3,461,500won.

Note:
1) Samsung Fire & Marine Insurance Company shall only pay your "toejigeum" base on your basic salary computation. So, the excess amount due to overtimes must be paid by your employer. How to determine? Just deduct the Samsung payment to the computation result based on the above formula.
2) There must be also tax deduction for the "toejigeum" paid by both Samsung and your employer. But the deduction must not be so big. Please click HERE for sample computation...

sir ask ko lang kung paano po computation ng tegicom kung 1 yr @ 7 months lang po ako sa company namin kasi po pauwi na kami at yung mga nag 3 yrs po dito na kasama namin na pauwi na din ay nagrereklamo din po kasi maliit lang ang nakuha nila,can you send me a sample ng computation ng 1 yr @ 7 months thank you po @ more power sa sulyap pinoy na nakakatulong ng malaki sa aming mga manggagawa God bless you

kuya.. depende po ata sa amo kung ibibigay nila ng cash or ihuhulog nila sa bank account ng isang eps.nakaindicate naman po sa bankbook ng isang eps yung samsung hua iugugin. ito yung tigicom. yung 400k naman..samsung huaje buhom. may ilang eps noon na hindi nagbayad ng return cost guarantee insurance na hindi naman nagmulta. pero maige na rin po na meron kayo nito just incase na walang wala kayong maipon para may pamasahe kayo pauwi. salamat,,tanong ko na din kung makukuha na ba ang tijikom at kukmin pagtapos ng 3 yrs(1st sojourn) o pagkatapos pa ng 4 yrs and 10 months bago mkuha kung sakali na mag extend ka ng 2nd sojourn....

sir dave, tanong lang po dun po ba sa example nyo na computation e kasama n po ba duon ang overtime ang pinaka basic ko po kasi is 1.220M bale kung mag cocompute po ako isasama ko n po ung mga OT q..and isa pa po nag try po akong magpa compute sa samsung sa Jan.28 2013 pa po ang tapos ko pro meron na silang computation sa tejikum ko na 3M sa 2yrs and 11months ko ibig po bang sabihin nito na hindi ksama ang mga overtime pay ko...
