musta po sa lahat, ask ko lang po sana if cno bibili ng ticket namin sa pag uwi,mag 3 years na po kc kmi sa dec. sabi po kc nila na rere hire nila kami. tejikom pohum at kukmin iyon po ba ang pwede namin makuha sa pag uwi namin? maraming salamat po at mabuhay kyo lahat.

please refer below...
1) Pwede kayo na ang bibili or pwede rin ang employer ninyo. The most important thing ay dapat alamin nyo muna sa employer nyo kung kailan talaga ang scheduled departure date nyo para pwede na kayo makapag-reserve as early as possible.
2) Ang ma-iclaim mo before ka uuwi ay...
---> Departure Guanrantee Insurance or Severence Pay or "toejigeum" (to be filed at samsung agency - pwede ka punta sa FEWA office for the form, and dapat alam mo ang computation. please link HERE) for the details.
---> NPS Lump-sum or "Kukmin" (pwede ikaw na magfile sa regional NPS office na malapit sa company nyo. You need to bring plane ticket, your passport, and alien card.
---> Return Cost Insurance (yung 400,000won na deduction sa salary nyo during first salary or sometimes divided into 3-months). Walang tubo yan. Kung, magkano yung deduction nyo noon, yun pa rin ang i-refund sa inyo thru your employer.

1) for "toejigeum" - if the company has only less than 5 (4 or below) regular employees, it is not obliged or compulsory to pay a "Departure Guarantee Insurance" or "toejigeum"...

2) NPS or "kukmin" - lahat po applicable... dapat meron kayo monthly deduction at 4.5% of your average salary and another 4.5% contributed by your employer... try to visit NPS district office at your area... how to go? please visit NPS website... click HERE (under National Pension -> Regional Offices)

tanong ko lang po kung pano gagawin ko kung pagtapos ng 1 year ko sa company at ayoko na pumirma ng contract at mapapaso po visa ko magiging tnt po ba ako? pano po gagain ko bago mapaso visa ko po for 1 year? magrereport po ba ako sa labor?

if ayaw mo na mag renew ng contract sa current employer mo, sabihin mo yan sa amo mo then punta ka sa labor para mag-ask ng release paper...

hindi po mapapaso ang visa mo... saka na yan irerenew if makakita ka ng new employer... as long as meron ka nang release paper, meron kang 2-months na maghahanap ng bagong employer... siguraduhin mo lang na makakita ka ng new employer before 2-months end kasi if hindi no choice pauuwi-in ka talaga ng Pinas or if hindi maging TnT ka...

hindi maka-pigil ang employer mo if ayaw mo na pupirma ng new contract... huwag ka pumirma ng bastabasta esp. if di mo alam ang pipirmahan kasi baka kontrata na yang pipirmahan mo... if ayaw pumayag, punta ka lang ng labor office...

tanong din ko po na kung ask ko sa labor ang paghingi ng release paper bibigyan naman nila ako agad kahit di pa tapos ang 1 year contract ko? example nag ask na ako sa amo ko 1 month pwede na po ba ako humingi ng release paper sa labor at kung bibigyan nila ako agad. please paki reply naman po at maraming maraming salamat po sa sulap o sa inyong lahat.

saka kana pumunta ng labor para mag-ask ng release paper kung natapos na ang 1-year contract mo... yung release paper mo, yun ang palagi mong dadalhin while you're looking for a new employer... hindi po pwede na bigyan ka ng advance release paper tapos nagtratrabaho ka pa sa currenrt employer mo...

hanap ka nalang muna ng mga prospect na companies na pwede mo malipatan thru your contact friends bago ka magpaparelease kasi mahirap po maghanap ng trabaho ngayon sa Korea...

may tanong lang po ulit ako bkit po ang sajang namin ay may tojang din namin at talaga pong ayaw nyang magbigay ng payslip khit anong pakiusap nmin naka 3 taon na kmi at kababalik lang namin last march 20 after recontract. sabi ng labor may tejegum daw kami sa sajang namin pwera yung sa samsung tejegum pero wla syang binigay paano po yon makukuha ba namin yon dahil nasa kanya pa kami? at kung sakali bka alam nyo po kung magkano po? salamat po muli sana po masagot nyo po ulit ang aking katanungan.

actually, ang HINDI pagbibigay ng PAYSLIP ng isang employer sa kanyang mga employees is a VIOLATION of Korean Labor Standard Act (LSA), Art. 48 (Wage Ledger)... pwede ninyo sabihin sa amo ninyo na based on Korean Law dapat magbigay talaga siya ng PAYSLIP every salary period ninyo...

about naman sa "toejigeum" ninyo... if you have OVERTIMES during your last 3-months of work before kayo umuwi ng Pinas for rehire, i am sure meron pa po kayong dapat ma-receive sa amo ninyo based on "toejigeum" Standard Computation Formula... because ang ibibigay lang talaga ng Samsung Insurance Company ay based on your Basic Monthly Salary excluding OVERTIMES...

you may try to compute your actual "toejigeum" by following these references... PLEASE CLICK HERE & HERE

after confirming the amount, you can aproach your employer politely and ask him when can he give you the lacking "toejigeum"... you may show him the computation formula... if ayaw parin magbigay, you have the right to file a petition at the Labor Office including yung hindi pagbibigay ng PAYSLIP but before doing that... you have to consider the possibilities na pwede po kayong i-release ng amo ninyo at mahirap pa naman maghanap ng trabaho ngayon sa Korea...

one more thing, may bank account ba kayo sa company? yung salary ninyo, ibinigay ba sa inyo thru bank deposit? kasi if cash lang, mahirap po magreklamo kasi wala kayong proof sa salary record ninyo at "toejigeum" na nareceive ninyo from Samsung...

bank deposit kami sa tojang kami na sahod at may atm kami ng KEB at salamat sa payo nyo dahil di nga ako nagrereklamo dahil nga wla pa akong malilipatan ng job kaya tiis muna po ako dito sa company ko. nakuha ko na po ang tejegum ko at kukmin at di ko lang po alam kung tama ang hulog at kung hati kami sa hulog dahil wla nga po kaming payslip. maraming salamat po sa inyo at nagkakaroon po ako ng idea dahil sa totoo lang po ay lagi kaming nag aaway ng amo ko about sa mga ask ko na kailangan nya ibigay. tiis nalang muna po ako dito kung di man po ako makapagparilis ngayon itong 1 year di nalang po ako pirma ng kontrata sa kanya at bka malakas na po at bumangon ulit ang korea at magkaroon ng maraming trabaho po ulit. sige po maraming salamat po muli mabuhay po kayo at maraming maraming salamat po sa inyo.

please refer below...

1) under 40-hrs workweek system - 8hrs work from Monday ~ Friday (with less than 20 regular workers)
-> 2008 minimum wage (3770won x 209hrs = 787,930won)
-> 2009 minimum wagw (4000won x 209hrs = 836,000won)
-> if you work more than 8-hrs from Mon ~ Fri, and if your work Sat. and Sun... lahat ay considered OT... (OT hrs x 6000won)

2) under 44-hrs workweek system - 8hrs work from Monday ~ Friday plus 4-hrs work every Sat. (with 20 and more regular workers)
-> 2008 minimum wage (3770won x 226hrs = 852,020won)
-> 2009 minimum wagw (4000won x 226hrs = 904,000won)
-> if you work more than 8-hrs from Mon ~ Fri ... lahat ay considered OT... (OT hrs x 6000won)
-> if you work 4-hrs Sat... hindi pa yan OT... but if you work more than 4-hrs in Sat. it is considered OT (OT hrs x 6000 won)
-> Sunday work are all cosidered OT (OT hrs x 6000won)

you're right kabayan... after rehire, an EPS worker is entitled for another 3-years of sojourn but in case ma-approve yung addtional 2-years, the sojourn period will be extended to 5-years... salamat po...

mahirap po kasi kausap amo ko pagdating sa mga kailangan namin gusto lang po nya magpatrabaho ng magpatrabaho samin at sapilitan mag pa o.t. pa bago la na naman sahod delay at laging 15 at ngayon sa lunes naman daw po 18 kaya po nakakaisip po akong umalis sa kanya. tejegum namin sa kanya wla pa pong binibigay after 3 yrs. namin sa kanya pero sa samsung nakakuha po kami ng 2.1 prang maliit po wla po kasi kaming payslip for 3 yrs. mabigyan nyo po sana ako ng idea maraming salamat po

1) hindi pa po approve ang additional 2-yrs extension of sojourn until now... it is still under review by the National Assembly...
2) ang hindi pagbibigay ng employer ng payslip sa kanyag mga workers is a clear violation of Korean Labor Standard Act... in that case, pwede po kayong magfile ng petition directly at the Labor Office covering your workplace... after filing a petition, pwede ka na rin magpaparelease sa company...
3) yung delayed salary naman, it is also a valid reason para ikaw ay magpaparelease...

hindi pa po ratified ng Phil. Senate... currently the senators are so busy doing other priorities esp. that the 2010 National Election is coming... hindi pa po priority nila ang magreview ng NPS-SSS agreement... so, habang hindi pa nareview at naratified ang agreement na yan, we can still get our NPS lump-sum refund...
