Period for applications for reemployment of foreign workers largely extended

Any employer who wants to reemploy his/her foreign worker will be allowed to apply for reemployment just seven days before end of the employment period.
On July 5, the Ministry of Employment and Labor (MOEL) amended the Enforcement Regulations of the Act on Foreign Workers' Employment etc., which contains this feature.

The reemployment system is a system under which if an employer applies for the reemployment of a foreign worker who entered Korea under the Employment Permit System before expiration of the three-year employment period, the employment period can be extended by less than two years.

So far an employer has been required to apply for reemployment at least 45 days (or 15 days in case where the foreign worker has been employed with the employer for three months or longer before the expiration date) before the expiration date. As a result, workplaces have frequently missed their reemployment application deadlines.

In addition, if a workplace misses its application deadline, it cannot reemploy the foreign worker, and the foreign worker should return to his/her home country.

However, henceforth, an employer will be allowed to apply for reemployment just seven days before expiration of the employment period.

Yet if an employer is to request the reemployment of his/her foreign worker, the foreign worker should be employed with the employer for at least one month before expiration of the employment period.

Allowing the employer who has employed the foreign worker for at least a certain period to apply for his/her reemployment will be compatible with the purpose of the reemployment system.

If a foreign worker does not get any assurance of reemployment from his/her current employer despite that the expiration date of the employment period draws near, a broker often approaches the foreign worker and arranges for another work place to request his/her reemploymnet. the amendment is intended to prevent such problem.

Besides, the amendment includes reducing the required hours of employment education for foreign workers from 20 hours or more to 16 hours or more.

And the scope of workers for which agencies can make applications for employment permits on behalf of employers will be extended to ethnic Koreans of a foreign nationality (H-2 visa holders). Up until now it has been limited to foreign workers (E-9 visa holders).

Lee Jae-gap, Deputy Minister of the Employment Policy Office, said, "The amendment actively reflects demands from workplaces and is expected to largely reduce difficulties resulting from missing a reemployment application deadline and block brokers' intervention in the reemployment process."



The amended Enforcement Regulations will go into effect on August 1.

ibig sabihin hindi din kasama sa extension ung 3+1yr & 10months...

para po sa kanila un ang nabago lang ung palugit para pwede i reemploy ang isang worker, at kung sakaling ayaw n ng employer mo pwede po hanap ng iba d tulad ng dati kung dka i renew after 3 years uwi na po tlga

tanong lng po ulit para maliwanag!tapos na po ang 4 years ang 10 months ko sa feb.2012!puede pa bang i renew o doon lng sa mga bago mag 3 years?so wla namang nabago!ibig sabihin 4 and 10 months pa rin!!tama po ba?

OO nga po... bale batas lang po eto para sa mga bagong dating na eps na di pa nakakatatlong taon sa korea. lumang news na po ito cguro ngayon lang po na-approve ng MOL ng korea.

Mas marami po ang naghihintay sa sinasabing possible extension para po sa mga patapos na ang 6years dito po sa korea (3+3) katulad ko po.

Marami po kasi ang patapos na ang 6years (3+3) etong end of 2011 & end of 2012.

Yung balita po for 3+3 years ang inaabangan po ng karamihan.

Title: Revision on Reemployment application period (July 5, 2011)


An employer who intends to reemploy a foreign worker who completes the first 3 sojourn period may apply for reemployment 7 days before completion date from Aug 1, 2011. However, in order that an employer applys for reemployment to the job center, the labor contract period (from the date to join the company to the date to finish first 3 year sojourn period) with the worker concerned shall be at least one month.

e paano po ung 3+1 yr and 10 mos o ung 4 yrs and 10 mos sama din cla 3+3 na uuwi na this yr at ung iba nga mag eend na nxt yr.kc po ung 1 yr at 10 mos nayan ay dati pa nung sa 4th klt pa yan e.

pagkakaintindi ko po dun sa sulat eh para lang po yun notice sa mga employer na kung gusto nila ihire o iextend ulit ang empleyado nila na matatapos na ang contract, binibigyan sila ng 45 days (tama ba?) para i apply ang extension ng employee nila..

Kasi po ang kontrata nating mga bago dito eh kung di ako nagkakamali eh 3 years lang, kaya depende pa rin sa mga employer natin kung ieextend tayo ng 1 and 10 months o less than 2 years...

Mga Kabayan at kasulyap,

magandang araw po sa inyong lahat,

ito ay isang paglilinaw tungkol sa extension na pinatupad ng MOEL..

Sa mga 6 years contract ( 3 + 3 years);

Noong 2009, pinatupad ang 3+3 years para sa EPS, kung saan ang mga matatapos ng

contract for 3 years simula noong December 2009 hanggang March 9 2010, AY MAY

EXTENSION NA 3 YEARS ( IBIG SABIHIN PO 3 + 3 YEARS).


Sa mga 3 years contract kung saan;

At nang mabago ang policy simula nman ng March 10 hanggang ngun kung saan ang isang

EPS ay 3years contract mayroon itong 1 year and 10 months na extension para doon

sa mga naabutan ng March 10 until now;


Para nman po sa mga bagong dating na mga EPS;

Ang kanilang contract ay 3 years kung saan ang kanilang extension ay 1 year and

10months, subalit pag natapos na ang 3 years nila at hindi nabigyan ng extension,ang

mangyayari ay uuwi na sila ng Pilipinas.


SA NGAYON PO, WALA PANG BAGONG POLICY NA NAGBIBIGAY LINAW NA MAYROONG

EXTENSION SA MGA NAUNANG SOJOURN NA 3 + 3 YEARS.

AT HINDI RIN KSALI ANG 3 + 3 YEARS NA MAGKAKAROON ULIT NG EXTENSION

NA 1 YEAR AT 10 MONTHS..

ANG 1 YEAR AND 10 MONTHS AY PARA LAMANG SA MGA BAGONG EPS AT IYONG MGA

DATI NA NAABUTAN NG TRANSITION NG March 9, 2010...

Hi sir! eh yung balita po about sa extension ng 1 yr pa sa mga 4yrs & 10 mons na kumakalat.....last sunday kc yan yung usapan sa woori bank ng ibang mga kabayan natin na approved dw yung 1 yr additional sa sojourn ng mga 4yrs & 10 MONTHS ...PLS PAKILINAW PO ITO IF TOTOO....tnx!

Ang news pung ito ay hindi patungkol sa hinihinging dagdag na extension sa mga magtatapos ng. 6 years bali, ang topic pung ito ay patungkol sa mga naka tatlong taon na bibigyan ng karagdaggang 1 taon at 10 buwan, anh pi aka issue po kase dito sa ating pakikipagkulitan sa ating gobyerno ay marami ang napauwing eps dahil sa batas na 45 days upang masakop ng panibagong 1 and 10 months bali po ginawa na lamang 7 days ang pagaaply, wag po tayong malilito sa kagustuhang magkaroon ng extension, sa punto pong pagpupylong ng labor attache natin at ng poea, sinusubukan po natin makontak ang atin labor attache ngunit wala pong sagot sa akin tawag dala po siguro ng mga panauhing poea official kahapon na kakauwi lang nitong july 20 kahapon,, ipanalangin po natin na magkaroon ng development sa pakikipagusap ng labor attache fe bay , salamat po naway makapgbigay ng kaunting linaw

pasingit lng na tanong kabayan airline, magkano po ang basic pg 40hrs a week lng ang pasok,at ung sabado pg pinasukan magkano po ang overtime per hr? at ung O.T ng monday to friday , magkano rin po? magkapareho din po ba OT sa monday to friday,at ang OT ng saturday?

NA 1 YEAR AT 10 MONTHS..

ANG 1 YEAR AND 10 MONTHS AY PARA LAMANG SA MGA BAGONG EPS AT IYONG MGA

DATI NA NAABUTAN NG TRANSITION NG March 9, 2010...

finish contract po ako sa korea.6 yrs.mag 6 months na ako ngayong augost .tumwaag ako poea if pwede pa bumalik .kasi ang amo ko ay mag papafax ng re employment....ang sabi ng poea puntadaw muna ako ng korean embassy para humingi ng clearence.then pag may six months na ako saka ako pupunta sa poea.
patulong po kung may nakagawa na ng ganito. anung klaseng clearance po un na kukunin sa korean embasy. eps din po ako.
