NEW Employment Policy on Departure Guarantee Insurance Empty NEW Employment Policy on Departure Guarantee Insurance

Workplaces with four workers or less will be required to take out departure guarantee insurance if they employ foreign workers.

The Ministry of Employment and Labor (Minister Lee Chae-pil) said on June 21 that an amendment to the Enforcement Decree of the Act on Foreign Workers' Employment etc., containing this feature had been passed at a cabinet meeting.

Any employer who employs non-professional foreign workers (those holding E-9 or H-2 visas) under the Employment Permit System should take out departure guarantee insurance so that he/she can make retirement payments to the foreign workers when they depart from Korea. This has so far applied only to businesses or workplaces with five workers or more.

However, the retirement benefit system was extended from workplaces with five workers or more to those with four workers or less on December 1, 2010.

In addition, because foreign workers have to leave Korea as soon as their employment period expires, it is greatly needed to make retirement payments to them on time. For these reasons, the scope of workplaces required to buy departure guarantee insurance is expanded to include workplaces with four workers or less.

The revised decree will enter into force on August 1. According to it, workplaces with four workers or less should buy departure guarantee insurance only for foreign workers whose employment contracts will take effect on or after August 1.


* Foreign workers employed before August 1 will receive retirement pay according to the retirement benefit system.

Besides, the amendment abolishes the requirement for employers to return employment permits issued to them if they have any reason for having such permits revoked.

* Each employment permit contains the name and passport number of the relevant foreign worker, so there is little chance of misuse even if it is not returned. However, up until now the law has required a return of employment permits if they are revoked, which has done nothing but cause unnecessary inconvenience to employers.

In order to enhance punishment for repeat offenders, the amended law imposes additional fines if it has been repeatedly violated over a two-year period.

"The amendment will help foreign workers in small workplaces to receive retirement pay promptly and reduce workplaces' burden of making retirement payments all at once," said Lee Jae-gap, Deputy Minister of the Employment Policy Office. "The Ministry will distribute detailed implementation guidelines relating to the amendment to every job center and individual workplaces by the end of this month."

gud pm po! mag rerenew napo ako ng last contract ko dis august 2, 2011 dati po kasi wala akong nakuhang departure guarantee insurance kasi 4 lng kami sa company, ibig po bang sabihin pag uwi ko nxt year may makukuha po ako? thanx po!

sir, ide deduct ba sa worker yan? kaya pala nagtataka ako 7 months na ako may kinakaltas pang 83,000 won. yan ba yung chul guk puhom ryo? makukuha ba yan in case na lilipat ka sa ibang company? and 1 more thing po. pagdating po ba ng 1 year pwede ka lumipat sa ibang company?

tanong ko lang po papano po ito maku2ha bago umuwi, ano po hanguk nito at magkaiba po ba yun tejicom at departure guarantee insurance? kasi laging may kaltas akong 83k won every month. sana po masagot niyo salamat

sir, ilan months pong kakaltasin sa swldo yang chulguk puhom ryo? kasi po ako 7 monts na sa company ko bali 7 tmes na rin po ako nakakaltasan. e sabi po kasi ng ilan hanggang 3-4 months lang daw po ang kaltasan sa puhom na yan. atsaka wala po kaya akong magiging problema kung gusto kong lumipat after ng 1 year ko sa compay? sana po masagot nyo ako. maraming salamat po sir.

magandang araw din kabayan. bakit kaya 83,000 won ang kinkaltas sa akin buwan-buwan? ano kaya yun? plus kukmin na 45,000 and yung health insurance na 30,000 won. di ko malaman kung para saan yung kinakatas na 83k won, pero nakalagay nga sa payslip ko is chulguk puhom or pihaenggi puhom. makukuha ko kaya yun kung lilipat ako ng company after a year ko dito?

ang DEPARTURE Guarantee INsurance.

Ayon sa Labor law 4-2-3. Departure Guarantee Insurance and TRUSt

" the employer who employs migrant workers must purchase the departure guarantee insurance and the guarantee as a measure to guarantee migrant workers RETIREMENT ALLOWANCE. It is very necessary to check whether the employer insured it or not, because this insurance was made due to many cases not to get retirement allowance among migrant workers. Further, the insurance premium must be paid by the employer by law and its illegal to force migrant workers to pay it or deduct in from their own wages".

----> ang departure guarantee insurance and trust at tinatawag na TGCOM or separation pay. ito din ang tinatawag na CHULGUK MANGI BOHUM. ito ay binibigay ng sajang or boss pagnatapos na ang contract.

Most Migrant workers pay the insurance premium from the first month wages, it sometimes happens for employers to deduct those insurance premiums from the workers wages due to confusion with the departure guarantee insurance."


---> ang REturn Cost Insurance And Trust ay tinatawag din GuigukBiyong Bohum or Samsung Hwaje ( ito po ay ang 400, 000 won para sa plane ticket na makukuha pag matatapos na ang contract)

----> ang accident compensation insurance ay tinatwag ding Sanghe Bohum, noon ang rate po niyo ay 26,000 won kung saan binabayaran within 15 days after arrives in Korea.


----> Ayon sa Labor Law 4-2-4 HEALTH insurance ay kinakaltas din ito ay tinatawag ding Geungang Bohum. ang rate nito ay galing sa insurance mismo kung magkano ang kakaltasin.Itanong lang sa Sajang or Boss para sya ang mag aaply para sa inyo.

Most Migrant workers pay the insurance premium from the first month wages, it sometimes happens for employers to deduct those insurance premiums from the workers wages due to confusion with the departure guarantee insurance."


---> ang REturn Cost Insurance And Trust ay tinatawag din GuigukBiyong Bohum or Samsung Hwaje ( ito po ay ang 400, 000 won para sa plane ticket na makukuha pag matatapos na ang contract)

----> ang accident compensation insurance ay tinatwag ding Sanghe Bohum, noon ang rate po niyo ay 26,000 won kung saan binabayaran within 15 days after arrives in Korea.

,kuya ask ko lng po pnu nmn kung ndi nkapagbayad ng 400,000won,me penalty po un??kc ung mga ksama ko ndi n nmn ngbyad n2,khit ung mga bgong dumating d2 sa company nmin,pali2 kinukuha ung salary kya ndi n nka2ltas yung 400,000won,anu pong mgiging epekto nun..??ask lng po,,salamat!
