Very Imprtant! New EPS Policy! How many days before 3-yrs visa expiration that your employer must apply for your re-employment?
To all EPS workers:
Question: How many days before 3-yrs visa expiration that your employer must apply for your re-employment?
Answer: Rationalization of application period for reemployment (Effective April 12, 20010, according to Article 14(2) of the enforcement regulation of the said law)
- In order for an employer to re-employ a foreign worker, the employer have to apply for it before 45 or 15 days of the termination of first 3 year sojourn period.
Examples of how to apply the reemployment application period:
1) Applying for reemployment before 15 days of the termination of first 3 year sojourn period...
- An employer has to apply for reemployment before 15 days of the termination of first 3 year sojourn period, when his/her worker has worked for at least 3 months as of the completion date (Ex. In cased of a worker whose first 3 year sojourn completion date is June 15,2010, when he/she started his/her work before March 15, 2010)
-> Sa madaling salita, if ikaw po ay nakapagtrabaho ng company more than 3-months, pwede ka pa i-process ng reemployment (1-yr & 10-mos) kahit 15-days nalang bago magend ang 3-yrs mo dito sa Korea... (or from 90-days to 15-days)
2) Applying for reemployment before 45 days of the termination of first 3 year sojourn period...
- An employer has to apply for reemployment of his/her worker before 45 days of first 3 year sojourn period, if his/her worker has worked for less than 3 months as of the completion date. (Ex. In cased of a worker whose first 3 year sojourn completion date is June 15,2010, when he/she started his/her work from March 15,2010)
-> Sa madaling salita, if ikaw po ay nakapagtrabaho ng company less than 3-months, dapat mai-process ka na ng reemployment (1-yr & 10-mos) before 45-days bago magend ang 3-yrs mo dito sa Korea... (or from 90-days to 45-days)
CONCLUSION: EFFECTIVE APRIL 12, IF IN CASE YUNG CURRENT EMPLOYER NINYO AY WALANG BALAK MAGRE-EMPLOY SA INYO, DAPAT MAGPAPARELEASE NA KAYO 4-MONTHS BEFORE END OF YOUR FIRST 3-YRS VISA PARA MAY CHANGE PA KAYONG MAKAHANAP NG EMPLOYER NA PWEDENG MAGRERE-EMPLOY SA INYO...

maganda po ung conclusion para po sa mga cgurado at kompirmadong di na mai-re-renew ng amo nila...
pero dun po sa nkikiramdam at di mapanghawakan o matiyak ang renewal na pangako ng employer(bka kasi bigla magbago ihip ng hangin)...obserbahan po natin from 90days before ng sojourn period natin since ito po ang allowed duration pra magprocess...(bka mangulit tau 4months before na irenew tau hehehe nkakastress to at di pa pede...bka lang mgbago isip ng amo sa pngungulit natin)
pkiusapan po ntin kung maari sana iprocess ASAP ung re-employment..kc mapipilitan maghanap ng ibang employer kung aabot p ng 2months remaining ng sojourn period ay di p narerenew...

i guess makikita na rin ito sa molab website... kasi officially announced na ito ng MOL... galing naman talaga sa kanila (thru email) ang sagot ko... ini-elaborate ko lang ng kunti para mas maiintindihan ng nakakarami...

gud pm po.tanong ko lang about sa sitwasyon ko.now po buntis ako at nagparelease sa Feb2011 po ako manganak at til May 2011 yong binigay sakin na extension sa visa ko.makahanap pa kaya ako ng work?may tatanggap pa kaya sakin kasi sa May 2011 din po na yan ako mag 3yrs dito.nabasa ko po yong policy sa pag re employ.paano po ako na walang employer now makapagwork pa kaya ako.thanks.
