Increase seen in number of illegals in the workplace
http://joongangdaily.joins.com/article/view.asp?aid=2936344
May 18, 2011
A Thai woman named Jomsri, 41, has worked for five years at a jewelry factory in Siheung, western Seoul. But now, she is under the protection of a foreign workers’ center in Ansan, Gyeonggi.
“At the end of last year, my boss found out I became an illegal worker with my temporary working visa having expired,” Jomsri said. “And then he kicked me out of the factory, not paying the delayed wages, about 15 million won ($13,777).”
Jomsri said South Korean immigration officials caught her early this year but they postponed her expulsion because she had filed a lawsuit against her boss to get paid her overdue wages and was awaiting a ruling.
In Korea, most foreigners engaged in manual work are given an E-9 temporary working visa, which allows them to stay in Korea for three years.
But more and more foreign workers don’t return to their homelands even though their E-9 visas expire, becoming illegal migrants.
According to the Ministry of Justice, the number of illegal migrant workers is growing, from roughly 9,100 in the early 2008 to about 13,000 at the end of 2010. Since January, about 1,500 workers have become illegal workers.
The rate of illegal migrants among all foreign workers has doubled, from 20 percent in July 2010 to 41 percent this March, the ministry said.
“Given the current situation, more and more foreign workers will become illegal migrants, reaching to more than 1,000 per month from this July until the end of 2012,” said Choe Hong, a senior researcher at Samsung Economic Research Institute.
“Most foreign manual workers spent at least 10 million won in preparation for entering the Korean job market,” said Lee Jeong-hyeok, a pastor at Ansan Migrant Workers House. “So they want to get their invested money’s worth from staying in Korea [as long as possible].”
Under the current law, if an illegal migrant worker is caught by the Ministry of Employment and Labor, he or she is immediately expelled and re-entering Korea is not allowed for the next one to five years.
But experts say that punishment is too light.
A Justice Ministry official also said cracking down on illegal workers is lax, saying, “The number of officials cracking down on illegal migrant workers is only 140 and they are all busy doing other work such as issuing visas.”

Re: Increase seen in number of illegals in the workplace
