I N F O R M A T I O N S ABOUT :


1. National Pension System (NPS) or Kungmin Yeongum- Ang monthly contribution mo at ng iyong employer ay makukuha mo pagkatapos ng iyong 3 years contract or kung mag final exit ka na. Bago po mag final exit pumunta sa pinakamalapit na NPS office at mag file ng Lump-Sum Refund. Requirements: Alien Card, Passport, Bank Acct. #, Plane ticket etc. Ayon sa bagong patakaran TNT or Legal ka man sa Pilipinas na po makukuha pagnakauwi na kayo. Note: Sana hindi pa makuha ng Social Security System (SSS) papayag ka ba kunin nila?
Sa karagdagan information tumawag sa tel.# 1355 or visit their website at www.nps4u.or.kr

2. Severance Pay or Toe Jik Guem- Kailangan hindi baba sa 5 regular workers sa company nyo- hindi kasama si sajang at samonim, dapat makompleto mo ang isa,dalawa or tatlong taon bago ka umalis sa company. Bawat taon meron ka matanggap equivalent to one ( 1 ) month basic salary. Requirements: Passport,Alien Card, Bank Book etc. Pwede po kayo mag File ng Claim sa Phil.Catholic Center or sa FEWA inside Woori Bank every Sunday 10a.m-12nn.Dapat alam nyo Company/Employer's Identification Number. Para sa karagdagan information tumawag sa Tel.# 02-2119-2400

2. Return Cost Insurance- Ito po yong binayaran natin na 400,000 won para pambili plane ticket pag uwi Pinas. Makuha lamang ito kung matapos mo na ang 3 years contract or kung final exit ka na.

Thanks for the information.

Nakakatakot naman kapag may plan na kuhanin ng SSS natin yung pension yun lang inaasahan natin pagkatapos ng stay natin dito. Lalo na sa case ko na 6years na contribution ko sa pension (E-7 Visa).

Parang gusto ko na tuloy umuwi para makuha na ng maaga baka makuha pa ng government natin.....

Ganun din sa case ng mga kasamahan ko rito from agency Dalzen, 3years sila work sa campany namin pero 2 years lang separation pay nila. Since from agency ka ay surely hindi ka EPS kundi sakop ka pa ng Industrial Trainee Program.

Please correct me if I am wrong (MrDJ), ayun kasi sa rules and regulation ng Industrial Trainee Program ay trainee position (D3) ang worker for the 1st year of work at magkakaroon lang sya ng working visa on his 2nd year of work (E8 Visa). During the trainee period ay hindi entitled ang trainee sa separation pay at pension. Sa pagkakaalam ko ay nakasulat ito sa Industrial Trainee Program na bigay sa inyo ng agency ninyo. Kasi since nagkaroon kami dito ng almost 40 Production Pinoy Workers from Agency Dalzen with Industrial Trainee condition ay binasa ko rin ang laman ng Industrial Trainee Manual na bigay sa kanila ng kanilang agency.

Pwede mo rin tawagan ang agency mo para itanong ito at maliwanagan.

Kabayan Foxton and Emart,

According to my level of understanding sa Labor Standard Act (as of 2007), walang nakasaad doon na EPS lang or ibang Visa category lang ang pwede makakuha ng complete Severerance Pay benefits after your contract. It is clearly stated there na once you have completely worked for one year as regular or full time employee, you can avail an average wage of more than 30 days each year. In other words, if you work for 3 years regardless of your visa category, you must avail at least 3 months equivalent salary.

Yung sinabi kong fulltime or regular employee, that means your working time in a week should be at least 40 hours a week (for employers with more than 50 workers) and at least 44 hours a week (for employers with 50 or less number of workers). Also, please take note that "The Labor Standard Act" does not apply to employers with 5 or below number of workers.

I guess yung one year nyo doon yan mapunta sa agency or someone else... Or I'm not sure baka meron kayong pinermahang contract na pwede gawing basis ng agency or company nyo na hindi nila ibigay ang one year severance pay nyo. To make it sure please contact Ministry of Labor Call Center( 031-345-5000 ) or call 02-507-1701 (Severance Pay Division) because sila ang mas may alam at credible to answer or advise about your situation.

Yes, I agree with the opinion of MrDJ's suggestion. But maybe before you will call the Labor, please read first your Industrial Trainee Manual which was given to you by your agency. This manual was provided by Ministry of Labor / HRD Korea to the head of Korea Federation of Small & Medium Business so you have the full understanding before you will contact directly to Labor. If you already don't have the copy of the Industrial Trainee Manual then you can call directly to Labor.

As I mentioned in the above, in our company almost 40 Pinoy workers already finished their 3years contract and same with you, they only received 2years worth of severance pay and pension. Our company did not deduct pension on the 1st year since pension company advise that D3 are not entitled to this insurance.

We already connected to Ministry of Labor Branch in Busan and they informed us that our company has no violation since they follow the laws. D3 Visa is a trainee visa not a working visa. After 1year, then you can only receive the working visa of E8.

ask ko lang po sana...E9(EPS) visa po ako at naka re-hire na din po...for my first 3 years of contract ay 2 years and 3 months na po ako nagwowork d2 sa kunjang ko na ito na nag re-hire din sa kin ngayon....bale 4 na pinoy po kami (3 EPS ,1 tnt@2 koreana na kapatid ng samonim nmin) ang nagwowork d2!tanong ko po if makakaavail po ba kmi sa severance pay na ito at kasama po ba sa bilang nmin ung 2koreana at 1 tnt pinoy para sa labor law na 6 workers above ang pwede makakuha ng severance pay sa isang kunjang para maipaliwanag din nmin sa amo nmin na dapat ay may severance pay din kmi.kc ang reason nga nya sa min ay di nmn daw kmi cover nung mga benefits na yun dahil family business nga lang daw po ito.wala nmn po kami nakuha sa pag uwi nmin pagkatapos 3 years of staying here sa korea sa unang contract nmin at di rin kami inihuhulog sa nps ng amo nmin na ito kahit sinasabi na namin sa kanya na dapat ay may contribution din kami!!!!!!maraming salamat po at sana ay mapaliwanagan nyo po ako d2 sa case namin.....GOD BLESS US ALWAYS!!!!!!

i hope i can help you with my explanation as below based on my understanding and interpretation of the Korean Labor Law and Policy...

1) "severance pay" or "departure guarantee insurance" or 'toejikeum" is mandatory to all foreign workers working in an employer (business) with 5 and above legal workers. please take note, any relatives to the owner of the business must not be counted or included to the 5 workers... (in your case, i'm not sure if those 2 koreans who are sisters of your CEO's wife are covered under relative's degree... to make sure please contact "The Association for Migrants Workers' Human Rights" - Seoul, phone numbers (82)02-749-8975 or (82)02-795-5504. don't hesitate to call them, they can speak engish to answer your questions)
2) your "tnt" co worker must not be counted to the 5 workers because definitely he/she was not declared by your company to the labor... per labor record, your company has only 5 workers in total...
3) for NPS contribution, you should tell your 'sajangnim" to pay your NPS contribution because since 1999, NPS is mandatory to all workers regardless of the number of workers in a company...


how to compute the contribution?

a) monthly contribution = 9% x basic monthly income (excluding overtimes and allowances) but only 4.5% will be deducted by your monthly salary for your contribution and the other 4.5% must be paid by your employer.
b) example:
your basic monthly salary = 1,000,000 won (total NPS monthly contribution)
---> .09 x 1,000,000 = 90,000 won
---> .045 x 1,000,000 = 45,000 won (your monthly contribution to be deducted in your monthly salary)
---> .045 x 1,000,000 = 45,000 won (your employer's monthly contribution)
c) after 3 years of your contract you can get...
---> 90,000 won x 36months = 3,240,000 won (i'm not sure if there is tax deduction)

KEB, pumunta lamang sa pinakamalapit na sangay ng bank sa lugar nyo. i got mine instantly, tinatanong lang ako kung kailan flight ko, hinde na nga ako hiningan ng ticket eh... sabi ko bukas at binigay nya agad...at may kasama pang tubo 30 thousand plus won

sir, maganda araw po, last january 2007,inilipat po kami ng company nmin sa ibang company, pero dun din po kami nagwowork, bale nagpalit lng ng bagong sajang at bagong pangalan ng company, bale ang nangyari po, naging subcon yung bago nmin company sa dating naming company,tapos po nun, binigyan po kami ng severance pay ng former company nmin,nagtataka lng po ako bakit di pareparehas ang bigay nila samantalng parepareho lng nmn po at ang ipinagtrabaho nmin,me nakakuha ng 900k won at meron nmn 700k won lng, after 1 year po e isinoli nmn po kami ng sajang nmin sa sister company ng former company nmin, pero dun din po kami nag wowork sa dati nmin company, yun nga lng po di nagbigay ng severance pay yung huling sajang na humawak sa amin, ni wala man lng po sila sinasabi kung papaano magiging procedure dun 5 pinoy po kami dito. salamat po at sana e mabigyn po kami dito ng paraan kung ano ang magandang gawin, maraming salamat po at mabuhay po kayo

ang "toejigeum" po ay yun din ang "Departure Guarantee Insurance" na kung saan per Korean Labor Law, ang amo mo ay obliged na magbayad sa Samsung Fire and Marine Insurance Company (In short Samsung Insurance Company) para mabigyan kayo ng "toejigeum"...

anyeong, pag rehire ka ibig sabihin tapos na ang dati mo contract.
so ibig sabihin makukuha ang lahat nang dapat mong makuha kung susunod ang sa labor ang amo mo. ung toejigeum mo sa samsung, at ang overtime sa amo mo at kukmin mo sa nps. dapat ng apply ka na para makuha mo na kaagad

dalhin mo ang passport, ACR, at plane ticket na confirm ang departure date, at higit sa lahat ang bankbook mo na paghuhulugan ng pera mo.

Regarding sa Kukmin at Toejikum, may paraan para malaman online kung naghuhulog ba nang husto yung amo namin? Maliit lang kasi kumpanya namin 4 lang kaming workers (2 pinoy, 2 koreano) at 2 years & 4 months na kaming nag-tatrabaho dito. Nakatakot naman kung wala kaming matanggap pagkatapos ng kontrata. Maraming salamat po.

about toejikeum, since less than 5 regular workers lang pala kayo dyan sa company, per labor law, your employer is not obliged to pay you toejigeum thru Samsung Insurance... ang Toojikeum ay applicable lang po sa company with 5 or more regular workers... you can try call 02-2119-2400 (Samsung Insurance Office) and ask if nakaregister ba kayo... if nakaregister, then mabait ANG amo nyo...

pero yung sa Kukmin, dapat meron kayong contribution (you and your employer at 9% of your salary per month - bali 50% from you and 50% from ur employer)... you can visit district NPS office covering your workplace to confirm your contribution... if di nyo alam, email me your complete address and i'll help you get the contact number and NPS office address... email me at sulyap.managing@gmail.com

hello po.ano po ba ang dapat gawin if hindi nag remit ang company namin for the last twelve months ng kukmin yeungum? We found it after nagparelease po kami sa company namin na hindi pala hinunulugan ng company namin ung kukmin.tulong naman po.

Sir: nagtrabaho po dito sa south korea starting oct. 7, 2008 sa mushroom company and then natapos ko po yon ng oct. 7, 2009, wala po akong natanggap na kokmin o kaya tijikom, meron po ba akong habol para makuha ko yon? more than 5 employees po kami don dati pero wala po akong natanggap.pwede po ba akong mag file ng complaint against sa dati kong pinasukan? may 2nd question po is dito sa bago kong trabaho as bell pepper picker, my boss deducted 75,000 kwn sa amin para daw sa kokmin yon pero ang pinagtataka ko eh walang nadating na receipt galing sa nps, paano po ang gagawin namin kong hnd naiihulog ng amo namin yong 75,000 kwn, bale ang sabi sa amin dati tig 75,000 daw kami kaya in one month 150,000 yon. pwede rin po ba akong mag file ng reklamo kasi na verify ko na sa nps na hindi talaga inihuhulog ng amo ko, pls help me to solve my contribution in nps and tijicom. thank you
