Good day! Magtatapos po ang 3 years sojourn period ng husband ko sa Korea this coming Aug21, 2010. He is expecting that his employer will re-employ him. But lately ang sabi po sa kaniya hindi siya ma rere-employ dahil hanggang 3 years lang ang bagong batas ng Korea. Yun nga po ba ang bagong batas? Wala po siyang violation at maayos po siyang magtrabaho. Ang sabi po ng Supervisor niya lalapit sila sa labor office dun sa Korea para ma re-employ siya, at kung sakali po na hindi siya ma approve ng re-employment, pwede pa po ba siyang mag apply ulit sa POEA? para makapagtrabaho ulit sa South Korea?

Magandang araw din po! Kung talagang gusto ng employer ng husband mo na sya ay i-re--employ pwede po , Sa revised act po pag katapos ng 1st 3
years sojourn and if the employer wished to re- employ the foreign worker, the employer can rehire or re-employ the foreign worker for 1 year and 10 months po.

But , I, would like also to make it clear na based din sa revised act, the local labor security center can restrict the Employer to hire or re- employ a foreign workers,

Kasi tinitingnan din po nila yung proportion numbers ng korean workers and foreign workers in a certain company.,or baka naman may violation ang current company ng MR. mo for example... (human rights violation, delayed wages or other violation of Standard labor act) . kaya hindi pinapayagan mag hire or mag re- employ ng Foreign or , deli nman kaya nahulihan po ng irregular workers.(TNT) ang current company ng mr, po ninyo.kaya cancel din po ang special employment permit ng company.to hire or re-employ a foreign worker..... Pag ganon po ang situation hindi po talaga maka pag hire ang employer ng MR po ninyo.....

Doon naman po sa 2nd question kung pwede pa uli mag apply sa POEA para maka pag work uli dito ..pwede po... if he or she met the minimum qualification po ,for example po sa age limit not more 38 years old at kailangan pumasa uli sya KLT exam...... kung qualified pa po sya balik po sa dating processo...

sana po nakapagbigay po kami ng makbuluhang paliwanag po sa inyo...

Thanks so much sa reply! Naliwanagan po kami. Maybe may violation dahil nagreklamo po yung ibang kasamahan niya na masyadong mababa ang kanilang sweldo. Last question na lang po. Kanino po pwedeng mag file ng reklamo ang asawa ko, may isang oras na hindi po binabayaran sa kanila. Ten hours pong nagtatrabaho but 8 hours only ang binabayaran. They work from 8am to 6pm. ONce po ba na mafile ang complain may protection ba sila? Matatapos na po ang contract niya sa Aug. Pwede po ba sa POEA mag file ng complain?

dapat ay mareemploy muna sya bago mag complain yun ang mahalaga dahil kung mag complain agad sya magagalit yung amo nya at maari mapauwi na sya sa pinas...

posible po b n i extend p ulit kami ng company after 6 years?c kare renew lng po ulit nmin ng png six years at s dec.25 nga po ay end n un contract nmin pero kung gus2 p po nila kmi i extend ay maaari p po ba?until how many years po b talaga ang mga eps d2?i hope u can reply me....ty po

miss naneth wala pa po balita na mag kakaroon ng extention pag katapos ng 6 years nyo ang malinaw po sa ngayun ay kelangan po umuwi na sa pinas pag katapos ng 6 years sojourn mo pero nxtmonth daw may lalabas na bago batas at sana ay mag bigay pa sila ng extention para sa matatapos na ang contrata...
