tanong po sa re employment visa

mga kabayan tanong kolang po kung pano po ang re employment visa matatapos napo ako ng 3 years sa april 3 pero under new law eh straight 5 years na so how could it be since ang nakalagay sa visa ko is until april 2010 does the company issue another new visa for 2 years or diretso napo un kasi po plan ko umuwi magbakasyon ng march 2010 nagsabi napo ako sa company my concern is what if pagbalik ko ng pinas eh i hold ako due to visa problem which is paso na if ever hinde na renew kasi po kung sa dati batas po sa pinas napo sila nirerenew ng visa but with the new rule ano napo ang procedure para sa new law. Do i need to wait to renew my visa bago umuwi or pwede na po ung dating visa ko since straight 5 years napo ano po dapat kong gawin

kabayan ako sa march 2010 mag 3 years for my first sojourn streyt 5 years din me pero nakapirma na ako ng contrata ko yesterday lang at pati alien card ko eh nirenew na din nila kahapon... bakasyon me nxtmonth so kung april ka pa eh bago ka siguro makabakasyon eh nakapirma kna ng extention of contract mo kaya ask mo yun amo mo by nextmont na papirmahin ka ng maaga ng contract mo para wala ka na iniisip... sa pag uwi mo naman wala naman problema dun kasi bakasyon ka lang wala ka aayusin sa pinas unlike ng mga finish contract.

magandang araw kabayan,

tulad ng sabi ni maylene21, dapat agahan mo ang pagpapareemploy sa iyo ng amo mo, para makapirma ka agad, usually dapat 30 days before end of sojourn ang recommended time para magpareemploy. at tama si maylene, kasabay nito ay makukuha mo na ang bago mo ARC. Ang Straight 5 yrs po ( which is less than 5 yrs, naipaliwanag na po sa ilang mga threads dito, na actually is plus 1 yr and 10 mos) ay nangangahulugan lamang po na derecho ng makakapagtrabaho ang isang dayuhang kabilang sa E"PS kung sila ay marereemploy ng mga amo nila bago matapos ang 3-yr sojourn period nila. kung hindi ka po marerenew, ito ay nangangahulugan na tapos na ang 3-taon kontrata mo sa korea kuung kaya't ikaw ay nararapat ng umuwi ng Pinas. Kung papalarin namang muling makapirma ng kontrata. maaari mo ng ipagpatuloy ang iyong pagtatrabaho sa korea ng di na kailangan pang magrenew ng visa sa pinas. Subalit kung ikaw ay magbabakasyon pauwi ng pinas. Tulad ng dati, kailangan mo pa ding pumunta ng POEA sa balik-manggagawa para makakuha ka ng OEC at makapagupdate ng mga binabayaran tulad sa philhealth etc.

teka lang po medyo naguguluhan po ako dpo ba straight 5 years na kmi so it means even though we dont have an employer when we finish our 3 yrs sojourn period eh pwede papo kmi mag stay here in korea and find another company to register us and sign another 2 years contract dahil as far as i know un lang po ang advantages ng mga walang employer na mtatapos napo ang3 years sojourn period nila also for those 3 change of workplace done sabi sa labor nagdagdag papo ng 2 for a total of 5 change of workplace so even if the current employer does not renew your contract may chance papo na makalipat ng ibang company and sign a new contract

we have clarified this issue on some other threads, but to enlighten you on your follow-up question, here is the gist of what we've explained before.

To all EPS workers who belong to the old EPS Act in which they are covered by the 3+3 yrs maximum working period and to all EPS who belong to the new act whom are covered by the 3yrs+1yr&10mos maximum working period, all of you can only avail the extension if you will be reemploy by your employer upon the end of your 3-yr sokourn period.

So upon reaching the 3-yr sojourn period and you or your employer have failed to acquire your reemployment papers, it would automatically mean that your 3 year contract here in South Korea has ended and you will need to go home to the Philippines or you will be working illegally.

In order to attain your maximum possible working visa here in Korea ( 1st 3 yrs plus extension) your last employer at the end of your 3yr sojourn period should have successfully reemployed through the Labor Center on your locality.

Regarding the additional 2 chances of releases for those who will be reemployed under the 3yrs+1yr&10mos, yes it is true but be aware that, 3 maximum releases for your first 3yrs and then only 2 more for your 1yr and 10mos. If you haven't use even a single release on your first 3 yrs, still you will only have 2 available releases for the remaining 1yr&10mos.

maraming salamat po bossing now i know. eh pano naman po kung after 3 years narenew ng contract but then maybe after few months or a year eh magparelease ulit or ni release ng company is it possible po ba na mkalipat ng ibang company or mapapauwi napo ng pinas?

in that case basta binigyan ka ng release paper wala ka magiging problema sa paglipat ng iba company, mayroon ka pa 2 chances para magparelease. Salamat din.

kuya zack comfirm ko lang po mag 3 years me sa march eh nakasign na ako ng bagong contrata at renewal ng alien card... if ever ba na makuha ko yun arc ko nxtweek eh pwede na ako makapag parelease kahit na sa march 2010 pa ang 3 years ko

reycute21, kailangan muna magsimula ang extension mo para magtake effect ang bago kontrata at arc bago ka pwede magpa release. Antayin mo n matapos ang 3yr sojourn period mo.

Hindi po pwede magbakasyon kung ikaw ay walang employer kc need mo letter from ur employer na pinapayagan ka magbakasyon

Kailangan meron ka employer na babalikan.

kuya natatakan na po yung arc ko mag 3 years kasi ako march 27 2010 pero nirenew na ako ng amo ko pati arc ko may tatak na ulit bago until march 26 2011... sa ngayun mahina ang company biglaan kasi nawalan ng work po eh pinapaghanap na kami ng work nxtmonth kasi wala na nga gawa wala na daw papasahod... so paano kaya yun eh february pa lang nxtmonth tapos march 27 pa ako mag 3 years... di ba talaga pwede? pati nga yung kasamahan ko na wala ng release at sa june pa mag 3 years eh pinapaalis na din... tulong po kabayang sir lumad..
