40hrs monday to saturday. LEGAL?
anyeonghaseyo!!! 40hrs po kami, pero may pasok ng sabado. ang ginawa po ng office d2 samin ginawa nila 7hrs lang isang araw yung isang oras na binawas inilagay sa sabado inilagay kaya may pasok na kami ng sabado. kc para sakin unfair samin yun, dapat na o.t. na yung buong sabado dba. LEGAL po ba yung ginawa nila? maraming salamat po sa magiging kasagutan nyo d2!

kabayan ilang oras po ang work ninyo pag sabado???whole day rin ba???if ang ginawa ng opisina ninyo is to cut 1 hr/day so total working hours in a week nyo ay 35hrs lang...if u are working 8 hours on saturday excess hours over 40 should have been overtime na...

Mga kabayan,
kabayang efren7, legal yung ginawa ng inyong opisina regarding the 40hrs a week. Pero let me remind our kababayans that an extended time working hours are allowwed, but the employer and the workers must have an agreement first. Also workers are enitled to receive additional wages for extended working hours, (yagan/night differentials from 10pm to 6am) or on holidays.
Another thing o consider is that the maximum working hours for a week is (44), which is commonly neglected by workers in understanding the minimum hours of work for a week.
That is why if you will read the miminum working wages for 2010, it says :
일급(8시간) 32,880원, 월급(주40시간) 858,990원, 월급(주44시간) 928,860원
so the minimum working hours for a a week is 40, and the maximum is 44, other than that, it will be considered an extension of working hours (OT).
Also we must remember the less-than-5-workers rule.
The 40 working hours a week does not apply to foreign workers who belong to companies who have less than 5 workers. They also are not entitled to receive additional wages for extended working hours as long as the employer and the foreign workers have agreed to have this working hours extension. I hope that clarifies your situation.
As long as the total of working hours is 40 hrs a week, then it is legal for your company to implement this rule.
Also, as long as you agree to the terms set by your employer, any extension of working hours, depending on the number of workers, will be compensated by additional wages.
