2010년도 최저임금 안내

□ 적용기간 : 2010.1.1～2010.12.31
□ 최저임금액
○시간급 4,110원으로 모든 산업에 동일하게 적용
-일급(8시간) 32,880원, 월급(주40시간) 858,990원, 월급(주44시간) 928,860원
□ 적용범위 : 근로자를 사용하는 모든 사업 또는 사업장에 적용
○감액적용 대상
-수습사용 중에 있는 자로서 수습사용한 날부터 3월이내인 자는 10% 감액 적용 가능
-노동부장관 승인을 받은 감시 또는 단속적 근로에 종사하는 자는 20% 감액 적용 가능
○적용제외 대상
-정신 또는 신체의 장애로 근로능력이 현저히 낮은 자로서 사용자가 노동부장관 인가를 받은 자
-동거의 친족만을 사용하는 사업의 종사자, 가사사용인, 선원법의 적용을 받는 선원 및 선원을 사용하는 선박의 소유자
□ 사용자의 의무
○ 최저임금 주지의무
- 사용자는 2009.12.31까지 다음 사항을 근로자들이 볼 수 있는 장소에 게시하거나 그외 적당한 방법으로 근로자에게 주지시켜야 함
※주지사항 : ▴ 최저임금액 ▴ 최저임금에 산입하지 아니하는 임금의 범위
▴ 효력발생일 ▴ 적용제외 근로자의 범위
○ 최저임금액 이상의 지급의무
- 사용자는 근로자들에게 최저임금액 이상의 임금을 지급하여야 하며, 최저임금액을 이유로 종전의 임금수준을 낮추어서는 아니됨
※최저임금액에 미달하는 임금을 정한 근로계약은 그 부분에 한하여 무효가 되고, 최저임금액과 동일한 임금을 지급하기로 한 것으로 봄
○ 도급인의 연대책임
- 수급인이 도급인의 책임져야 할 사유(도급계약 체결 시 인건비단가를 최저임금액 미만으로 결정하는 행위, 도급계약 기간 중 인건비단가를 최저임금액 미만으로 낮춘 행위)로 근로자에게 최저임금액에 미치지 못하는 임금을 지급한 경우 도급인은 해당 수급인과 연대하여 책임을 짐
최저임금 미달 여부의 판단방법
아래 임금을 제외한 임금총액을 시급으로 환산하여 시급 최저임금액(4,110원)과 비교
- 매월 1회 이상 정기적으로 지급되지 않는 임금
-소정근로시간(근로일)에 대하여 지급하는 임금 외의 임금(연장․휴일근로수당 및 가산임금 등)
- 생활보조적․복리후생적으로 지급되는 수당 또는 현물급여
※ 월급의 시급 환산방법ː주40시간제⇒산입금액÷209시간, 주44시간제⇒산입금액÷226시간
일반택시운송사업 운전근로자의 최저임금 산입범위
단체협약, 취업규칙, 근로계약에 정해진 지급 조건과 지급률에 따라 매월 1회 이상 지급하는 임금(생산수당, 근속수당, 성실수당 등)
- 소정근로시간 또는 소정의 근로일에 대하여 지급하는 임금외의 임금(연장․휴일근로수당 및 가산임금 등)과 생활보조․복리후생을 위하여 지급하는 임금(가족수당 등)은 제외
※ 시행시기 : 특별시․광역시 ‘09.7.1, 제주도․시 지역 ’10.7.1, 기타 지역 ‘12.7.1

Next year’s minimum wage set at 4,110 won, up 2.75%

This year’s increase rate is the lowest since the financial crisis and a huge gap between labor and management forced
it to be decided by votes.

Next year’s minimum wage is set at 4,110 won (monthly 858,900 won based on a 40-hour workweek system), up 2.75% from this year’s rate.

The Minimum Wage Council convened an all-member meeting from 7 pm on June 29 and representatives of unions and employers waged a tug of war between their proposals and early in the morning on June 30, the council members cast a vote on the mediation proposal made by public-interest members.

Next year’s minimum hourly rate, which is up 2.75% from this year’s 4,000 won, is the lowest rise since the financial crisis in 1998 except from September 1998 to August 1999, when the hike rate was only 2.7%. The minimum wage increase rate for this year was 6.1% and given the current inflation rate hovers at around 3%, next year’s real minimum wage is actually slightly cut down.

The minimum wage negotiation this year hit the wall from the beginning due to a stark contrast in proposals between unions and employers as issues such as low-income workers’ right to survive and shortage of wage payment capacity of smaller businesses got entangled amidst an economic crisis.

The original minimum hourly rates proposed by labor and management sides were 5,150 won (28.7% increase) and 3,770 won (5.8% decrease), respectively. The proposals made by labor and management in the last 7th round full-member meeting were 4,800 won and 3,840 won, respectively, showing a little progress.

Unions demanded that as social security is insufficient, minimum wage should be at least half of the average wage of the total workers. In contrast, employers called for a cut-down of minimum wage for the first time since the minimum wage system was introduced in 1988, insisting that since minimum wages have continuously grown and small and micro businesses cannot afford the labor cost as a result of implications of economic recession, employment insecurity, therefore, will be brought about.

Such a wide position gap led the Minimum Wage Council to determine next year’s minimum wage by voting rather than consensus this year, which is different from last year’s case. The agreed minimum wage level will be confirmed and announced by Labor Minister within 90 days.

At the same time, an intensive review on the proposed bill on the revision of the Minimum Wage Act is scheduled during the fall plenary session of the National Assembly, heating up a controversy over improvement of the minimum wage system between labor and management.

According to the revision bill of the government and the ruling party, minimum wage security level will be more lowered than the current one including: ▲ introduction of regionally different minimum wages; ▲ extension of the probation period of probational workers; ▲ reduction of the minimum wage for senior workers aged 60 and over; and ▲ counting the cost of food and accommodation provided by employers in the minimum wage. Until now, food and accommodation fees have not been allowed to be deducted from the minimum wage and employees have been guaranteed full minimum wage.

may computation po ba kayo ng yr 2010 salary wage increase tulad ng format na pinost nyo yung title eh 2009 salary wage increase mas malinaw po kc ganung format.tnx po

ask ko lng po pno po compute night differential 8pm to 8am pasok nmin up to friday pero pag pumasok sabado ot na nmin 8pm to 8am din po magkano din po ba bayad nung sabado tnx po.

kabayang wheyinkorea.ang night differential po ay magsimula sa 10pm until 6am kahit anong araw po yan ang nakasaad sa korean labor..and night differential is only 2000/hour po. kung sabado po meaning lahat ng oras na un ay overtime na +night differntial..meaning to say for example sa amin dito pasok nmin kung yagan is 7:30pm-7:30am, ang night differntial nmin doon sa halip 8 hours,7 hours lang binigay ng company nmin pero ok lang..and then since sabado yan overtime na lahat ng oras na yan so overtime nmin sa sabado is 10.5 hours..so computation natin is 7night differential times 2000 won equals 14 000 won ang night differential nmin sa sabado..and then sa overtime 10.5 times 6000 won equals 63 000 won tapos i plus ntin ung night differntial ganito ang mangyari 14 000 won plus 63 000 won equals 77 000 won..so ang bayad nmin sa sabado is 77 000 won..ganyan lang ang computation kabayan..pati monday to friday na overtime e times mo ng 6000 won..kc 6000 won per hour ng overtime ntin..hope it helps kabayan..
