NPS Q&A: "Employers Not Paying Contribution for Their Workers"
Hello Everyone:
I wanna share you my drafted queries sent to NPS Office thru its website pertaining to issue on "Employers Not Paying NPS Contribution" for their workers as well as the NPS official reply. Please refer below.
I am sure this will be helpful to Foreign Workers in Korea who have experienced same fate by their abusive employers. Please share to others as well.

I have three friends under E-9 Visa (Employment Permit System) whose employer did not register them into the NPS (National Pension Scheme) nor paying monthly contribution since start of their work in their current company.
My friends already told their employer to register them and pay 50% share for their monthly contribution (9% of their basic salary) but their employer refused to do without any valid reason.
As I know, under NPS policy, all foreign workers has the right to be registered into the NPS and get 50% employers share for their NPS monthly contribution.
In order to help my friends, please help answer my questions as below...
1) What legal actions do my friends may proceed to get their NPS benefits?
2) My friends have been working in the company for almost 2-years already, what the NPS office can do to help them get their benefits?

This is in response to your questions.
There are two different kinds of mandatory insured persons under the Korean National Pension Program. One is a Workplace-based Insured Person, and the other is an Individually Insured Person. How to report a person’s income to the National Tax Service (NTS) decides whether he or she is a workplace-based insured person or not. Korean National Pension Act provides that contributions rate of insured persons pay 9% of their income. Individually insured persons have to pay 9% of their income to the National Pension Service (NPS) by themselves, whereas, for the contributions of the workplace-based persons, employees and employers are to equally take the responsibility of paying contributions.
In principle, if you friends are working in Korea, they are to be under the National Pension Scheme. Based on your argument, your friends are thought to be workplace-based insured persons.
The NPS imposes its pension contributions on employers based on the data of the NTS. If the employer of your friends does not report incomes of your friends to the NTS, the NPS does not have any legal foundations to levy its contributions for your friends on the employer. If the employer reports the incomes of your friends to the NTS as employees, the NTS informs us of the date which give the legal rights for the NTS to levy on the employer.
If your friends have any proofs of salary as employees, please ask them to visit the NPS regional office in the vicinity of the company. The officer in charge of the company might help your friends.

hello sir kagagaling ko lng po sa nps sa gumi kz nag inquire ako about my nps contribution kz po pauwi na ko dis coming august kaso po wala pa din hinuhulog amo ko monthly po mrn kmi kaltas na 44,500 tinanong ko po un babae dun bkit wala sagot lng po samin nde daw naghu2log amo nmin sbi nmin papano un eh mnthly kmi may kaltas eh sabi lng po samin kung nde daw maghu2log amo nmin wala cla magagawa pano po un sir ano gagawin nmin khit po kz un sa asawa ko narehire na xa un balance nla sa nps nde na rin nabgay den un panibago kaltas sa knya nun nakabalik nde pa din po nahu2log sna nmn matulungan nyo kmi sir pano nmin maku2ha un salamat po ng mdami,god bless you po....

tinawagan ko na po ang ang NPS Gumi... parang pasive ang reply nila to solve your problem...
so tinawagan ko ang Labor Office and confirmed na pwede kayo magfile ng petition regarding sa problem ninyo...
i suggest you to call me para mag-usap tayo and explain to you in details to hopefully solve your NPS problem...

gandang usapin n2,,ako rin kse ay hinde kinakaltasan ng NPS,ngunit cnbi qo n 2 s amo qo,pati nga health insurance wala ring kaltas,d2 p kya c sir dave pra matanung?bk kse me iba p tyung kbbyan jn n wala ring kaltas,d qo kse alam kung me liability ang EMPLOYER s huli..
