magandang gabi po sa inyu, tatanung ko lang po kung saan po pedeng makuha ang samsung insurance na 400,000 won kasi pa pauwi na po ako? saan po pwedeng makuha at anu po ang kailangan na ipakita? pwede po ba sa mnga banko? salamat po.........

hi noknat,

depende po... kung umabot po kayo ng 1-yr working sa company and the company has 5 or more regular workers, then you should receive toejikeum from Samsung Insurance Company and from your employer depending on the total amount according to computation fomula which is using your last 90-days salary...

pero kung hindi kayo umabot ng 1-yr at nagsara ang company or the company has only less than 5 regular workers, wala po kayong matatanggap na toejikeum...

Good day Sir Dave, applicable pa rin ba ang last 90 days salary let say magpa-release ako ng katapusan ng June...at galing ako sa bakasyon sa pinas from april 26 to May 26 kaya ang gross salary ko ay butal-butal as follows: APRIL=720,000; MAY= 145,000 at bale itong June lng ang buong 900,000won (kc wla kaming overtime at wla na rin pasuk ng saturday since January), magkano kya ang magiging toegicom na mkukuha ko if ever Sir considering 40 employees kami lahat?
Bale mag-end na kc first 3 yr sojourn ko by Aug 20 (one company lang po ako since then)at naiisip q lng mgpa-release na kc mukhang tagilid ang lagay ko, kc as early as June 1 ay ngpapaloap na ako sa opis about reemploymen ko at pinasasabi ko na sa marunong mag-hanguk ang tungkol sa prescribe timeline ng processing pero tumawag dw cla sa labor at immigration at ok dw khit sa Aug.15 pa ako iprocess sabay turo nila sa date sa Calendar.(Just Imagine 5 days na lng, nasanay kc cla sa ganung the previous year na 1 or 2 days na lng ska kmi pinapapirma at kinukuha ang ARC)Anu sa plagay nyo sir ubra ba yun at pwedi ko ba panghawakan yun na gusto nila akong irehire pero di nmn pasuk sa timeframe as prescribed by the new rule? If ever sir ay wla ba kayong copy of MEMO in Hangul galing immigration or labor about prescribe period of 30 to 90 days b4 end of sojourn ay dapat maprocess na ang reemployment pra ipabasa ko sa opis? Kc mukhang pti mga information personnel sa mga immigration/labor ay not well informed about new rule kaya tuloy pg nag-inquire ang mga taga-opisina kahit anu svhing paliwanag ay dun pa rin cla naniniwala.Sana masagot nyo po ang concern ko Asap. hi riomar,

1) about your toejikeum, if wala po kayong OT sa last 90-days work mo sa company, automatic po na according to your monthly basic salary ang toejikeum mo... you can receive your toejikeum through Samsung Insurance company at wala ka nang mareceive from your employer kasi wala ka namang overtime sa last 90-days work mo... if kumpleto kayo ng 3-yrs dyan, your toejikeum computation is monthly basic salary x 3 = total receivable toejikeum - tax deduction...

in case naman if meron kayong OT, kahit nagbakasyon po kayo, yung working days mo lang ang pagbabasehan ng computation... hindi po according to month but according to 90-days... so reversal counting lang gagawin sa days of work to make a total of 90-days...

2) yung sa reemployment naman... actually may bagong policy at procedure na po about sa number of days na kailangan ang isang EPS worker maiprocess ng reemployment... sa old policy, an employer can apply the reemployment of his worker within 90days to 30days before completion of worker's first 3yrs sojourn...

but now (effective April 12, 2010), for EPS workers who has been working in a company for more than 3-months, an employer can apply a reemployment within 90days to 15days before completion of EPS worker's first 3yrs sojourn period... so, in case sa situation mo, tama po ang employer mo... kahit 15days na po ang remaining before completion of your sojourn period, pwede ka pa rin i-apply ng reemployment sa labor office ng employer mo but if less than 15days na, yun ang hindi pwede... more so, i suggest ask your employer to start processing your reemployment as early as possible to avoid any risk...

para naman sa mga workers na kakalipat lang ng companies at malapit na rin matapos ang first 3yrs sojourn, if their working period sa company is less than 3-months pa lang until completion of sojourn period, dapat ma-iprocess na sila ng reemployment minimum of 45days before completion of their sojourn... if less than 45days, hindi na po pwede...

now sa case mo, if magpaparelease po kayo this month, but your sojourn period will end on Aug. 20, so meron ka nalang 2-months remaining... my question is, are you sure na makakita ka agad ng bagong company before deadline of your reemployment application which is 45days before Aug. 20? dapat kasi July 16 the latest, maiprocess ka na ng remeployment ng new employer mo in case magpaparelease po kayo... so for me, very risky po ang situation mo...

i suggest na later ka nalang magpaprelease if naiprocess ka ng reemployment at extended na ang visa mo ng 1yr and 10months... or malay mo, baka lalakas din ang current company mo few months from now... so no need ka nalang magpaparelease...

FOLLOW-UP QUESTION lng po Sir....Bale basic salary po kc namin ay 1st year=800,000 ; 2nd year= 850,000 & 3rd year ay 900,000. Question: [b]Alin po ang magiging basis ng severance pay na makukuha pg natapus ang 3 years?[/b] Kasi yung kasama ko nagpa-release at the end of his 2nd year ay nakuha nya lang ay saktong 1.6M won sa samsung + overtime galing sa employer.
