Bagong Balita Mula sa NLCC - Number and reason of Workplace change under the EPS - Dec 05, 2010
ㅇ In principle, foreign workers should continue to work in the workplace where they first began to work. However, in case there occurs any of the justifiable reasons for the change of workplace as are prescribed in the law, foreign workers are exceptionally allowed to move to another workplace up to three times during the first period of employment permission (up to three years).
* In case their employment is renewed for an additional period, they may change the workplace up to twice during the reemployment period. Under the previous provisions, the frequency of workplace transfer was counted regardless of whether the transfer was attributable to the foreign worker or the employer.
ㅇ However, the revised law which took effect on December 10, 2009 provides that “in case a foreign worker moves to another workplace because he/she cannot continue to work in the current workplace for a reason which is not attributable to the worker” the transfer shall not be counted into the limited frequency. This provision is to promote protection of foreign workers’ human rights.
■ The employer terminates or refuses to renew the labor contract for justifiable reasons.
■ The foreign worker cannot continue to work in his/her workplace due to reasons not attributable to him/her, such as closure or temporary shutdown of business.
■ The foreign worker employment permission is revoked or the workplace is restricted from employing foreign workers because of human rights infringement, such as physical abuse, overdue wages, deteriorating working conditions, etc.,
■ The foreign worker cannot continue to work in his/her current workplace due to injuries, etc., but is possible to work in a different workplace.
ㅇ Any person who interferes with a change of workplace or business by foreign workers is punished by imprisonment for up to one year and a fine not exceeding ten million won.

tanong lang po ako kabayan, yung friend ko kasi 4 years and 10 months na work dito balak niya po magbakasyon ngayon dec 19 ang sabi daw po ng labor, at ng iba niya kakilala di na raw po magbibigay ng reentry permit para magbakasyon lang, at di na raw makakabalik yung nabakasyon lang sa pinas.. pakilinaw naman po, salamat...

kung halimbawa kabayan at sya ay under ng 3+3yrs at nasa ika-apat na taon at 10 buwan, makakapagbakasyon sya sa pinas dahil inalis na ang requirement na tatak ng re=entry para makabalik, at hindi po totoo na di na makakabalik, kung tutuusin mas madali na sila makabalik dahil inalis na ang re-entry permit system basta hindi pa nauubos ang iyong visa. malabo kasi yung case nya kung under sya ng 3+less than 2 yrs, kasi e yung 4yrs and 10mos ay pauwi na sya nun sa pinas for good. So pwede talaga sya makabalik, basta papayagan sya ng amo nya magbakasyon. i hope makatulong ito.
