Sa pagkakaalam ko pwede basta lampas na 5 years nagwork ng legal sa korea ng diretso pero kailangan meron po sapat na pera sa bangko mga 20milyon ata tapos my monthly income na 2milyon plus.kailangan din po medyo mataas na ung level ng hanguk mal.

Starting July 2nd, foreign migrant workers who return home voluntarily upon completion of their legal working period (4 years and 10 months) without changing workplaces will be eligible to work again in Korea and will be allowed to re-enter the ROK to work for another 4 years and 10 months.

After the government made public the amendment for the "Enforcement Decree of the Act on Foreign Workers' Employment" on Feb 1st,the Foreign Worker Policy Committee determined the target industries and business scope for the implementation of the new system on April 26. The committee finished revising enforcement ordinances and regulations outlining detailed procedures under the revised law on May 8th and 9th, respectively.

The new measures will be implemented for workers (E-9 visa holders) from 15 labor-exporting countries under the Employment Permit System(EPS), which will apply not only to workers who finish their working period of 4 years and 10 months but also to foreign workers who complete 6 years* of employment in Korea under the previous code. Foreign migrant workers must meet the following requirements to benefit from the new system:

First, they must not have changed their workplace during their period of employment (4 years & 10 months / 6 years). In the case of involuntary changes in employment due to shut-down or closure of factories, foreign workers must have worked for at least 1 year for their most recent employer.

Second, workers must have worked in the agro-livestock, fishery, or manufacturing industries for companies employing less than 30 workers. Under the "Root Industry Promotion Act", foreign workers are still eligible for the EPS if they have worked for manufacturing companies with less than 50 workers participating in Root Industries.

Third, foreign workers' employment contracts must expire after July 2nd, which is the date the new Act will go into effect.

1 month to 7 days before the conclusion of an eligible foreign worker's employment contract, employers can apply for employment permits on their employees' behalf at local employment centers.

When applying, employers must submit a copy of a new employment contract for a period of more than 1 year (a standard employment contract) that will go into effect when the worker re-enters the ROK and begins working.

Foreign workers who are eligible for the new measures do not need to take a Korean Language Test for re-entry to Korea and are also exempted from employment education before and after coming to Korea. They can return to Korea 3 months after having returned to their home countries, and will work in their previous workplaces.

Through this system, employers do not need to find domestic workers and can hire foreign workers who have re-entered the ROK without being constrained by new employment limits on business. (Businesses can currently hire only a limited number of foreign workers)

On the other hand, foreign workers who are not eligible to participate in the new Employment Act due to having changed workplaces will have to take a special Korean Language Test to determine their eligibility to return to the ROK 6 months after having returned to their home countries. This special Korean Language Test will only be given to workers who plan to return to Korea and will be held 4 times a year (on a quarterly basis) for each labor-exporting country. Currently the Korean Language Test is offered in Vietnam, Thailand, Indonesia, and Pakistan. It will be offered additionally in Uzbekistan, Philippines, Bangladesh, Cambodia, Mongolia, and Nepal starting in the third quarter of 2012. (Test availability will be expanded to to other countries as soon as possible)

Foreign workers with a record of illegal alien status are not eligible to take the exam and therefore must leave Korea within the scheduled period.

Lee Tae-hee, director of the Manpower Policy Bureau in the Ministry of Employment & Labor said, "The special Korean Language Test and the Re-entry System for Sincere Foreign Workers will help companies make use of skilled workers and reduce the number of undocumented workers in Korea. The Korean government will confer benefits on migrant workers who obey the law and work hard while dealing sternly with illegal aliens."

Totoo po ba ung sabi ng tropa ko sa korea na di sila cover ng bagong batas na ito. Finish po cla 6years diretso sa august sa kundyang nila nagpunta amo nila sa labor sabi di sila cover dahil over 50 katao ung worker sa kundyang nila.
