The Ministry of Employment and Labor announced on the 17th that it had made an advance notice for enactment of the revised bill of the Employment Insurance Act. The revised bill provides for modified eligibility requirements for the Employment Insurance (unemployment benefits), which are intended to support the self-employed who are going out of business. The bill will take effect on January 22, 2012.

According to the revised bill, self-employed persons (in a single-person business or with fewer than 50 employees) may opt to be covered by the Employment Insurance: incumbent self-employed persons have to join the Insurance by July 2012 while new ones, within six months of their business opening, in order to be qualified for recipiency of unemployment benefits. The only requirement for coverage is the business registration certificate. It is estimated that there are 4.9 million self-employed throughout the country, 3.59 million of whom are with the business registration certificate.

The insurance contributions are proportional to the five scales of reference pay (ranging from 1.5 million to 2.3 million) that are designated by the Minister of Employment and Labor. The self-employed person who wants to join the Insurance shall choose one of the five scales, taking into account the monthly profit at the time of subscription, and pay the corresponding amount of contributions (2.25% of the selected reference pay, which breaks down into 2% for unemployment benefits and 0.25% for job security and job skills development programs) for one year or longer.

Once covered by the Employment Insurance, a self-employed person may receive unemployment benefits when he/she has involuntarily gone out of business for an unavoidable reason, such as declining sales and continuous unprofitability. In other words, the cases of intentional or voluntary business closing are ineligible for unemployment benefits. The eligible self-employed, upon business closing, will get a monthly benefit equivalent to 50% of the reference pay (750,000~1,150,000 won) for 3~6 months.

An official of the Ministry of Employment and Labor said that “a large number of Korean people decide to take up self-employment just because they find it hard to get employed”, observing that “the expanded coverage of the Employment Insurance is of great significance as an employment safety net for small self-employed businesses”.

Self-employed persons may apply for Employment Insurance coverage at the offices of the Korea Workers’ Compensation & Welfare Service (Tel: 1588-0075, Website: kcomsel.or.kr).
