may tanong lng po. If ever mag file ng bankruptcy ang company wala po ba kaming makukuhang tegicom (severance pay)?Paparelease na kc ako by aug 27 this year and talagang lubog na sa utang ung company.Ano po bang makukuha ko?ung samsung po ba at tegicom ay magkaiba?

may makukuha ka pa ring toejikeum as long as your employer has five or more regular workers at nakapagwork kayo dyan nag mahigit isang taon...

ang Samsung Insurance is an insurance company na naghahandle ng toejkeum... sila po ang magbibigay ng toejikeum based sa basic monthly salary ng isang worker... pero if marami kayong OT sa last 3-months before kayo umalis ng company, may possibility na malaki po ang toejikeum na dapat marereceive nyo based on standard formula of computation... in that way, ang employer nyo na ang magbabayad sa balance kasi nga ang ibibigay ng Samsung Insurance is based lang dun sa basic monthly salary nyo...

but since malapit na pala ma-bankcrupt ang empoyer nyo, ang sure lang na matatanggap nyo na toejigeum ay yung galing sa Samsung Insurance...

yes it has five or more workers and more than 1 year po ung service ko sa company namin.Kaso nga lang po nag change of workplace and company kami ng kasama ko dun sa sister company nya pero di naman po namin kasalanan un dahil talagang nagmerge ang dalawang company. So wla po ba kaming makukuha dun sa unang company kasi hndi naman kami umabot ng 1 year.?Bale ung sa pangalawang company nlng po ba?

i see... nung time na nagchange of workplace kayo, dumaan pa rin ba kayo sa standard process? which is ni-release kayo then niregister uli ng sister company at inapdate ang ARC nninyo? if that is so, tama po... mabaliwala po yung first year toejikeum ninyo sa unang company kasi hindi po kayo umabot ng 1-year kahit hindi nyo ginusto na mangyari yun... thanks...

hindi naman po kami nirelease pero niregister po kami dun sa sister company nya.We went thru the standard process except for releasing.Paki linaw lng po yung ARC?di ko po kc alam ibig sabihin nun. Eh paano po yun if ever aalis ako sa company this 27th kasi ung sahod po namin ay delayed na lagi bali naging installment po sya. Supposed to be ay every 10th of the month tapos ngaun ay makukuha namin this 20 and 30 of aug 50% OF the total salary
. It happened po kasi sa kasama ko na unang nagparelease sa akin at di po binigay sahod nya until now. Bali sahod po for the month of june and july.Tapos she received her samsung after a week of her release amounted to 1,199,000kw. Ano po yun? Toejikeum?Eh pano po ung sahod nya if ever hndi maibigay ng company?saan po makukuha? dun sa bond amount po ba from the samsung insurance? Am afraid po kasi baka ganun din po gawin nila sa akin.Madedelayed po ung kalahati ng july na sahod and for the whole month of august.

ARC (Alien Registration Card)... paano nyo nalaman na nakaregister na kayo sa sister company? check ur ARC... if meron nakalagay na new date sa likod, that means nairelease kayo at na-register sa new company...

kung delayed ang salary nyo lagi, habang nagwowork kayo dyan delayed pa rin ang sahod nyo... so i think, it's better magpaparelease na kayo dyan habang di ba nagfile ng bankcruptcy... dapat ang friend mo ay pumunta ng labor office at nagfile ng petition about sa pending salary niya... ganun din ang gagawain mo if magpaparelease na kayo... magfile ka agad ng petition sa labor para mabigyan ng deadline ng labor office ang employer nyo to give your delayed salary...

wala pong bond na makukuha sa Samsung Insurance... toejikeum lang ang pwede ibigay ng Samsung...

Period of entry ko is Apr 22, 2008 sa unang company ko. Tapos nung nag change of workplace kami nakatatak ung pangalan ng nilipatan that was on Sept. 22, 2008 po.
Nag paalam na po ako sa company na magpaparelease na nung monday kaya nga lang ay di me pinayagan on that day. They move it on AUg 27 nga po. Naawa naman din po ako sa company kasi good performance namn po in terms sa wages sila for the past two years of my service except lng po talaga this year na parang hirap silang bangunin ang company kaya pumayag na rin po ako na sa 27 nlng mag parelase.

I see..so ganun nlng po ang gagawin ko to file a petition po sa labor office to give them a deadline if ever delayed po ung salary ko.

Makisabad na nga lng po regarding delayed salary kc po ang alam ko required by Korean Law ang mga employer to purchase guarantee insurance in order to avoid non-payment of worker's salaries .Di po ba cla nai-apply ng Guaranty Insurance ng company nyo?Kc sa amin yearly my Bond amtg. 2M won sa Seoul Guaranty Insurance Company to cover for the delayed salary.Nung time na delayed din ang salary namin for two months, company pa mismo ngbigay sa amin nung Insurance Information Notice galing ng Seoul Guaranty pra cguro dun mg-claim if ever pero di ko in-avail kc pabakasyon na ako that time kaya yung delayed salary ko ay pagbalik ko na ng Korea ska ko na nakuha sa bank.Baka nman kako nai-apply kayo e mas mabilis cgurado mkakubra dun sa insurance & more convenient kesa sa mgpetisyon pa kayo sa labor w/c is isi-set din kayo ng preliminary conferences pra mag-settle...hope nakatulong ang info.thnx

Yes, our company has availed the guaranty insurance with a 2M bond. So, if ever there is delayed in wages the easiest way to avail it is to call the Seoul Guaranty Insurance? I see. ..Kasi ung friend ko na umalis na ay nagfile ng petition sa labor dahil nga ay hindi nya nakuha ung salary. Tapos sinabi sa kanya ng labor na depende sa company kung dun kukunin sa 2M bond na pinurchase ng employer ang magiging sahod nya.

Salamat sa advice po. Kasi ako ung susunod na magparelease at least may guide na po ako.
