company deduction...huhuhu
hi there..
ask ko lang po sana how much po ba dapat ang deduction ng company once na nag-absent ang isang employee?
->kahit 1day lang kc ang absent namin di2 sa company, parang 2days ang kaltas pagreceived namin ng salary...
is there a two kinds of overtime rate??
->W6,165/hr po ang rate ng overtime pero there is always this W4,932/hr na rate din ng overtime namin covered 16hrs per month.. bale if 46hrs ang o.t w/in a month ganito po ang computation daw... 46-16=30hrs
(30hr*W6,165) + (16hr*W4,932)= total o.t rate
hope for your reply kasi po gusto na po namin umalis sa company namin..nag-iipon lang po kami ng sapat na dahilan..

please refer below...
1) in case nag-absent po kayo ng 1-day (for ex.), yung 8hrs equivalent salary shall be deducted from your basic salary that is 4,110won x 8hrs = 32,880won
2) as you know, according to Labor Law, an EPS worker under manufacturing category shall be given a 1-day paid leave (4,110won x 8hrs = 32,880won) commonly known as weekly holiday (normally Sunday) granting that he/she has a perfect attendance in a week... more so, weekly paid leave is already added in your basic salary which is 858,990won (40hrs work week) and 928,860won(44hrs workweek)...
now, since nag-absent ka ng 1-day, your weekly paid leave will also be deducted from your basic salary because hindi na po perfect ang attendance mo in that particular week... so hindi na po kau qualified sa weekly paid holiday... in that case, lalabas po na parang 2-days ang deduction nyo...
3) about naman sa overtime rate... in general, OT rate = OT hrs x minimum wage x 150%... but para sa mga companies na kakachange lang ng workweek system from 44hrs workweek into 40hrs workweek system, within first 3-yrs from the date of its implementation, every first 4hrs OT of the week shall only treated as OT = 4,110won x 125% instead of 150%...
for example, if you work overtime with 20hrs a week, total of 80hrs...so, yung 4hrs a week instead of 50% additional overtime salary, 25% lang within 3-yrs from the date na nagstart ang 40hrs workweek system...
therefore, your total OT Salary is...
-> (60hrs x 4110won x 150%) + (16hrs x 4110won x 125%)
-> (60hrs x 6165won) + (16hrs x 5137.5won)
Note: yung 4,932won... mali po yan... OT rate for first 4hrs a week should be 5,137.5won based on 2010 minimum wage...

how about when the company consists of 100+ employees?

and about sa food allowance po.. 180,000 po ang binibigay ng company a month BUT once na nag-absent ka or holiday(korean red calendar) ay binabawasan po ng W6,000/per day na di namin pinasukan..

and again..wla tlagang puso ang ibang sajang..once na nagpa.OT or nagpa-extend ng working hours wala pong pakain ang mga pilipina dito..pero ang chinese..korean..at mga nagpapart-time ay pinapakain nila sa shiktang(discrimination)over!!!!

regarding sa additional questions mo, pls refer below...
1) workweek system always depends on the number of regular workers including Koreas...
-> 40hrs workweek system (applies to companies with 20 or more regular workers) - regular working hours is 8hrs a day from Mon ~ Fri only... working on Saturdays, Sundays and working in excess of 8hrs on weekdays should be considered as overtime work already... basic monthly salary of this category is 4,110won x 209hrs = 858,990won
-> 44hrs workweek system (applies to companies with less than 20 regular workers) - regular working hours is 8hrs a day from Mon ~ Fri only and Saturdays (4hrs only)... working on Saturdays in excess of 4-hrs, Sundays, and working in excess of 8hrs on weekdays should be considered as overtime work already... basic monthly salary of this category is 4,110won x 226hrs = 928,860won
2) about naman sa food allowance, actually according to the Korean Labor Law, hindi po nakasaad dun na obliged ang isang employer to provide food allowance or free meals sa mga workers like EPS... depende na po yan sa offer ng company... at normally nakalagay po yan sa kontrata na pinirmahan nyo if nmerong benefits na food free meals... so, kung ano ang nakalagay sa kontrata ninyo at hindi sinusunod ng employer, that's the time we can say na may violation na po ang employer...
3) about naman sa hindi kayo included tuwing may kainan sa shiktang... mga chinese at Koreans lang ang pinakain... naverify na po ba ninyo na meron din silang food allowance? baka kasi wala that's why sila lang ang pinakain...

tnx kuya..hayaan mo pag natapos ko tong composition ko..send ko sa sulyap... n about naman kay kobe..wala na kami pro love ko pa rin sya..may third party kasi..hehe

about naman sa food allowance nyo na 180K monthly, maari pong tama ang employer nyo na may deduction if wala kayong pasok because yung 180K na food allowance ninyo ay intended only for working days kasama na ang Saturday at Sunday kasi ina-anticipate na po nila ang Saturday ay merong overtime at yung Sunday naman ay always considered a paid holiday... that's why 6,000won ang deduction kasi yan ang per day budget ninyo (6,000won x 30days = 180Kwon)...
pero yung nightshift differential ninyo na fix 9,800won kahit nagwork kayo from 9PM ~ 8AM, kulang po talaga yan... from 10PM ~ 6AM working hours dapat meron kayong additional salary na 50% which is 2,055won based on 2010 minimum wage na 4110won/hr...
pwede po kayo magfile ng petition sa labor office at gawing valid reason kung gusto nyo magpaparelease...
