Sir dave,
Ask q lang, this june 2,2010 expire na allien card ko.Pero my 1 year pko d2 sa korea sakop pa kc ako ng
old law,bale re-employed nko.2005 pko d2 sa korea.Balak ko kc ndi na mag sign for another 1 year,lilipat sana
ako ng ibang company.Ano ba dapat kung gawin before june 2?inform ko ba muna sa sajang ko then punta ba me sa labor para ipaalam na ndi nko mag sign for another 1 year or straight nko sa immigration para mabigyan ako ng 3months para makahanap ng ibang company?Then totoo ba ung sabi sabi nila na 3 months na ung binibigay ng immigration?palugit ng paghahanap ng ibang company?Tapos, pede pang makauwi sa pinas for 1 month? dun sa 3 months na binibigay ng immigration?My naririnig kc ako pede dw makauwi sa pinas kahit 1 month then pag balik eh ska nlang makahanap ng company basta sakop pa siya ng 3 months? Maraming salamat po..Hintay ko nalang kasagutan
nyo..

Kung sino man po sa inyo nakaranas ng ganitong klaseng sitwasyon ko please pki comment nalang po..

it is advisable to renew every immigrant of Korea to renew their visa 2 months prior and before it ends to its scheduled expiration date. just go to the immigration and for applying for extension of stay and bring all the necessary documents.... ask 1345 for more details and u can speak an operator in english mode too ^^
and if you don't want to extend your contract to your company,go to what its called (jobcenter: 고용지원센터/goyongjiwoncenter), and apply for what they called : "사업장변경신청" saopjangpyongyongsinghong; means change of work place..and u must find a place of work immediately but if you cant find w/n 3mos u are can't no longer stay here in Korea and u must have to go back to your own country as a rule....

hi nikulasu,

ano po ba ang reason sa plan mong magpaparelease? kasi 1-yr nalang pala natitira 2nd sojourn period mo at hindi ka na rin pwede i-extend kasi nga per EPS policy 1-time reemplopyement lang po ang pwede... baka kasi mahihirapan po kayong maghanap ng new employer considering sa limited stay mo nalang dito sa Korea...

yes tama po kayo... per new EPS policy, a released worker has given 3-months duration to find a new employer from the date he/she gets an approval from the labor office...

granting na magpaparelease po talaga kayo, ito ang gagawin mo... magpaalam ka muna sa amo mo... sabihin mo na di ka na magrerenew ng new contract... as much as possible ngayon na para makapagprepare pa ng kapalit sayo ang amo mo... then punta ka sa labor office on the date na magpaparereae kayo to get yout release paper... after that, you should go to the immigration office to temporarily renew your ARC...

since June 2 ang expiration ng ARC mo, you should schedule your release date before that date.. pwede May 31, or June 1...

take note: if ayaw pumayag ang amo mo na magpaparelease kayo, and considering na wala siyang violations sa labor laws, wala po kayong magagawa but to renew your contract with him...

Meron po nman akong malilipatan na ibang company.My usapan kc kmi ng amo, then ndi nya tinupad 2years ago pa un
kaya ngaun lang ako nagkalakas ng loob na iparamdam sa kanya...Sayang nga short time nlang stay ko dito sa korea.Meron pa pala ng realease paper kahit ndi kna sign new contract?Kala ko po dun lang mga ndi na natapos ung yearly contract?

Sa immigration po sir dave ano po ba sasabihin ko or anu dadalhin na documents before ako tumuloy sa immigration?meron kc pini fill-up na papel un dba?

out of country po amo ko ngaun by monday po sasabihin ko sa kanya...
Again salamat sir dave atleast nalinawan ako at nadagdagan kaalaman ko sa laborlaw d2 sa korea..

P.S : Ahh pede po ba makauwi sa pinas if my temporary visa ako 3months given by the immigraton?

kabayang nikulasu,

yes... kailangan pa rin ang approved release paper kahit end of contract ka na sa company... so you still need to visit the nearest local labor office...

and before you go to immigration office, just bring ur ARC and release paper... ipakita lang ang ARC mo at malaman na nila agad ang status ng ARC mo na paexpire na...

and by the way, hindi po pwede magbakasyon ng Pinas if wala pa po kayong employer... you should have new employers first and have your ARC be registered within 14-days from the date you have started working in the said new company... then tsaka pa kayo pwede magbakasyon kung papayagan kayo ng new employer mo...
