mga kabayan plsss help nman me po....
mga kabayan tanong ko lng po kc 4 yrs nako d2 sa company ko staight po yun d2 nrin me narenew noong ntapos ko ang 3yrs ko at umuwi me ng pinas tpos dito pa rin ang nagpabalik sakin...itatanong ko lng po sna kc mlapit na matapos ang 4yrs ko next month napo at wla nman pong violation na nagawa ang amo ko..kaso gusto ko po sana magparelease kc yung asawa ko po ay tnt nkatira po kami sa bucheon ang company ko po ay d2 sa namyangju malapit po sa techno mart...kya bumabyahe po ako lagi kaso nahihirapan na po ako sa byahe kya po gusto ko magparelease na d2..ok lng po ba na magparelease ako kahit napo etong company ko ngaun ang nagpabalik sakin d2 sa korea nung nag3yrs ako tpos cla ang ngapabalik sakin...sana po matulungan nyo pa ako maraming maraming salamat po..

kabayan,
magpaalam ka ng maayos sa amo mo as early as possible... sabihin mo na hindi ka na magrerenew ng contract after 1-yr at ikaw ay magpaparelease na kasi gusto mong lumipat sa lugar ng asawa mo... i-explain mo lang ang situation mo... i'm sure papayagan ka ng amo mo...

salamat po sa reply sir dave pero ang inaalala ko lang kc eh sobrang sungit kc ng amo ko gusto ko sana pagnagpaalam ako eh wlang magiging problema irelease nya me pagtpos ko ko ng 1yr ulit..kc pag di sya pumayag eh mlamang habang nandito akosa company eh arawaraw magiging mabigat ang loob sakin ng amo ko..kya ko po tinatanong kung may magagawa ba ang amo kung gusto kong magpareleas na sa kanya..baka po kasi ipitin nya ko or balewalain nya ko tpos di nya ko bigyan ng release paper

actually, may right ang employer mo na ayaw kang payagan... kasi yan talaga ang nasa policy na bawal lumipat ng ibang company if yung reasons are not belong to the following as below...
1. The employer terminates during employment period for justifiable reasons or refuses to renew the labor contract after completion of labor contract.
2. The foreign worker cannot continue to work in his/her workplace due to reasons not attributable to him/her, such as closure or temporary shutdown of business.
3. In case the employment permit is canceled by obtaining the employment permit or special employment permit in false or other fraudulent ways pursuant to Article 19(1) or any restriction is imposed on the employment of foreign workers by employing a foreign worker without employment permit or special cases employment permit pursuant to Article 20(1)
4. In case working conditions are completely different from the terms of the labor contract or employment relations are deemed impossible to be maintained by social norms due to employer's unfair treatment including violation of working conditions;
5. The foreign worker who cannot continue to work in his/her current workplace due to injuries, etc., but can continue to work in a difficult workplace.
so, i suggest, try mo nalang mag-explain or sabihin mo nalang diritso na di ka na magrerenew ng contract...
