kabayang inc,
under Immigration Act of Korea, Article 11 (Prohibition of Entry), Item 1.6, it is said, "A person for whom 5 years has not elapsed after departure from Korea under a removal order"
in other words, all TNTs na nahuli at ipinadeport back to their home countries, need to wait for 5-years bago po magkaroon uli ng chance to apply back to Korea...
but for TNT's na mag voluntary exit, i'm not sure if merong special treatment with regards to penalties... i suggest you should consult our Philippine Embassy regarding that matter... because it is a government to government special agreement... i guess there might be a special treatment like less years of penalties compare sa mga nahuli...
hope my answer would help...

Re: matagal na sa company
dugtungan ko lang po ung sinabi ni kabayang Dave, its true sa immigration law d2 sa korea na ganun nga ang practice, sabi nila d2 sa korea kapag mag-voluntary exit ka (if TnT ka) 1 year or more than lang ang aantayin mo at pwede ka na makabalik sa korea, pero ang problema lahat ng nahuli at voluntary ay may record ang korean embassy sa pinas, w/c means na may record ka sa korea na illegal stay, pag-uwi mo galing sa korea Oo sabi after 1 yr pwede na pero kapag nasa pinas ka na at nag-apply ka after a year, may verification pa sa embassy at kapag nakita nila dun na may record ka (as illegal stayer) denied ka sa visa mo, so asaan ung rule na sinasabi nila na after 1 yr. madaming nangyari ganito ngayon sa KLT-Registration, ung iba akala nila pwede na sila makabalik, pero lahat ng nagparegister sa POEA nagverify pa sila sa korean embassy sa pinas, ang daming lumabas na meron illegal record sa korea, kaya isa-isa inimail ng MRD Division ng POEA ung mga nagparegister na may mga records of illegal stay sa korea, na hindi sila pwede magparegister/magtake ng exam this coming KLT Exam, un lang po...

hi pjsbrn,
granting na yung mga nag nadedeny pa rin sa Pinas to take the KLT, kahit nagparegister pa sila, tapos ganun pa rin ang nangyari then i can say na it's A FAULT OF THE PHIL. EMBASSY IN KOREA... I SUGGEST THEY SHOULD CONSULT OR CALL THE ATTENTION OF THE PHILIPPINE EMBASSY...
on the other side, baka mali lang ang info na natanggap nila galing ng Phil. Embassy... baka hindi lang 1-yr ang penalty... baka more than that pa kahit nagvoluntary exit pa...
so, sa mga gustong mag voluntary exit, dapat iklaro nyo muna sa Phil. Embassy ang penalty... at dapat meron kayong proof na paghahawakan na galing sa kanila confirming of the penalty agreement...

Re: matagal na sa company
by the way mga kabayan,
merong bagong offer ang Korean government thru immigration ngayon para sa mga TNTs... according to the news, all irregular migrants can leave Korea without any penalties basta mag voluntary exit sila starting May 5 ~ Aug. 31, 2010... meaning wala nang 5-yrs ban and fines... so pwede na silang makakabalik ng Korea under normal visa application process...

Illegal immigrants given until Aug. 31 to leave S. Korea
(Yonhap) -- South Korea will introduce a temporary grace period to allow foreigners staying here illegally to leave without punishment, the Justice Ministry said Monday, while promising to crack down on those who fail to depart ahead of the Seoul G-20 summit.
The measure will go into effect from Thursday until Aug. 31 under a government effort to reduce the number of foreign nationals staying here without permission, the ministry said. About 180,000 are estimated to be residing in South Korea illegally.
Illegal aliens who voluntarily leave the country during the grace period will be exempt from fines and a five-year ban on future entry, the ministry said, noting they will be allowed to reenter the country through the normal screening process later.
Local businesses that report undocumented migrant workers to immigration authorities will also have fines waived and receive high priority for a pool of substitute workers provided by the Labor Ministry, officials said.
Under current law, those who employ unregistered foreigners are subject to a fine of up to 20 million won (US$17,900) and a ban on future employment of foreign residents for up to three years.
After the grace period expires, the Justice Ministry said it will join hands with police to step up a crackdown on illegal aliens and their employers.
"The voluntary departure program will go side by side with the government's clampdown on the illegal aliens to minimize side effects from the law enforcement and enhance security in preparation for the G-20 summit," Seok Dong-hyun, chief of the Korea Immigration Service, told reporters. Seoul will play host to the fifth summit of the Group of 20 advanced and emerging economies in November.
Similar measures were adopted in 2003 and 2005, resulting in 1,793 illegal foreign residents leaving the country in 2005 alone, Seok said.
