sino man po ung my nakakaalam kc po buntis po ako alam na ng sajang ko kya pinagbabakasyon nya ako until manganak ang tanong ko po may ipa2file pba ako sa labor kahit di nmn ako nirelis ng boss ko?

Regarding your questions, We would like to explain the maternity leave stipulated in Labor Standards Act(LSA) as follows:



According to Article 74 of the LSA, an employer shall grant a pregnant female worker 90 days of maternity leave before and after childbirth. In such case, 45 days or more shall be allocated after the childbirth. And an employer shall pay leave benefits for 60 days of the leave period, while employment insurance fund will cover the benefits for the remaing 3O days upon application to the Job center. This provision is applied regardless of the female worker’s nationality.

If the employer violates Article 74 of LSA, he/she shall be punished by imprisonment of up to 2 years, or by a fine not exceeding ten million won.



And an employer shall not dismiss a worker by reason of only pregnancy, because according to Article 23 of the LSA no employer shall dismiss a worker without justifiable reasons. Especially, no employer shall dismiss any female worker during a period of temporay interruption of work before and after childbirth as provided in article 74 and within 30 days thereafter. If the employer dismiss a female worker the aforementioned preiod, he/she shall be punished by imprisonment of up to 5 years, or by a fine not exceeding 30 million won.

sir ask ko lang po sa nodongbu din po ba magpafile ng maternity leave?ano pong insurance ang kelangan kz po ang kinakaltas lang po samen eh kukminbohom at konkangbohom.salamat po ng marami..godbless.

sa case ko kc since di nmn ako nirelis ng sajang ko baka di na ko pumunta ng labor bka kc ung mga nagpupunta lng don ung mga wla ng employer............ung sa mga makukuha nmn bka di ko na habulin un ang importante eh pinayagan nila akong magbakasyon ng 3months maiuuwi ko pa ung baby ko ok na un tnx po sa lahat..........
