hello po,
ask ko lng kung anu mangyayari if pregnant po tas nalaman ng comp..possible po kaya n matanggal ako?pnu po yun kung la n release mbigyan p kaya ako sa labor?considering n yung sang reason ay release due to crisis at yung isa nmn not following labor contract..salamat po sa magrereply..

This is the National Labor Consultation Center.



Regarding your question, it is difficult for us to give a specific answer, as we don''t understand what you want to know.

There are some provisions to secure a female worker in pregnancy in the Labor standards Act.



So, we would like to inform you of protection provisions for a female worker in pregnancy.



An employer shall grant a pregnant worker 90 days in pre- and post-natal leave with pay. And the employer shall pay leave benefits for 60 days of the leave period, while the employment insurance fund will cover the benefits for the remaining 30 days if she is the insured of employment insurance.



No employer shall dismiss a worker without justifiable reasons. Expecially, any employer shall not dismiss his/her worker during a period of temporary interruption of work before and after childbirth within 30 days thereafter.



We hope that this counseling will help you understand Korean Labor Laws.

tanong po uli,posible po kys sa kalagayan ko n makapag palit ng comp?ksi mabigat work ko nagbubuhat ng mag box hanggang 3 at 4 n patong,gusto ko sana maghanap ng work n d nagbubuhat or nde sya chemical..may tatanggap kaya sakin pag 1month preggy?salamat po..

Kabayan,

Una sa lahat, ang maipapayo ko ay kausapin mo ang amo mo about your condition, kung maiintindihan ka niya, maaari mong hilingin na bigyan ka ng mas magaan na trabaho sa loob pa din ng kumpanya mo. Subalit kung hindi, maaari mo siyang hilingan na bigyan ka ng release paper. Kung sakali naman na hindi pumayag ang iyong amo, kakailanganin mo lang ng doctor's certificate bago pumunta ng labor center para ipakita doon at sila ang magbibigay ng final decision kung pwede ka nila bigyan ng release paper. Subalit bago mo gawin yan, subukan mo muna humanap ng trabaho na mas magaan bago ka magparelease dahil baka mahirapan ka lang maghanap ng trabaho na magaan at maiintindihan ka na buntis ka sa kasalukuyang kondisyon mo. Wala sa listahan ng tinatanggap na dahilan ang pagbubuntis para magparelease pero maaari nila itong kunsiderahin na dahilan base sa klase ng trabaho at kagustuhan ng nagbubuntis na malipat etc. Basta nasa labor center ang desisyon kung papayagan ka nila. Subalit kung sa una pa lang ay payag ang amo mo na irelease ka, wala ka magiging problema. Subalit pakaisipin mo ang mga benefits na makukuha mo at ang hirap ng paghahanap ng trabaho bago ka magdesisyon. Muli, subukan mo muna na humiling na ilipat ka sa mas magaan na trabaho.

Sana makakita ka ng magandang solusyon sa problema mo kabayan at sana makatulnog ang mga payo dito.

hello po,
may konting katanungan lng po ako.
buntis din po ako for about 2months, pero po mabigat ang work namin,at bawal daw sa company nmin.gusto ko sana tapusin muna yong contract ko sa company nmin for 2 year at uuwi nko,april kasi this year ang end ng 2years ko,kaya lng sabi ng O.B ko kailangan ko dw ng bedrest dahil mahina dw ang bata so nagpaalam ako s production n magkaroon ng 1 week n rest.yong leader nmin alm n buntis ako,pero sa office hindi. at sa di inaasahan nalaman ng opisina nmin n ganon ang kalagayan ko.so nagresign nlng ako at bumili nko ng ticket dahil gusto ko n ding umuwi para s safety ng ko at ng baby ko.dapat sa 31 this month ang uwi ko. but this is the sadest part dahil s sobrang hina ng baby ko i suffer from miscarriage.this happen 18 of this month.lahat ng pangyayaring eto s buhay ko this month lng nangayri.so humingi ako ng pabor sa company nmin na bigyan nlng ako ng 1month vacation sa pinas kasi di p nmn ako nkakapirma ng resignation letter at sayang din kasi yong ticket ko,pero iba ang nangyari agad din pinapirma ako ng resignation and after 3 days they issued me my release paper.gusto ko lng poalamin d2 n pwede po b akong humingi s labor nlng ng 1month vacation s pinas or kahit n 2weeks lng?

kabayan, sad to say, lahat ng kabilang sa EPS program ay hindi maaaring magbakasyon ng walang employer. Sa case mo, bagong employer. Susubukan kong alamin kung base sa kaso mo ay maaari kang bigyan ng exception pero i dont want to give false hope, Try mo na maghanap ng bagong employer na papayagan kang magbakasyon kaagad bago magstart ng work. I will update this reply pag meron akong nakuhang sagot.

tnx sir zack...di bale pag magaling nko hahanap nlng ako ng bagong employer so i can continue working here...how about this sir zack.
kasi n compute na ang NPS makukuha ko nga sa 19 this month.
if ever b na makakuha ako ng work automatic b kakaltasan ako
nag magiging bagong employer ko o hindi n.1st time ko kasing

hello marianne,

2 yrs ka kamo sa april and makukuha mo ang nps (kukmin) mo sa 19. Medyo naguluhan ako, baka tijikom yung makukuha mo. dahil ang NPS po natin ay makukuha pag tapos na po ang ating sojourn period dito (first 3yrs at sa second sojourn na either another 3 yrs or 1yr & 10mos, depende sa visa mo). Pero para sa mga magpaparelease, paglipat nyo sa bagong kumpanya, dapat na ituloy hulugan ng latest employer mo ang NPS mo. ang tijikom naman, basta 1 yr or more ka nakapagtrabaho sa kumpanyang aalisan mo ay makukuha mo sa pagalis mo.

balitaan mo kami kung nps nga yung makukuha mo, Good Luck!

sir zack sorry nguluhan k.ganito kasi yon dapat kasi uuwi nko nong jan 31.so may ticket nko kaya pumunta nko s NPS office. kaya lng nangyari nga ang hindi inaasahan. kaya nagdecide ako n mag stay p d2 s korea kasi nga may 1yr and 3 months p ako to finish my 3 yrs.tnx sir zack.
