This is the National Labor Consultation Center, the MOL.

For your understanding related to calculation of wages, we would like to inform you of the Minimum wages for this year as follows:



INFORMATION ON THE MINIMUM WAGES FOR THE YEAR 2010

2009년도 최저임금 안내


□ Period of application: Jan. 1 2010 ~ Dec. 31 2010

적용기간 : 2010.1.1~2010.12.31

□ Minimum wage

최저임금액

○ Hourly wage rate : 4,110 won, daily wage rate( on a 8-hour basis): 32,880 won

시급 4,110원, 일급(8시간 기준) 32,880원


○ In the case of 40 hours per week(209 hours per month) the monthly wage will amount 858,990 won.

주40시간제(월 209시간)의 경우 월급 836,000원


○ In the case of 44 hours per week(226 hours per month) the monthly wage will amount 928,990 won.

주44시간제(월226시간)의 경우 월급 928,990원


□ Target of application : every business or workplace employing workers

적용대상 : 근로자를 사용하는 모든 사업 또는 사업장


○ Workers whose minimum wage can be reduced

감액 적용 근로자

- Apprentices: his/her minimum wage may be reduced as much as 10% up to 3 months

(hourly wage rate : 3,699 won)

수급근로자 : 최장 3개월간 10% 감액 적용 가능(시급 3,699원)

- Surveillance or intermittent workers( when approved by Minister of Labor): Minimum wage can be reduced as much as 20% (hourly pay: 3,288 won).

감시단속적 근로자(노동부장관 승인시): 20% 감액적용가능(시급 3,288원)


○ Workers who are not applied the minimum wage

적용제외대상

- A person who has remarkably low abilities to work due to a mental or physical handicap (when approved by the Minister of Labor).

정신, 신체 장애로 근로능력이 현저히 낮은 자(노동부 장관 인가시)

- An employee who works for the workplace which employ only relatives living together or domestic workers.

동거의 친족만을 사용하는 사업의 종사자 또는 가사사용자

- A sailor who is subject to the seamen law or an owner of ship employing sailor.

선원법 적용 받는 선원 및 선원을 사용하는 선박의 소유자


□ Liability of the employer

사용자의 의무

○ Liable to pay above the minimum wage to the employee.

최저임금액 이상 지급의무

- An employer shall pay the workers at least the minimum wage rate or more. And no employer may lower the previous wage level on the ground of the minimum wage.

- 사용자는 적어도 최저임금액 이상의 임금을 지급하여야 하고 최저임금을 이유로 종전 임금수준을 저하하여서는 안됨


- If a labor contract provides for a wage that is less than the minimum wage rate, it shall be considered to stipulate that the same wage as the minimum wage rate shall be paid.

- 최저임금액에 미달하는 임금을 지급하기로 근로계약한 경우, 최저임금액과 동일한 임금을 지급하기로 한 것으로 간주


○ Obligation of notice of the minimum wage to the worker

근로자에 대한 최저임금 주지 의무


- An employer shall inform the workers of minimum wage rate, wages not included in the minimum wage, effective date, and workers being excluded from the minimum wage Act.

사용자는 최저임금액, 최저임금 미산입 임금, 효력발생일, 적용제외근로자에 대하여 고지하여야 함


□ In the cases of the following, a contractor shall take responsibility for violating Minimum Wage Act jointly with the subcontractor.

도급인이 최저임금법 위반의 연대책임을 지는 경우


- As for determining the unit labor cost lower than the minimum wage at the time of the signing of the contract;

도급계약 체결시 인건비단가를 최저임금액 미만으로 결정한 경우


- As for lowering the unit labor cost to below the minimum wage in the middle of the contract period.

도급계약 기간중 인건비단가를 최저임금액 미만으로 인하한 경우

punta ka agad ng immigration office bukas... im not sure if may penalty ka na or wala pa... bring ur current emploment contract sa company and a copy of business registration of your employer...

sir dave,
tanong ko lng po kasi yung asawa ko naguguluhan kasi daw may nakapag sabi daw sa kanya na dapat daw may 15 days leave daw sila at kapag di daw nagamit sa isang taon babayaran ng kumpanya. at kung di man daw sila binayaran nito habang nung nasa kumpanya sila pwede daw ito i file daw ito nang mabayaran sila bago siya umalis sa korea sa jan 18, 2011 6 yrs na po sya.. ang problema nakalimutan ni mister saan i file. sir dave pakilinaw po ito kung totoo at kung saan po niya pwede i file .

pls tell your husband to approach his employer and ask to avail his annual paid leave... if his employer is not willing to give such benefits, then tell your husband to file a petition at the local labor office which has a jurisdiction of his employer if malapit na po matapos ang sojourn niya...

good night po sir Dave,i want some clarifications sa min wage '10..sa sun po paano po tlaga ang computation nun?rotation kmi after 2weeks pag dayshift magkano po sun ot 8:30-8:30 po kmi.then pag nightshift magkano po can you pls teach me how to compute for it.tapos at the office blak nilang i-3 shift kmi so bale 8hrs. per shift i mean to say 8:30-5:30 1st shift5:30-1:302nd and1:30-8:30 3rd so yng magwowork nn gabi may night diff ba cla..more power..

hi bluecool,

please refer below...

1) sundays are always considered paid holiday... and the salary is already included in your monthly basic salary which is 858,990won for 40hrs workweek and 928,860won for 44hrs workerweek.

2) in case you are working during saturdays and sundays, automatically your salary per hour is 4110won/hr x 150%...

3) nightshift differential is only applicable from 10PM ~ 6AM work... nightshift additional salary is 50% of hourly minimum wage...

4) for example: if you are working overtime on sundays from 5:30PM to 1:30AM, your salary must be (8hrs x 4110won x 150%) + (3.5hrs x 4110won x 50%) = 56,512.5won...

--> your nightshift differential is 3.5hrs x 4110won x 50%... (3.5hrs is taken from 10PM ~ 1:30AM working time)

the computation of nightshift differential is similar to working on Mondays ~ Saturdays...

Good Morning po! Ask ko lang po ung payment of holiday,kung you worked that date how much po in 8hrs.?

plus 50% of the minimum wage... so, since 2010 minimum wage is 4,110won per hour so your overtime work during holiday is 4,110 + 2,055 = 6,165won per hour...

same lang din po yan if you work overtime during weedays, saturdays and sundays...

hi arnelyn,

yes you can work here if merong employer na maghahire sayo... the bottom line is you should find an employer first na maghahire sayo at magproprocess ng visa mo under E-7 visa...

more so, if you are willing to work under unskillled job (3D jobs), you can apply at POEA under EPS program... but you have to study Korean kasi meron pong Korean Language Test (KLT) bago po kayo mainclude sa jobseekers roster for hiring Korean employers... and take note, KLT is not done regularly.. it always depend on Korean government kung kailan na naman sila magconduct ng exam...
