hello po sa lahat, binabasa ko po ung announcement tungkol sa 5 years sojourn at nakasaad dun na after 3 years at na reemployed ka mabibigyan ka uli ng less than 2 years na sojourn, pano kaya kung after 3 years at ayaw ka ng ireemploy ng company eh di mo rin pala maaavail yung additional 2 years, uwi din pala sa pilipinas, kelangan din pala irehire ka ng same company para mabigyan ka uli ng additional 2 years, inalis lang yung 1 month mandatory stay sa pinas. tama po ba kaya ang interpretation ko sa bagong batas??

mali po...after 3 years at ayaw ka na ireemployd ng company mo ay automatic relis ka na...at pwede ka makahanap ng ibang company..kasi ay may 2 years ka pa na visa...pakibasa ulit yung anouncement kabayan...baka naconfused ka lang..

The National Assembly of Korea approved on 16 September 2009 the FIVE (5) years sojourn period of EPS workers, amending for the purpose the Act on Foreign Workers Employment. The new law is expected to be published in the Official Gazette around third week of October 2009 and will take effect two months thereafter or around third week of December 2009.

Under the old rule, EPS workers are granted three years sojourn period. If he is re-employed by his last employer, he has to leave Korea first and come back after about one month. He is given another three years on his second sojourn period.

According to the Foreign Workforce Policy Division of the Korea Ministry of Labor (MOL), the new law, upon its entry into force, would grant a period of stay according to the status of the worker, as follows:

1. Newly hired workers - Three years. If the worker is re-employed by his employer, plus less than two years without need to leave Korea.

2. Workers in Korea who are in their first (three year) sojourn period – If the worker is re-employed by his employer, plus less than two years without need to exit Korea. However, if the employer files the application for re-employment not later than 09 December 2009 and within the prescribed period (30 to 90 days before the end of sojourn), plus three years, but must leave and re-enter Korea.

3. (Re-employed) workers in Korea who are in their second sojourn period – the remaining portion of their three year sojourn period.

We shall furnish you a copy of the official English translation of the new law as soon as the same becomes available.


andyan kasi ung pasubali na "if the worker is re-employed by his employer" dun p lang mabibigyan ng plus less than 2 years so required na iapply ka ng reemployment permit after ng 3 years.
anyways thanks kabayan sa dec. 2010 p nmn tapos ng 3 years sojourn ko may mga pagbabago p cguro mangyayari tungkol dyn

di po...kung gusto nyo po,,,you can ask sa molab..may site sila na pwede ka magtanong..or sa mga nodongbu..or you can call sir reeve or si zack...para mas malinaw sayo..

thanks sa recommendation mo kabayan jrtorres, i visited the molab site at dun may nakita ako related topic tungkol sa refusal ng employer to recontract the worker after ng 3 years, their visa will soon to expire this jan. 23 2010 and sad to say sabi ng molab ay kelangan nila ng reemployment permit to continously work for additional 1 year and 10 months and it must be applied at least 30 days before expiry of their visa but since their current employer refuses to reemploy them baka mahirapan n rin sila maghanap ng new employer that can reemploy them since 1 mo. n lang ang natitira sa visa nila.

Kung titignan halos pareho lang sa dating rule except sa pagalis lang sa compulsory 1 mo. stay sa pinas at sa pagbawas sa additional sojourn period from 3 years to 1 year and 10 mo.

kabayang HEDSAN,ako po ay sa april 2010 mag 3 yrs.sunod po ako sa new law na plus 2yrs...dahil ayun po sa labor mismo,sinadya pa naming pinuntahan to..rehire ka o hindi ng employer mo,plus 2 yrs ka pa din...If ever,d ka na nirehire ng amo mo,kelangan makahanap k pa din ng bago mong employer plus 2 yrs pa din...Sana nakatulong ako sa agam agam mo..ty

tama kapo kabayang cecil....naguluhan kasi ang iba nating kababayan sa example ng last employer n magbigay ng reemployment...basta ang maging visa natin ay 5 years..yan po ang maliwanag..kaya wala na tayo dapat ipagalala..
