1) As explained, 44-hrs workweek system shall be implemented for companies with less than 20 workers starting July 1, 2008. So even 3 employees lang kayo, dapat follow parin ang company nyo sa 44-hours workweek system.
2) But with regards to payment of your overtime, I am sorry to say... Meron pong provision sa Enforcement Decree ng Standard Labor Act of Korea na if the number of employees sa isang company ay less than 4 workers, ay maaari pong hindi magbayad ang employer ng Overtime Pay, Night Differential, and Annual Paid Leave System. But if if the proper payment for Overtime Pay, Night Differential, and Annual Paid Leave System are described or stated in your contract, in that case your employer is obliged to pay you but if wala then wala po tayong magagawa.

1) I am sorry, meron po akong changes sa previous answer ko...please refer to bold fonts...
2) With regards naman sa Heath Insurance, lahat po na migrants workers regardless of number of workers in a company ay mandatory to register the Health Insurance under employment category. So dapat ni-register ka sa employer mo sa National Heath Insurance Center (NHIC). And dapat meron ka monthly contribution na 5% of your basic salary (50% from you and the other 50% from your employer). In that case, meron ka dapat Health Card for medicine and medical services discounts.
3) Sa NPS or "kukmin", regardless of the number of employees in a company, all foreign workers must be covered by NPS. You must have a monthly contribution of 9% of your basic salary (50% from you and the other 50% from your employer).

Overtime computation ----- 4000 won x 1.5 (150%) = 6,000 won O.T/ hr.
Night differential ----- 4000 won x 0.5 ( 50% ) = 2,000 won N.D/hr.
Total = 8,000 Won ( 10pm-6am excluding breaktime)

For your understanding related to calculation of wages, we would like to inform you of the Minimum
wages for this year as follows.
INFORMATION ON THE MINIMUM WAGES FOR THE YEAR 2009
□ Period of application: Jan. 1 2009 ~ Dec. 31 2009
□ Minimum wage
○ Hourly wage rate : 4,000 won, daily wage rate( on a 8-hour basis): 32,000 won
○ - In the case of 40 hours per week(209 hours per month) the monthly wage will amount
836,000 won.
I - In the case of 44 hours per week(226 hours per month) the monthly wage will amount
904,000 won.
□ Target of application : every business or workplace employing workers
○ Workers whose minimum wage can be reduced
- Apprentices: his/her minimum wage may be reduced as much as 10% up to 3 months
(hourly wage rate : 3,600 won)
- Surveillance or intermittent workers( when approved by Minister of Labor):
Minimum wage can be reduced as much as 20% (hourly pay: 3,200 won).
○ Workers who are not applied the minimum wage
- A person who has remarkably low abilities to work due to a mental or physical handicap
(when approved by the Minister of Labor).
- An employee who works for the workplace which employ only relatives living together
or domestic workers.
- A sailor who is subject to the seamen law or an owner of ship employing sailor.
□ Liability of the employer
○ Liable to pay above the minimum wage to the employee.
- An employer shall pay the workers at least the minimum wage rate or more. And no
employer may lower the previous wage level on the ground of the minimum wage.
- If a labor contract provides for a wage that is less than the minimum wage rate, it shall be
considered to stipulate that the same wage as the minimum wage rate shall be paid.
○ Obligation of notice of the minimum wage to the worker
- - An employer shall inform the workers of minimum wage rate, wages not included in the
minimum wage, effective date, and workers being excluded from the minimum wage Act.
○ A contractor shall be held accountable for the following:
- - As for determining the unit labor cost lower than the minimum wage at the time of the signing
of the contract;
- As for lowering the unit labor cost to below the minimum wage in the middle of the contract
period.
※ HOW TO ESTIMATE IF THE MINIMUM WAGE IS FULFILLED
○ Convert the total wages excluding the below wages and allowances into hourly
wage rate and compare it with hourly minimum wage( 4,000 won).
① wage which is not paid regularly more than one time per month(such as bonus)
② wage which is paid for the non-fixed working hours( such as extended work
allowance)
③ Allowances paid for an employee''s living support or welfare
○ How to calculate the monthly salary based on the hourly pay:
4 40-hour work week ⇒ monthly regular wage for contractual working hours ÷ 209 hours
44 44-hour work week ⇒ monthly regular wage for contractual working hours ÷ 226 hours
※ EVEN THOUGH THE STATUTORY WORKING HOURS ARE REDUCED THE PREVIOUS

1) under 44-hrs work week system (8-hrs work Monday~Friday and 4-hrs Sat.) : 226 hrs x 4000 = 904,000 won

-> Overtime Salary = 4,110 won + (0.5 + 4,110) = 6,165won
-> If meron kayong nighshift work, from 10pm ~ 6Am, meron din kayong additional 50% salary. Same lang din ang computation sa overtime salary...
by the way, marunong ba kayo gumamit ng MS Excel program sa computer? Meron sana me ginawa na Overtime Auto-monitoring Sheet... Bali encode lang ninyo ang time-in/time-out also the number of hours OT, then automatic na magcocompute kung magkano ang expected salary nyo in a month... just email me at sulyap.managing@gmail.com...

-> 904,000 = 904,000/1195 = 756.48USD
-> 756.48usd x 45.28PHP = 34,253
therefore, 904,000won is equivalent to P34,253 as of today's rate...

nakapagsign na ba kayo ng contract? dapat sa contract nyo nakasaad dun ang working hours details and salary... dun nyo malalaman kung may overtime ba ang 904,000 basic monthly salary nyo...
