Re: Filing a Petition with a Local Labor Office thru Internet...
to mr. dave,
good day.
highly commendation for sharing this very important site to our fellow migrant workers. indeed, this is a great help for all of us. it only shows that the Ministry of Labor is also trying and extending all their means to reach out to the migrant workers, extending means on how to help and protect the benefit of migrant workers. this is also a way of expressing that they are not only after on the protecting those SME's and other industries.
now, it is up to the migrant workers to know their right, understand the law and fight for what is right for them, instead of barking and blaming the content and context of the law and make it an excuse to be an undocumented worker.
Mabuhay All OFWs!
good day.

what can you say about her experience? do you think the ministry of labor was really trying to help ms. welkyut's problem to get her unpaid salary? do you believe when they said that all the information given by ms. welkyut about the company location, name, etc were not true and even the number cannot be contacted? thus until now no positive result at all? or maybe they were just ignoring the issue because they know that ms. welkyut was already in the philippines? or the worst scenario, the ministry of labor was biased to the said abusive employer instead of helping the petitioner...
sometimes i can't deny to say that "Korean Labor Law is really good for migrant workers in Korea but hanggang papel lang pala"... because in reality, they are not actually serious in helping out distressed migrant workers according to what is written in their law...
it was really very discouraging to know ms. welkyut experience...

Re: Filing a Petition with a Local Labor Office thru Internet...
to mr. dave,
good day.
actually, i read that case, and i am wondering what was the part done by our authorities assigned here in Korea? Like the Philippine Embassy? I am wondering if ms. welkyut asked for the assistance of the Philippine Embassy, if yes? what was the action taken?
this is the dilemma - are these people paid by our government really doing their part? protecting the welfare of Filipino Migrant Workers?
As of now, though there are several moves, discussions, etc. to revamp the existing Law pertaining to Migrant Workers, these authorities should not take for granted this kind of case. Maybe, you have the point that the Ministry of Labor ignored this case since the petitioner is already in the Philippines, but I believe the people of Philippine Embassy can do something about the case.
If somebody in the right authority has the strong will to fight for the welfare of migrant workers, especially the Filipinos, these authorities who have the right and easy access to the Korean government, ..... If somehow they do what really their responsibilities are, ... If somehow they have the guts to question the way the law was implemented... If somehow they are visible to fight for the migrant workers' right.... There are lots "ifs" and "buts" which affects the true essence on the implementation of the Law.....
let us not only focus our attention to the implementer of the law - the Korean government ... let us also be reminded and take a look if the people send by the Philippine government to assist and protect us are really doing their part?
Again, the Law was clearly written, easily comprehended, artistically amended, but it was abusely implemented.....

sir ernie,
well commented on the part of Phil. Embassy's role particularly the POLO... i wish our current Labor Attache' or the Phil. Ambassador may have read this topic especially on your latest comments... so that they may evaluate their current program and purpose if it really provide what the migrant workers really needed...
let's say ms. welkyut was asking the help of the Phil. Embassy thru POLO? i'm not sure also how serious they can help her...
"buti nalang merong mga migrant centers and filipino communities in Korea who are always willing to help our distressed kababayans"

yes you can email me the copy of your petition... i will try to help you but don't expect too much lang din sa outcome kasi as you know, i am just a migrant worker also with limited time... but let me try to help you... i'll forward your petition sa isang migrant center at sa FEWA...
let's pray na sana may chance pa makuha ang unpaid salary mo...
God bless!

kabayan,
dapat meron ng nagreply sayo na representative from the ministry of labor to handle your petition... if wala until now, try to call NLCC @ 031-345-5000 and inform the status of your petition... give your petition receipt number... try mo lang... if wala pa ring action, then you better visit the labor office... we cannot really expect 100% immediate action from the labor because they are currently having problems/issues on their services... kulang po sila sa action in terms on implementation sa labor laws and assistance sa mga abused migrant workers...
another option is to ask help from any migrant center...
hope my answer would help... thank you...

Please be informed that we can now file our petition against our abusive Korean employers ONLINE with regards to labor related matters such as non-payment of wages and statutory allowances, improper payment of overtimes, and other employers' violations on the Labor Standards Act through e-People Service website. Please refer below for the details...< HOW TO FILE A PETITION ONLINE USING E-PEOPLE SERVICE >
1) Access homepage of e-People at http://www.epeople.go.kr and you can see the below screen.2) Download and fill-up the Petition Form provided by the Ministry of Labor and upload it in the e-People website. Please click HERE to download the Petition Form.
Note: There is also another form you can download at the e-People website but that form will only be used for non-labor related issues.
3) Fill-in all needed information completely as required in the blank fields.
4) Then, click SUBMIT.
Your petition will be processed as follows:
