A. Significance of EPS

Employment Permit System (EPS) is a system for Korean companies to hire foreign workers legally with the permission of the government (the Ministry of Labor) when they cannot find domestic workforce. As EPS helps making the foreign workforce management system transparent and rational, it reduces labor shortages of domestic companies and resolves problems of illegal recruit of foreign workers. The significance of EPS lies in the fact that it provides an opportunity to get rid of such problems.

B. Organization in charge of EPS and Support agencies

Foreign Workforce Policy Committee (FWPC, Chairman: Minister of the Office for Government Policy Coordination) is established under the Office of the Prime Minister and determines important issues annually such as: how many foreign workers are needed; which industries are in need of workers; and from which countries migrant workers should be imported after considering the supply and demand of the labor market. FWPC is composed of 20 members including Vice Ministers from Ministries of Finance and Economy, Justice, Commerce, Industry and Energy, and Labor as well as Small and Medium Business Administrator and other vice ministers. For preliminary deliberations on agendas to be submitted to the FWPC, Foreign Workforce Employment Committee (FWEC) is set up under the Ministry of Labor (MOL) with Vice Labor Minister as chair and members representing the government, employers, workers and public interest are participating in the FWEC. Foreign Workforce Employment Team under the Labor Ministry is in charge of tasks related to foreign workforce policy.

The actual operation of EPS is commissioned to Human Resources Development Service of Korea (HRD Korea) and other private organizations. However, all the works related to workforce-sending countries including cooperation with those countries and signing labor contracts for migrant workers are commissioned only to HRD Korea.

As ITS was combined into EPS in 2007, organizations used to be in charge of ITS such as Korea Federation of Small and Medium Business (KFSB), Construction Association of Korea (CAK), National Agricultural Cooperative Federation (NACF), and National Federation of Fisheries Cooperatives (NFFC) were designated as private organizations involved in EPS. These organizations carry out various tasks for employers such as providing convenience in hiring and managing foreign workers, employment education, and follow-up management of migrant workers after hiring them.

Until now, preliminary job education for migrant workers after they enter Korea has been conducted by HRD Korea and Korea International Labour Foundation (KOILAF). However, since July 1, 2007, ordinary preliminary job education carried out by HRD Korea has been transferred to private organizations such as KOILAF, KFSB, CAK, NACF, and NFFC. Since then, HRD Korea has been dedicated to the bigger task of the overall management of employment education for foreign workers and ethnic Koreans. The Korean Language Test for EPS is conducted by Korean Language Society, International Korean Language Foundation, and HRD Korea depending on countries.


C. Selection of Sending Countries

The Foreign Workforce Policy Committee (FWPC) determines sending countries of migrant workers after considering which countries Korean employers favor, how transparent and efficient workforce-sending procedures are in sending countries, whether migrant workers are willing to return to their home country or not, and if there is a probability for workers to leave their workplace without permission. Also, the Committee takes into account diplomatic relations between Korea and sending countries and the economic effect from hiring them. In the beginning of EPS, the FWPC selected eight countries at first and expanded the range for sending country steadily to fifteen countries as of August 2007.

Countries sending industrial trainees for ITS were all eighteen and most of them have been designated as EPS sending countries because of respect for employers' right to choose workers, diplomatic relations with the sending country, and changes in the status of migrant workers from industrial trainees to workers. This was to bring unification between EPS and ITS on the right track as smoothly as possible.


D. Decision on the Quota of Foreign Workers

When the FWPC decides the total number of foreign workers to be introduced and quotas for each type of business, the Committee makes sure that the introduction of foreign workforce will not encroach on jobs for domestic job seekers.

As shown in Table 1, the total introduction size of migrant workforce in 2007 is 109,600 including general foreign workers (49,600) and Koreans with a foreign nationality (60,000).

Among the 60,000 ethnic Koreans, who will enter Korea under Visit Employment System, about 30,000 have relatives or other connections in Korea and those without any connection will be about the rest 30,000.

F. Training and Medical Check-up for Foreign Workers

After signing a labor contract, foreign workers have to go through a program for job capacity development carried out by the labor-sending country and receive preliminary job training and medical check-up in Korea, which takes about 80 hours in total and are necessary for adaptation to Korean society.

As soon as they enter Korea, they are required to receive 20-hour employment education at government-designated foreign workforce training organization and go through a medical check-up again.


G. Employment Management of Foreign Workers

Under EPS, employment of foreign workers is allowed for three years to prevent them from staying permanently. Therefore, after three years, migrant workers need to return to their home country. However, those who leave Korea after working for three years can re-enter and work for another three years after six months from their departure. If employers want to continue to hire their workers after three-year visa period expires, those workers can re-enter Korea and work for three years more after one month from their departure.

For transparent employment management of foreign workforce such as wage, working hours and bonus, it is mandatory to use a standard labor contract.

As a measure to guarantee foreign workers' retirement allowance, employer must purchase a departure guarantee insurance and trust, which is to ease the burden of employers to pay retirement allowances to all migrant workers at the same time. Also, the insurance and trust is to guarantee workers' returning to their own countries after legal staying period expires.

Foreign workers need to purchase a return cost insurance and an accident insurance for the expense needed to return to their home countries and for accident and diseases unrelated to work.

Entering Korea, foreign workers are required to be registered as a foreigner at immigration office in their staying area or its branch office within 90 days of their entrance. They should start working at workplace of the employer with whom they signed a labor contract before they entered Korea. However, if there is a proper reason that they cannot work at the enterprise they signed before entrance, those workers can change their workplace with help from a job center. For Koreans with a foreign nationality, they can change workplace by just reporting it. Employers hiring foreign workers illegally are prohibited for three years from employing migrant workers.


H. Protection of Migrant Workers

Foreign workers under EPS are treated equally as domestic workers and can be protected by labor laws such as Labor Standards Act, Minimum Wage Act, Industrial Safety and Health Act and their basic labor rights are guaranteed. Also, discrimination against them is forbidden. When their employer violates the labor contract and lay them off unfairly, they can bring the case to the Labor Relations Commission, National Human Rights Commission, and a court for salvage.

For social insurances, Industrial Accident Compensation and National Health Insurances are mandatory and Employment Insurance can be bought when foreign workers want. As for National Pension, a principle of reciprocity is applied.
