GOOD DAY!

I JUST ARRIVED HERE 2 WEEKS AGO UNDER THE RE-CONTRACT SCHEME.

I ALREADY HAVE THE ALIEN CARD AND I PROCESS IT WITH MYSELF. STILL I AM WORKING HERE
IN OUR COMPANY.

I WAS NOT YET REPORTED BY MY EMPLOYER IN THE KOREA LABOR OFFICE AND HAVE NOT YET SIGNED
THE CONTRACT.

I AM PLANNING TO WORK IN ANOTHER COMPANY.

DO I HAVE TO CHOICE TO GO TO THE LABOR AND ASK FOR MY RELEASE? OR THUS MY EMPLOYER NEED
TO SIGNED THE RELEASE PAPER SINCE I AM NOT YET REPORTED IN THE LABOR ?

clarification lang... i guess you have signed a working contract already before na-iprocess ang rehire mo because that's one of the basic requirements in rehiring an EPS worker...

ano ba ang reason why lilipat ka sa ibang company? may mga violations ba ang employer mo sa right mo as a worker?

if pagpaparelease ka, you should go to the labor office after you ask permission from your employer...

if meron violations ang employer mo like delayed or unpaid salary, non-payment of NPS Insurance and Departture Guanrantee Insurance, and others pwede na dumiritso kayo sa labor office without asking permisison sa amo mo...

Sir dj,asko ko lng po kung valid reason ung reduction of salary na 100k won.Last 2008 ns 1,050,000 won ang salary nmin ng ksamahan ko(840,000+210,000 na bigay ng sa jang nim nmin)& this year start ng february naging 950,000 won n lng.Deduction of 80k won ay nsa 870k won ang sinasahod namin.The reason was due to economic crisis.Bihirang bihira kung mag pa OT.Day shift ang sked nmin.D alam ng sa jang nim kung kelan kmi increasan.Is this a valid reason?

clarification lang, yung 970K won na salary ninyo ilang oras po ba ang OT ninyo dyan? and yung 80K won na deduction, para saan yun? may payslip po ba kayo?

ganito kasi ang computation...

1) under 40-hrs workweek system (for company with 20 or more regular workers):
-> basic salary (Mon~Fri work only at 8-hrs = 209 hrs) = 209 x 4K won = 836K won
-> overtimes = number of OT hrs x 6K won

2) under 44-hrs workweek system (for company with less than 20 regular workers):
-> basic salary (Mon~Fri work at 8-hrs plus Sat. at 4-hrs = 226 hrs) = 226 x 4K won = 904K won
-> overtimes = number of OT hrs x 6K won

following the formula above, you can confirm if tama ba o hindi ang sahod na binigay ng amo ninyo... you should compute according to the number of actual working hours rendered...

if hindi po tama, hindi po pwede yan... hindi po pwede magdeduct ang isang employer ng sahod natin due to global crisis... except lang kung wala rin kayong work...

may work po ba kayo ng Saturday? if wala po, eh over minimum wage na pala salary nyo... wala palang problema?

kung magpaparelease kayo dahil naghahanap kayo ng OT, be sure na may malipatan na kayong company na may OT talaga bago po kayo magpaparelease kasi sa totoo lang mahirap po maghanap ng work ngayon... halos lahat na companies ngayon ay hirap talaga dahil sa ongoing global crisis... huwag naman sana, baka yung pera nyo ngayon maging bato pa yan in the future if magpaparelease po kayo...

don't just think twice but many times po kabayan before making any moves...

Clarify ko lng po... based on my experience if rehired ka pagdating mo d2 sa korea need pa rin na pumunta ng sajang mo sa labor to report your reemployment /arrival and need to do a new contract based on the date of your arrival/day of work>>

Ni released ako ng amo ko kaso nun nsa labor na kmi tinawagan sya ng staff sa labor na di me puede ma released kc di pa ako na report sa labor (1 month mahigit na me nkabalik d2). need pa ma report and do new contract prior to your arrival here;

Please pag nag post po kau ng reply sa mga questions nmin pki check nu po muna maiigi kasi it cause trouble sa amin because sometimes we are relying on your answers (admin). tnx

yung sinabi mong dapat magreport ang employer na nagrerehire sa inyo at the Labor Office (Job Center) within 10-days from your arrival date in Korea... yun naman ang nasa post ko di ba? baka di mo lang naintindihan ang statement na nakalagay sa post ko... gusto mo nang proof sa post ko? yung post ko galing po yan sa Ministry of Labor... hindi ko po sariling idea ang mga sagot ko... nagreresearch po ako para sa tamang kasagutan sa mga tanong dito sa SULYAPINOY website... palagi po akong tumatawag sa Labor Office para i-confirm yung question dito na hindi me sigurado if tama yung mga isasagot ko...

gusto mo nang proof kung galing ba talaga sa Ministry of Labor ang sagot ko especially about the Reemployment Procedure? PLEASE CLICK HERE

kung ikaw ay nirelease after you arrived in Korea and find for another employer, yung ang dapat magsign-up ng new contract kasi nga nasa new employer kana magtratrabaho...

boss dj gud day po, ask ko lng kung required ba ang signature ng sajang sa release paper na galing sa labor? kasi gusto kong magparelease after expiration of my 1 year contract at nagpaalam ako sa boss ko, nakabalik nako ito na yung 4year ko. pero ayaw pumayag ng sajang ko hindi daw sya pipirma. at tinatakot nya ko na pauuwiin sa pinas pag nagpilit akong magpalipat. Is there anything I can do about it. Gusto ko palipat kasi masakit itong hip ko sa kabubuhat nang mabigat sa trabaho. thanks.

Kabayang Jeedjohn... opo kailangan ang pirma ng sajangnim mo sa iyong release paper...regarding nmn sa pagpapauwi ng amo mo di ka nila pwede pauwiin..pagkatapos ng 1yr contract at ayaw mo na pumirma panibagong kontrata ay nasa inyo na po yan kung ayaw nyo na di ka pde pilitin ng iyong employer...pag ayaw ka bigyan ng release paper pde ka na dumerecho sa pinaka malapit na labor center na syang may sakop sa lugar nyo at sila ang mag re release sa inyo as long as natapos mo ang 1 yr mo sa company nyo...salamat

sir bossing marzy,

matatapos na ang 2 year's ko dito s factory namin ayaw ko na pumirma ng panibagong contract (pero kung ibigay yong 1.25M 44hour's/week pirma ako ulit) nagpaalam na ako sa sajang ko pumayag naman sya. ask ko lang kasi ang nakalagay sa ARC ko ay NOV. 16, 2009 bale balak ko kasi mag work ako on that date then kinabukasan saka ako punta ng LABOR NOV. 17, 2009. ok lang ba yon??? di ba tnt NA LABAS KO kasi expired na ang ARC ko???

kabayan di po kayo llbas na tnt....dapat po pagkaend contract nyo ay sa pinakamalapit na imigration center kyo pupunta..para makakuha ng 2months na extension ng visa...habang naghahanap ka ng bagong kumpanya na malilipatan...kailangan mo yan...pag di mo ginawa yan ..tiyak ko sayo magiging tnt ka..he he..try ka hanap ng mga car accesories na kumpanya kc mas bz ngayon ang carparts,,,sensya na ako ang sumagot....ingat kbyan

take note sir ang basihan nyo ay ung nakatatak sa alien card nyo,hindi po ung papel na hawak nyo galing sa company

gudpm po.pwede nyo po b akong mtulungan sa problem nmin sa company nmin...18 po kming filifino eps workers s company nmin,tpos may vietnam eps din.e2 po ang problema kasi po ang computation nila ng shod nmin is...MON-FRI 7hrs lng daw ang working hour nmin tpos ung SAT 4hrs nga...start kmi ng work daily ng 9am-17:25pm MON-FRI,tpos ang SAT 9am-13:25pm.pero ang basic nmin is 836won lng.mga kabayan tama b tlg ang computation ng basic nmin?tnx and more power.

kabayang marianne kung mahigit 20 kayong empleyado jan sa inyong kumpanya ganito po dapat ang inyong monthly basic salary...(wala pong pasok ng saturday, pag pumasok o.t na po)

1) under 40-hrs workweek system (for company with 20 or more regular workers):
-> basic salary (Mon~Fri work only at 8-hrs = 209 hrs) = 209 x 4K won = 836K won
-> overtimes = number of OT hrs x 6K won

at kung 19 pababa naman ang bilang ng empleyado ay eto ang buwanang sahod....

2) under 44-hrs workweek system (for company with less than 20 regular workers):
-> basic salary (Mon~Fri work at 8-hrs plus Sat. at 4-hrs = 226 hrs) = 226 x 4K won = 904K won
-> overtimes = number of OT hrs x 6K won

kabayang suzuki...txt moko or call ka sakin kapag may releas paper ka na...baka sakali may open dito na work sa oras na marelis ka...dito ksi samin pagmayopen ay sinasabi sa kapwa pilipino...maganda ngayon dito kasi malakas ang mga ot namin ngayon..kahit linggo ay may pasok....kaya wala na ring pahinga...pero maganda naman ang sahod..

wala pong anuman ,,,ngayon palang magtanong na ko sa mga kasamahan ko dito,,ano b present na work mo..usually kc dito ay bakalan...cnc o kaya ay welding at grinding ang mga available jobs dito...para may idea ako...just txt me ...pag may relis kn .....

sa immigration u muna unahin mo pde ka nmn magparenew ng alien card khit wla ka pa amo bsta b4 ng expiry date dun sa alien card kz kapag lumamapas ka khit one day lng mrn ka penalty 100,000 won den saka u nlng isunod ung sa reles mo... bounce
