Hi

What will happen to an EPS worker got pregnant while still in contract? She is still single and the father is a fellow EPS. What will be the status of the baby? will POEA or Korean labor deport the the worker?

Pls any idea.

What will happen to an EPS worker got pregnant while still in contract? She is still single and the father is a fellow EPS. What will be the status of the baby? will POEA or Korean labor deport the the worker?

Actually wala pong nakasaad sa EPS MOU, Foreign Workers Employment Act, and Korea Labor Standard Act na pwede i-deport ang isang EPS worker who got pregnant while she's regularly working in Korea...

Foreign workers has the same rights with Koreans such as availing maternity leave and others...

But in my opinion, we have also to consider sa mga posibleng maging problema...
1) if a worker gets pregnant and it is quite heavy or difficult for her to do her current job in contract, maaari pong magdecide ang employer na i-release siya after giving her a 1-month notice.
2) if ma-release po siya and siyempre mahihirapan siyang maghanap ng ibang employer kasi nga buntis siya and considering the 2-months limit period of release in order to get new employer, the situation may lead her to be deported or with no choice maging TNT nalang if hindi po siya makakita ng new employer within 2-months period...

Opinion ko lang po yan kabayan to give you an idea sa mga posibleng mangyayari...

But contrary to my opnion, meron din me 2-friends na nabuntis dito sa Korea... they were lucky because yung work nila ay "visual inspection" lang so walang problema sa health nila at kaya din nila ang work kahit pregnant...

Yung isa dito na nanganak at pinadala nalang nya ang baby niya sa Pinas... yung isa naman, nagkataon na i-rerehire siya so nag-advance nalang siyang umuwi ng Pinas at dun na siya nanganak din bumalik dito after 2-months...

hi princetriple...i hav my opinion..pd xa pumunta sa labor hingi ng maternity leave.or.kung nrelease xa amo nya ok lang w8 nya lang,,,pg malapit na matapos rles nya balik xa uli sa labor pd xa hingi 2mos uli...ganyan po nangyari sa esmi ko

thanks for the info. Actually im in the Phils now my wife is an EPS worker. Is there a way i can communicate thru email to any FEWA counselors or officers. I have personal inquiries regarding this matter. thanks for the help.

eps po ako,last yr po ako nanganak,,ganito gawin nya,punta sya s labor ask sya maternity leave magdala sya medical record ng pregnancy check up nya from her doctor para malaman ng labor officer kung ilang months na ang tyan nya kasi doon ibabase ang maternity leave na ibibigay ng labor sa kanya,,then may 1 month leave pang ibibigay s kanya after nyang manganak,,yung bata legal to stay in korea until finish ng maternity leave nya...yon lang po ang experience ko..just wanna share,,,hope it could help

di ba bibigyan yung nanay ng maternity leave tapos lagpas ng leave nya pero di pa nakauwi ang baby magbabayad sya ng 50 won kung ibang tao ang mag uwi ng bb sa pinas pero pag sya ang mag uwi walang bayad,,,kung ibang tao ang mag uwi ng baby magbigay sya ng copy ng alien card nya doon s mag uwi para ipakita sa immigration officer s airport

sa kaso ko kumuha ako ng certificate of live birth sa philippine embassy sa eataewon,katunayan na dito sya pinanganak then yung certificate na binigay ng embassy yan ang ipakita mo sa NSO sa pinas after 6 months nga lang bago ma register sad to say matagal talaga mag process ang government natin...kung legally married kayo dalhin mo marriage contract nyo pagpunta ng embassy para naka apelyido na s tatay ang baby

ok. so ok lang pala paglagpas sa maternity leave di pa mauwi ang bata sa pinas wlang penalty pag ina ang magdala. paano yan sa registro sa NSO automatic ba?

ah ok bagal talaga pinas. yung hospital san ka nag anak may katibayan din ba sila ibigay sa yo para naman sa embassy natin?
