Merry X'mas kabayan!! tanong ko lang po sana if may penalty po ba sa part ng employee o employer pag nahuli ng Immigration na nag a- "AROBYTE" sa ibang kumpanya...mabuhay po kayo! santa

hello kabayan,
ayon po sa one of the provisions of EPS labor policy (please refer below)...


Except cases where a migrant worker from outside of Korea is not able to continue his/her work at a workplace due to reasons not attributable to worker himself/herself, the current Employment Permit System does not allow a transfer between industries. However, change of workplaces may be granted only in cases when the employer intends to terminate an employment contract by the employer based on justifiable grounds during the duration of the relevant employment contract or to refuse to renew expired employment contract, or cases of suspension or discontinuance of business, violations of labor related laws by the employer and other reasons not attributable to the worker preventing continuous service by such worker at the workplace.

If we try to analyse this provision, it is clear na hindi po talaga pwede magwork ng ibang company if an EPS worker is still legally connected or employed with his current employer...

Pero sa panahon ngayon na marami talagang mga companies ang nag-temporary shutdown, baka may considerations ang Labor Office at payagan ang isang EPS worker to work part-time in other companies during the temporary shutdown period...

I suggest you better visit Regional Labor Office (Job Center) and ask confirmation or an approval first... baka pwede sila magbigay ng approval with authorization letter na mag part-time kayo sa ibang company...

I will also visit Regional Office in our area to ask about this matter and will get you back here soon...
