Contract Violation: Changed of employer after arriving Korea
Kabayan,
There have been reports that some of our fellow OFWs under EPS category have experienced contract violation such as changed of employer or company name. The name of the employer or company reflected on the signed labor contract was totally different to the actual employer or company whom an EPS worker is working with after arriving South Korea.
If you experienced such contract violation or knew somebody who have experienced the same, please give us your/their contact numbers or please reply to this post.
We need to gather enough evidence that this issue is really happening in current EPS system and forward to the Philippine Embassy thru POLO to negotiate with the Korea Ministry of Labor (MOL) for an immediate action/solution.
We would appreciate if you could give us immediate information because POLO is set to discuss the EPS-MOU next week with Korean government thru MOL.
Your help is highly appreciated.

actually, meron na pong batas ang Korea (Labor Standard Act and Foreign Employment Act) which prohibits this kind of violation... hindi po pwede na basta nalang tayo i-release or i-dismiss ng employer natin without justifiable reasons... if meron man sa ating mga kababayan na nakaexperienced ng ganito sana that time hindi nila tinanggap o pumirma ng release paper at nagreklamo sila agad sa labor office.
if sa tingin ninyo na hindi talaga justifiable ang reasons ng employer na i-release kayo don't be afraid to fight your rights... our signed labor contract is enough proof if magsampa tayo ng reklamo sa labor office...

actually maraming case na ganyan.Meron kasing mga employer na hindi na makakuha ng tao kya ibang company name ang ginamit but then ung company na un di na nag-eexist pagdating dito irerelease sila ska ipasok sa company nila ung iba naman hindi na,so in that case kawawa naman tayong mga EPS na naghirap pumila sa POEA,nagtiyaga mag-aral ng salita nila,nagsikap ipasa ang exam,naghintay at nangutang pa para makapunta dito tapos pagdating sa korea hahabulin pala tayo ng immigration,unfair db?sana MOL should give appropriate actions for these,para ung mga employer na ganito,magtanda at matuto na at ng di na pamaresan pa ng iba!!
so ask q lng kung anu ung kelangan beside from contract copy kc I have friend na ganito situation before.

please give me the names, current location, and contact numbers sa iba pang mga nakilala or alam ninyo na naka-experienced ng ganito... POLO needs more proof para ma-ipresent nila sa Ministry of Labor during their renegotiation sa EPS MOU...
please provide as soon as possible habang hindi napirmahan ang MOU which is expected to be finalized January next year...

humina po yung unang kompanyang pinagtatrabahoan ko noon, nirelease ako at inilipat sa ibang kompanya. kaso ang problema ko ngayon, ang kompanyang kinabagsakan ko ay meron palang problema sa labor at hanggang sa ngyon wala pa akong kontratang napipirmahan dito, laging pangako lang ang naririnig kong sagot sa tuwing tinatanong ko tungkol sa kontrata. at doon din sa una kong kompanya wala naman akong pinirmahan na release papers man lang.

meron ka bang alien card ngayon? if meron kang updated alien card based on your current company name, wala po kayong problema sa immigration... but if yung alien card mo ay hindi updated (what i mean is yun pa rin sa dati mong employer) i can say na naging illegal worker ka na ngayon...
in that case wala tayong magagawa dyan... dapat noon pa, umalis ka na dyan noong time na hindi pa nag-expire ang release period mo...

Sir, magtatanong lang po kasi yung sajang namin binago yung sahod namin from basic to 42,000 won/day with 3 hrs. ot napo yan kasi sabi niya kailangan daw bawasan sahod namin kasi mahina.kaso normal lang naman ang takbo ng company namin...diba po nasa article 23 (reduce of wages) yung kaso namin? ang masakit pa don may kasama kami na tinaasan ang sahod nya eh pareho lang naman ang trabaho namin.pls need ur help tnx

tama po kayo. hindi po pwede bawasan ang sahod natin especially if it is below the minimum wage. please refer below for salary/day details...
-> Regular Working Hours (8-hrs): 8hrs x 4,000won/hr = 32,000won
-> Overtime (Ex. 3 hrs): 3hrs x 6,000won/hr = 18,000won
So, your total salary per day considering 3-hrs OT must be 50,000won using 2009 New Minimum Wage.

pede po kaya ireklamo sa labor office yung tungkol sa kinakaltas n maintanance sa amin kc po almost 3 and a half year n kmi kinakaltasan ng bayad sa gas at kuryente pero sa kontrata naman po eh nakalagay eh employer ang magbbyad. pede ko pa po ba yung ireklamo khit nkalipas n yung 3 taon. thanks

are you sure na specific talaga nakalagay dun sa contract nyo na shoulder ng employer ang accomodation nyo including gas & kuryente? nagreklamo naba kayo sa employer nyo? siguraduhin nyo muna kung nakalagay ba talaga dun...

yung trabaho nyo sa ibang company related ba sa product ng original company nyo na nagregister sa inyo? may mga Korean ba kayong kasama dyan?
May mga cases kasi na yung company ay sub-supplier ng isang company tapos may agreement sila na dun nalang magtrabaho ang ibang workers ng sub-supplier sa company na sinusuplayan nila to save transportation time and for effective quality monitoring... in that case okay lang yan... but if ang trabaho nyo dyan ay hindi related sa product ng totoong company ninyo and most especially hindi sub-supplier ng tinatrabahuan ninyo, delikado po yan kasi "아르바이트" ang status nyo dyan which is a violation to immigration law... in that case pwede kayo huhulihin ng immigration...
yung trabaho nyo sa ibang company related ba sa product ng original company nyo na nagregister sa inyo? may mga Korean ba kayong kasama dyan?
May mga cases kasi na yung company ay sub-supplier ng isang company tapos may agreement sila na dun nalang magtrabaho ang ibang workers ng sub-supplier sa company na sinusuplayan nila to save transportation time and for effective quality monitoring... in that case okay lang yan... but if ang trabaho nyo dyan ay hindi related sa product ng totoong company ninyo and most especially hindi sub-supplier ng tinatrabahuan ninyo, delikado po yan kasi "아르바이트" ang status nyo dyan which is a violation to immigration law... in that case pwede kayo huhulihin ng immigration...

if yung tinatrabaho nyo na products ay owned pa rin ng campany na naka register sa inyo but dyan lang kayo nagwork sa customer company na sinusuplayan ng company ninyo wala pong problema yan... you're still under the management of your original company... so hindi po "아르바이트" ang status ninyo...

matatanong lang po ano po yung SA JIK SO? kc pena paperma kc kmi nyan. ang pagkaka alam ko kc ang companya namin pinalitan sajang. bali 5 ang companya namin sa isang companya lang kami ng trabahu corporation kc bwat companya iba ibang sajang. cnabihan kami na mahina na daw ang companya namin wala na daw kaming pasok sa buwan nato march pero bigyan daw kmi ng 100 000 para sa break fast at dinner din sa april daw wala ng 100 000 may tendecy daw na sa MAY na kami maka pagtrabahu kaso hindi raw lahat pipili lang daw cla ng 4 ek ang problema 11 kami. din mag isang taon na kmi noong feb 27 pero sa alien card namin march11 pa so malapit na mag expired ang alien card namin trnsfer lang po kc kmi sa companya to. hihinge lang po ako ng payo kung ano ang dapat gawin.
