ANNOUNCEMENT !!!
The National Assembly of Korea approved on 16 September 2009 the FIVE (5) years sojourn period of EPS workers, amending for the purpose the Act on Foreign Workers Employment. The new law is expected to be published in the Official Gazette around third week of October 2009 and will take effect two months thereafter or around third week of December 2009.

Under the old rule, EPS workers are granted three years sojourn period. If he is re-employed by his last employer, he has to leave Korea first and come back after about one month. He is given another three years on his second sojourn period.

According to the Foreign Workforce Policy Division of the Korea Ministry of Labor (MOL), the new law, upon its entry into force, would grant a period of stay according to the status of the worker, as follows:

1. Newly hired workers - Three years. If the worker is re-employed by his employer, plus 1 YEAR AND 10 MONTHS without need to leave Korea.

2. Workers in Korea who are in their first (three year) sojourn period – If the worker is re-employed by his employer, plus less (1 year and 10 months) without need to exit Korea. However, if the employer files the application for re-employment not later than 09 December 2009 and within the prescribed period (30 to 90 days before the end of sojourn), plus three years, but must leave and re-enter Korea.

3. (Re-employed) workers in Korea who are in their second sojourn period – the remaining portion of their three year sojourn period.


We shall furnish you a copy of the official English translation of the new law as soon as the same becomes available.

long as it does not exceed the three-year employment
period.

○ In addition, the qualifications, etc., of workers newly
imported will be assessed so that employers can employ
foreign workers suitable for their business.
- If it is necessary for assessing their qualifications, etc.,
direct interviews with job seekers will be conducted and
the results will be recorded in the roster of job seekers.

○ Along with this, various stronger support will be provided
for foreign workers.
- If foreign workers cannot work for reasons not
attributable to their faults, such as industrial accidents or
diseases, the two-month job-seeking period permitted for
a change of workplaces will be put off until after such
reasons no longer exist.

□ “The improvements to the Employment Permit System made
this time are expected to allow employers to secure a
necessary level of foreign workers and employ them in a
stable manner, and enhance foreign workers' adaptability to
employment in Korea,” said Lee Jae-gap, the director-general
of the Employment Policy Bureau.

bale ibig po ba sabihin yung mga hindi pa nakatapos ng 3 years pwede ng diretso 5 years ang stay nila dito bago mag exit?or ung mga re-entry ay 5 years na ang stay?kasi re-entry na po ako .

Ayon po sa Min. of Labor lahat na re-hired ay hindi maapektuhan sa REVISED BILL ( 5 YRS. PERIOD OF SOJOURN) ibig sabihin 3 yrs. + 3 yrs= 6 yrs lahat.

Maaring ung maabutan sa implementation sa REVISED BILL ay 5 yrs. straight nlng cla.

Kabayan Jane,

Ang totoo wala pong good news sa REVISED BILL na ito bakit?
Kasi po 5 yrs. na lng ang period of sojourn ng mga maabutan sa implementation (lugi sila ng 1 yr.) at sa mga na re-hired walang plus 2yrs. ulit kundi tapusin nlng ang 3 yrs.no more --no less.

That means no additional 2 years sa mga na re-hired? Sir dave clarify this issue before regarding 3+2 years sojourn period whether your a first time working in korea as EPS.Many of us expecting the good news.

Kung ma re-hire ka pwede ka pa makauwi kc hindi pa nman na implement ang Revised Bill na ito.
Cguraduhin mo lng kompleto ka sa papers bago ka umuwi at cgurdo ma -rehire ka.

You're absolutely correct, IF YOU ARE REHIRED, NO MORE ADDITIONAL 2 YRS.( 3YRS.+3YRS = 6 yrs all in all)
I just want to clarify that there was no 3yrs. + 2 yrs. period of sojourn but 3yrs.+ 3 yrs. only.

Actually, this is not a good news for us.

Kabayan,

Bago po ipatupad ang bagong REVISED BILL, ganito po : pag na received na ng Ministry of Labor ang bill na ito from the National Assembly , publish pa nila ito sa major newspapers, websites etc for two months bago ma implement ang REVISED BILL.
It might be implemented this coming December or early next yr. it depends on the Ministry of Labor.
Take note, i'm using the words"IT MIGHT BE" meaning not sure(Nobody knows)

maraming salamat po sir reeve for the info...sa iba po na EPS, ask the nearest Labor office in ur area, kung saan nasasakop po ng Labor, doon po pwede magtanong, as of now here in our area, wala pa po iyong katunayan na 5 years na nga ang new soujorn,,,sana po wag malito ang ibang kababayan....salamat po...

sir gud pm po ask ko lang kasi yung pinsan ko nagtatanong sa akin kung kailan magkakaroon ng KLT exam sa poea sa pinas dati rin syang eps kaya lang di sya nakakakuha re entry kasi nag pa release sya sa unang employer nya ask nya rin kung wala bang problem dun kung gusto nyang bumalik sa korea nag on line registration na nga sya sa website ng poea.o pwede na rin ba syang hindi mag exam asi dati na syang eps.sana po masagot nyo ang tanong na ito.salamat godbless po.

gawa na sana po yung amo namin ng reentry visa ko po pero sabi daw ng labor e no extension na raw pati lahat ng companies then napalitan na raw ng patakaran patapos na 3 years contract ko this october 30. is it possible?

Kabayan Bench,

Ang bagong REVISED BILL ay APPROVED na BUT HINDI PA NA IMPLEMENT.
Ibig po sabihin STATUS QUO po tayo, hanggang ito ay ma implement bago pa magbabago ang mga patakaran.

Let us wait for the official announcement of the Ministry of Labor(MOL) for the details.
Please give me the name, location and tel. # of the Labor center( Job Center) where your employer applied for your extension?

d2 po ako sa namyangju city....malaki po ang company namen....pagawaan ng refrigerator....malapit na pong matapos ang visa ko by next year feb. eh paano po yun kahit d na po ako umuwi ok lang po ba???? eh kasi baka pag umuwi ako hindi na ako bigyan ng visa tulad nung kasamahan ko sa work na nagbakasyon hindi na nakabalik???? kahit po ba sabihin ng sajang ko na umuwi ako????....kahit ayaw ko pwedi po ba??? maraming salamt po in advance sa magrereply...........godbless sulyap pinoy!!!!!

Kabayan Punk,

Kung ma implement na ang REVISED BILL wala ng uwian diritcho na hangang matapos ang sojourn mo.
Kung ayaw mo umuwi hindi ka naman mapilit ng sajang mo basta hindi pa tapos sojourn mo.

Ang kasama mo nagbakasyon lng ba tlga sya bkt naman di sya nkabalik?
Bka naman hindi sya na re-hire.

The National Assembly of Korea approved on 16 September 2009 the FIVE (5) years sojourn period of EPS workers, amending for the purpose the Act on Foreign Workers Employment. The new law is expected to be published in the Official Gazette around third week of October 2009 and will take effect two months thereafter or around third week of December 2009.

Under the old rule, EPS workers are granted three years sojourn period. If he is re-employed by his last employer, he has to leave Korea first and come back after about one month. He is given another three years on his second sojourn period.

According to the Foreign Workforce Policy Division of the Korea Ministry of Labor (MOL), the new law, upon its entry into force, would grant a period of stay according to the status of the worker, as follows:

1. Newly hired workers – Five years WITHOUT need to leave Korea.

2. Workers in Korea who are in their first (three year) sojourn period – Plus Two years after the end of three years WITHOUT need to exit Korea, or a total of Five years.

3. (Re-employed) workers in Korea who are in their second sojourn period – the remaining portion of their three year sojourn period.

We shall furnish you a copy of the official English translation of the new law as soon as the same becomes available.

Does this mean that we can't take vacation after our first 3yrs here in korea. what about the NPS contribution? can we claim it when we exit for a vacation(if still allowed) after the first 3yrs sojourn period?

That's according to the new REVISED BILL( Straight 5 yrs.)
NPS contribution? Continue your monthly contribution.
NPS contribution can only be claimed after finishing your contract/final exit.

sir pagbanaka 5 years ka na straight may possibility pa ba na makabalik ka sa korea..like reentry ..kasi may mga naririnig ako na ganitong option.hanggat gusto ka ng employer mo..pwede ka makabalik ulit..para na rin po sa kaalaman ng lahat...tnx and more power sa sulyapinoy

hi kabayan jrtorres, after ur contacy of 6 years, pwede ka bumalik in two options po. 1) weyt agen 6 months in philippines and re aply in poea for work in korea, 2) after ur contract for 6 years, pwde ka po i rehire ulit ng boss nyo pero not as E-9 visa ( non professional employment) to E-7 ( specically designated activities)...basta lamang po ok ang records nyo sa work pwede po mag ask ang boss ninyo sa immigration for this knd of visa but meron pa po interview eto, kya be honest lang po when ur in imigration ofis.. for more details plis refer to "immigration contro act"..salamat po...

nagfile ng amo ko ng reentry visa ko sa immigration but nung sinend ang fax ang bumalik ay OMMISSION.
ang mali ng amo ko e dapat 1 month before end ng visa ko dapat nakafile na ginawa lang nya pagkatapos ng chusok. ang mahirap pa dito parang denied na ko for reentry visa. matatapos po ang contract ko this coming october 30.

hello kabayang airlinehunk24 maraming salamat sa pg share mo sa mga option kung sakaling gusto pang bumalik sa korea.

my tanong lng ako don sa 2nd option na pagpalit ng visa from E9 to E7, kc ang pagkakaalam ko e ang E7 ay pang professional visa na ngwowork dito sa korea, possible b ung ganon kc from non-professional visa n dati mong gamit e iaapply k ng boss mo (just in case n gusto k irenew ulit) ng professional E7 visa. bka mgkaproblema sa interview sa immigration pg ganon dahil mgtatanong sila kung ano ang nature nang work at kailangan kang iapply ng E7. thanks Smile

Meron kasi akong 15 EPS E9 holder dito na matatapos na 6yrs eh baka pwede rin sila kung totoo yan

kabayan..sa 2nd week of december ay implemented na ang bagong batas..possible na 15 days na lang ang maging bakasyon mo kc 5 years na nga ang visa mo at di na kailangan ang mandatory na 1 month exit..pero nasa sajang mo parin ang desisiyon kung halimbawa man na gusto mo ng mahabang bakasyon...hope makatulong ang munti kong paliwanag

hello kabayang emart, yeap it is possible to change the visa stat from E9 to E7,, but cguraduhin po nila na they have gud records at work sa company nila, kc ung boss lng ang pwedeng mag aply for E7 nd also di na pwede mag palipat in case na makakbalik sila as e7....meron din po etong interview eto sa embassy...salamat po

kabayang egysher,,,,nagkamali ako ng type..di mo ba nabasa yung pangalawa kong message....sabi ko ay kung sa december ay implemented na...bakasyon lang ang mahihingi mo....pero sa ngayon ...wala pa exact date...kaya posible na abutin ka pa ng dating batas..so 3 plus 3 ka parin
....mas maganda nga na makauwi ka.para makuha mo agad ang tegicom mo at gukmin... ingat bro...godbless
