INFORMATION ON FINES, ENTRY BAN AND PROCEDURE FOR THOSE DISCOVERED INVOLUNTARILY

1. Illegal stayers detected by immigration officers are subject to fines:
· Those who stayed illegally for less than one (1) year are exempted from fines;
· KRW 500,000 won for illegal stay of one (1) year to two (2) years (excl.);
· KRW 1 Million won for two (2) years to three (3) years (excl.);
· KRW 1.5 Million won for three (3) years to five (5) years (excl.);
· KRW 2 Million won for five (5) years or over.

There is no commutation of detention to penalties for those who are incapable of paying fines. Instead, illegal stayers will be deported after undergoing a prescribed process and will be banned re-entry for a certain period of time.

2. The period of entry ban for the deported illegal stayers:
· Three (3) years for those who paid fines before being deported;
· Five (5) years for those who failed to pay fines before being deported.

3. The detected illegal stayers will be deported following the procedures below:
1. An illegal stayer is arrested,
2. Will be investigated for illegal stay,
3. Will be detained (upon issuance of detention order),
4. Decision will be made after examination (possible decisions include imposition of fines and issuance of deportation order),
5. Will prepare for departure (issue a passport and buy tickets, etc.),
6. Will be deported.

sir kelly,tnx sa info mo! my katanungan lng po aq, ibig sabihin po ba? 7klt passer po.pero dati aq nag tnt dyn sa korea 1998 to 2004 six yirs na aq d2 sa pinas d po kya magkaprobkema ang apply q? na ipass q na din po lahat ng recq.sa POEA w8 na lng po ng call for pidos

ur welcome popoy26, about ur case im not sure kung nabura na talaga ang record mo d2, tnx for being honest. ang sure lng e may mga na A to A dahil nakita nga na may record cla ng illegal stay d2 sa korea bale 8 ung na A to A last month according to Phil Embassy in Seoul. pero hindi kita tinatakot syempre gus2 din nmin n mkrating uli kau lahat d2 sa korea to have a decent job that can support ur family. ang alam ko lang after 5 yrs DAW burado na ang record ng illegal stay but its hard to confirm kung totoo nga ito coz wala nmng nakaka alam talaga sa sistema ng Korean Labor regarding this issue. mas mabuti pa cguro tumawag ka na lng anonimously sa POEA then ask mo itong question na ito, maybe they can give you a more informative answer. nawa po ay makarating kau d2 sa korea at sa lahat ng nag nanais bumalik at pumunta d2. gabayan po tayo ng ating mahabaging Diyos. PS. pinaka importante po na wag nating kalilimutang mag PRAY. ang hindi po kaya ng TAO ay kayang-kaya ng ating DIYOS.

nkalimutan q sabihin sa inyo sir kelly na d poh aq nahuli. nagsurrender po aq ng umuwi ng dec.03,2004,pareho lng po ba na my record sa immigration ang nagsurrender bago umuwi at ang nahuli na napauwi?
