QUESTION: I quitted my work after working for 1 and 1/2 year. How can I calculate my retirement allowance ( Toe Jik Guem) ?


ANSWER: Severance Pay / Retirement Allowance ( Toe Jik Guem)- is paid in the amount of average wages of 30 days for working period of 1 year. Therefore, you can be paid with an average wages for 45 days. 30 days for 1 year and 15 days for 6 months. To calculate the exact retirement allowance, you should know the exact average wages. Average wage is calculated the ( total amount of wages for 3 months prior to retirement divided by total days for 3 months)


EXAMPLE: Juan dela Cruz worked in a company from January 1, 2006 to June 30, 2007 . He was paid as follows: 1,000,000 won in April, 1,100,000 won in May and 1,200,000 won in June.

Average wages
- [ 1,000,000 won in April + 1,100,000 won in May + 1,200,000 in June ] / [30 days( April) + 31 days( May) + 30 days( June)] = 36,264 won


Severance Pay/ Retirement Allowance - 36,264 won x 45 days = 1,631,880 won - (Juan received 1,631,880 won )

Ang pagkakaalam ko babawasan pa ng tax yung severance pay so hindi buong 1,631,880 won ang mareceived ni Juan.

May idea ka ba sa proper tax deduction for severance pay?

hello kabayan inhamiller,

pasingit lang po. bago lang po kasi ako eps.ang pagkakaalam ko po, pag di mo nakumpleto ang isang taon.balewala tijikom.halimbawa po, 1 1/2 year, yung kalahating taon, di na babayaran. nagtatanong lang po. pakilinaw nga po.
--> once you have worked more than one year in the same company... you can avail the "toejikeum" completely including the incomplete 2nd year of work based on computation (refer to computation above)...

yung hindi lang maka-avail ay yung nagtrabaho ka sa isang company but less than 1 year ay lumipat ka sa ibang company... the bottom line is that you have to work more than one year of the same company then you can avail complete "toejikeum"...

thanks misterdj for your prompt response. actually i'll be turning one year this august and planning to look for another company to work. medyo di na kasi maganda sistema dito.delayed salary for almost 2months plus 3months food allowance.sayang kc tijikom kung di ko tatapusin kontrata.just yesterday, they gave us our salary for the month of june but they haven't given the salary for the month of May yet. i don't know what's their reason/s. anyway, thanks again and more power to this on-line forum. it really helps specially to our kababayan working here in korea.

you have a valid reason to resign and transfer to another company... but tiisin mo nalang yan until you finished your 1 year contract to get your "toejikeum"...

don't forget to keep your payslip (last 3 months of your salary)... in case hindi tama ang ibigigay na "toejikeum" sayo soon just tell us... i can give you NGO contact that will help you... (in case lang ha... hope ibigay pa rin nila ang tama)

thanks misterdj for your advice. about the payslips, no problem,kumpleto ang payslip ko.sa ngayon, pinag iisipan kung mabuti at pinaghahandaan.nagtatanong tanong.my other concern kasi once the company released me, di ko pa alam kung saan ako magi-stay while looking for a new job. i'll just give some update in the days to come. thanks again.

first of all, please refer to severance pay computation as posted above... ganito po kasi ang situation kabayan... ang babayaran lang sa Samsung Insurance Company ay ang computation base on basic salary natin... if nagkataon na marami tayong OT sa last 3-months work natin na siyang kukunan ng average during computation (refer to computation), so definitely ang result ay mataas pa sa computation based on basic salary... ang magbayad po sa excess ay ang employer natin...

please bear in mind mga kabayan...marami na po ang mga cases na na-met ko na hindi nagbayad ang isang employer sa employee... ang problema hindi rin alam ng employee na niluko na pala siya dahil hindi rin alam nya ang computation so karamihan huli na po ang lahat...

as a foreign employer, it is our responsibility to know our rights... we should ask, study, and research on how to compute our severance fee and other applicable laws affecting us...

tanong lang po kabayan at para nman malamang din ng ibang eps na kagaya ko ang situation,,i was working here in my company for almost 2 years and 8 months now,and my employeer want us to be back here ater my 3 years contract:here the problem now,,last september 3 ay nahulihan kami ng illegal worker(tnt)ayos lang kase di nman pinoy the problem is our recontract now kase naka hold/ban ung company nmin sa immigration ng 1 year so start september 3 2008 to september 2009 ay hindi sila makakuha ng foreign worker,at matatapos na ang contract ko sa march 7 2008,,so ano po kaya ang dapat na gagawin ko otherwise ng companya ko para makabalik ako ulit dito ng another 2 years?di parin ba approve ang 5 yrs contract deritso na walang uwian sa pinas after 3 years contract?

hello kabayan,
please ask your employer to confirm the labor office if hindi ba talaga sila maka-rehire within a year from the date na nahuli ang Tnt? kasi, ang alam ko, after 6-months pwede na maka-rehire ang isang company provided that the employer must pay the corresponding penalties... and also depending on number of TnTs na nahuli... meron din limit ilan lang ang ma-rehire... so, mas better, now pa lang ay malaman na ng employer mo kung hindi ba talaga sila maka-rehire after 6-months...

yung sa 5-yrs sojourn naman, as of now hindi pa po implemented...kailangan pa kasi yan i-approve muna sa National Assembly of Korea... expected implementation daw ay April next year but we don't know yet the details kung ano ang sistema ng 5-yrs stay (diritso na ba to 5 yrs? or uwi muna tapos ng first 3-yrs sojourn din balik for another new 2-yrs or 5 yrs sojourn?)

granting na hindi talaga pwede maka-rehire ang current employer mo, you better look for another company na pwedeng mag-rehire sayo...

In that case you can use equation by cross multiplication to get the equivalent number of days for 2-years and 11-months of working period. Please refer below...

For example:
1) Juan have worked in a company from January 2005 to November 2008. His last 3-months salary are as follow...
  • September (30 Calendar Days) ~ 1,200,000 KRW
  • October (31 Calendar Days) ~ 1,100,000 KRW
  • November (30 Calendar Days) ~ 1,300,000 KRW
2) Get the average ~ [1,200,000 + 1,100,000 + 1,300,000] / [30+31+30] = 39,560 won

3) Get the equivalent number of days for 2-years and 11-months of working period...
Note: Retirement allowance is paid in the amount of average wages of 30-days for working period of one year. So, 1-year or 12months is equivalent to 30days. 2-years is equivalent to 60-days. How about the 11-months for his 3rd year working period?

Solution:
Let X = equivalent days for 11-months
a) So, 12months/30days = 11months/X
b) By cross multiplication, 12months(X) = 11months(30days)
c) X = 27.5

4) Retirement Allowance = 39,560 won x [30days(1st year) + 30days(2nd year) + 27.5(11months)

5) So, your total retirement allowance is 3,461,500won.

Note: Samsung Insurance Company shall only pay computation base on your basic salary. So, the excess amount due to overtimes must be paid by your employer.

maraming salamat po. ngayon alam na namin kung bakit sabi ng mga nakauwi sa ibang kumpanya na iba yung bigay ng samsung insurance co. at iba pa ang bigay ni sajang as Toe Jik Guem.

paano po pag hindi naibigay ni sajang yung "xcess amount due to overtimes"
.paano po natin mahahabol yun? eto po ay para dun sa case na "narenew" si juan na magtrabaho ulit sa kumpanya ni sajang..

location po namin somewhere in taegu. malayo po sa kabihasnan.malayo sa lahat... immigration office...labor..etc.

ang case na yan ay very common na nagyari... since i-rerehire nga so di nalang mag-reklamo...kasi if magreklamo baka di ituloy ang rehire.

if gusto talaga kayo magreklamo, pwede yan... pero saka na kayo magreklamo once you got your new alien card na... lapit lang kayo to any migrant center na willing tutulong sa inyo but you have to risk your job kasi i'm sure magagalit talaga ang amo nyo to the point na magparelease nalang kayo...

meron me kaibigan na nagparelease siya then nagreklamo...tinulungan ng isang migrant center... nakakuha siya ng mahigit 1-million from her previous employer for "toejigeum"...

binigyan ko lang kayo ng totoong pangyayari... it's your decision pa rin kung willing talaga kayo mag-reklamo in case di nyo nakuha exact "toejigeum" nyo after sojourn at na-rehire kayo...

Lapit na naman po ako para magtanong.Sept 5 2008 natapos ang 3 years contract ko.Nakuha ko lang pong tejikom eh 2,460,630 won.Kung pagbabasehan ko po ung computation eh parang kulang po ng malaki.
last 3 month July = 1,525,000 won ( 25 days )
Aug = 1,552,000 won ( 26 days )
Sept = 200,000 won ( 5 days )
-------------------------------------
3,277,000 won / 56 days
= 58,517.85 won

oct 17, 2005 to oct 17, 2006 = 1 year equivalent to 30 days
oct 17,2006 to oct 17 2007 = 1 year equivalent to 30 days
oct 17,2007 to sept 8 2008 = 11 months equivalent to 27.5 dys

total days for 2 years and 11 months is 87.5 days

58,517.85 won
X 87.5 days

Tama po ba compute ko??????

Kung sakali naman nga po na tama ako ibig sabihin kulang ang nakuha kong tejikom at kanino galing ang nakuha kong 2,460,630 won nung umuwi ako ng pinas?

i suggest sa lahat po claiming their tejekom,,iwas sakit ulo
is to consult and just rely to the labor opis or migrant center kung may problema kau at di nyo ma claim ,,just rely to migrant or labor para di na kau mahirapan for the total computation kase dis is confusing sometyms,,importanti makuha nyo ito and trust those 2 department

July has 31 days, bakit 25days lang computation mo? absent ka ba ng 6days?
August has 30days, bakit 26days lang computation mo? absent ka ba ng 4days?
Remember bayad ng company yung Sunday nyo kasama sya sa basic.
Since September ay hindi buong month so they will use your June salary in the computation.

Isa pa ang company ay nakiki-contract sa samsung insurance, usually they only contract for minimum kc hindi naman nila alam kung ilan ang OT mo for the projected years. In this case your company send 2,460,630 + tax ( magkano ba minimum? 852,000won per month ba? so yun lang provide ng company mo sa samsung)

Then based on your new computation after your 3yrs since may OT ka, yung kakulangan ay dapat sa company magbabayad na. Example lang ito ah... 3months average ka ng 1,500,000 so sabihin na natin na 4,500,000 dapat na separation pay mo so 4,500,000 - (852Tx3) = 1,944,000won ---> yan dapat handle ng company mo pa.

Yung share ng company kung hindi binigay ay sa labor mo habulin at hindi sa samsung.

kanina po nagputa me sa ofc at cnb sa kwajang nim namin ang tungkol sa back pay o yung kakulangan sa tejikom namin. ang sabi ng amo ko di nila alam ang computation pero willig daw cla na maibalik kung tatawag ang labor sa kanila.ano po kaya ang magandang gawin, ayaw kasi nila na cla ang tumawag sa labor.

Talagang hindi sila tatawag, alangan naman na i-complain nila ang sarili nila ano? So ikaw ang dapat na mag file ng complain. Punta ka sa labor dahil mo lahat ng evidence mo then gagawa ng computation ang labor kung magkano pa obligasyon ng company mo sayo.

mam dapat po nung magexit ka ng 3 years pa lang ay binigay na sa iyo ang tijicom mo...kasi yan ang nasa batas..dahil umuwi ka ..at nirehire ulit..napakatagl ng 6 years bago mo makuha ang tejicom mo..ikaw ang lugi..wat if nalugi ang company nyo..pano mo sya mahabol..malamang tanging basic lang ang mabawi mo pag ganon..mas maganda mabigay na yan sayo asap..may ganyan mga ilang cases..kasi may ibang sajang na mapagsamantala sa empleyado...wag po tayo magpaloko...kunin mo agad ang para sa iyo..

I would like to ask kung kelan po naging effective ang ganitong computation. I was here 2005 and nag exit po ako ng 2008. That time sa company lang po nakkuha ang tejicom. And our company gave 2,100,000 won for 3 years of working. I believe they just based the computation in our average basic salary for 3 years.
My concern sir is that, if there are such discrepancies in the computation of our benefits, other than tejicom, can we still claim it today, when that was happened on our first sojourn period?

can you still remember your ARC number? you may try to call Samsung Insurance Company at 82-2-2119-2400 to confirm if yung nareceive nyo na toejigeum was from Samsung or from your employer...

if from Samsung yun, yung sa side sa employer, i think malabo na po yun makukuha pa...
