plz..give me advice..wlang katiyakan na extension
hello po sa inyo..im a new member sa sulyap pinoy..ang problema ko po pati ang ksama ko di2 po sa cmpany nmin..kc kmi dalawa mag 3yrs na sa may22..eh sya nkauwi na nung march dahil namatay ang papa niya..ako ngaun palang sana mkauwi sa may 21 cmula akoy dumating,bali stret 3yrs..eh ngaun ang problema namin wlang katiyakan ang extension namin kc nde kami sinasagot ng maayos sa opisina..last friday kinuha ang alien card nmin tapos my pinermahan kami d nmin alam kng ano un kc minamadali kmi..nung sat. binalik ang alien card namin na wlang sulat sa likod. ok na ba un....?pero itong mnday na to my dalawang bagong koreana inikot sa area nmin tapos dinala sa tinitirhan nmin cguro dun rin cla titira..ang nkapagtataka bkit may bago nde naman kulang sa tao..tapos tinatanong namin ang mga kasama sa cmpany eh nde rin nila alam..kaya tuloy ngaun kinakabahan kmi baka kc kapalit namin un..lalo na ako kc nextmonth na ako uuwi..sa totoo lng po ang taga opisina s cmpany nmin ay wla tlaga pakialam smin nde kmi inasikaso kng my mga gusto kami sabihin o reklamo sa office para kami mga aso basta nlang palalabasin..ngaun po pinoproblema tlaga nmin ang aming sitwasyon...ano po ba ang dapat namin gawin...?plsss..reply[quote]

kulitin mu n cla na i-renew ka o itanong muna kung irerenew ka o bka nman na renew k na...kc kung sa kwento mu kinuha alien card at me pinirmahan ikaw last friday at prang nagmmdali ay sa kdahilanan n dapat mai-apply ang extension 1 month before(april 21) ng sojourn period mu(3yrs)...walang sulat sa likod? naku!!!di ako sure...try mu ulit itanong kung bkit wala...dahil kung hindi naayos uwi n ikaw sa may 22...so may hangang ngaun araw k p pra asikasuhin at cguraduhin.. cguraduhin mu ha..at ok lng khit di ikaw magexit o umuwi kung di mu nman kelangan...cguraduhin mumuna ung 1yr 10 mos extension mu then magpaalam k n lang magbakasyon...e2 hanguk barok pede mu gamitin...tanong mu kung 5nyeon visa kesok tadesoyo? sabay pkita ng alien card at passport pra malaman mu kung ok n lahat...GodBless

under na po kayo ng bagong policy, so no need na po kayo compulsory umuwi ng Pinas for 1-month... ur current employer should have processed ur re-employment already... dapat nakapagpirma na kayo ng kontrata at kinuha na ang ARC at passport ninyo for renewal...
sino po nagsabi sa inyo na pauwiin kayo tapos ung ARC ninyo ay palitan ng bago pagbalik ninyo? di po totoo yan kasi under na po kayo ng new policy... malakas kutob ko na pinaniniwala lang kayo ng amo ninyo na irere-employ kayo pero hindi pala...
try to confirm again at itanong ninyo na kung ireemploy nila kayo for another 1yr and 10-months, dapat naiprocess na kayo... tapos if hindi pa rin clear ang sagot nila, ask nalang kayo na magpaparelease para makahanap pa kayo ng new employer na pwedeng magrereemploy sa inyo...

sad to say...dapat nasulatan at nabigyan na kau ng extension sa immigration today april 22 kung May 22 matatapos ang 3yrs. nyo...kahit sana kayo na ang nagasikaso hihingi lang kau ng supporting documents sa Company nyo at kau na ang nagdala sa immigration...prang 1yr renewal lang ang proseso nito e...bibigay lang ung papel then bayad lang 40,000 tpos ipapamail na lang ung aliencard nyo...hayyyssss....dahil nga ayon sa bagong batas dapat maasikaso ang plus 1yr 10mos extension mu 31days before(more than 1mo upto 3mos) so dapat from Feb 22 - April 21 e naayos mu na yan..sir dave khit po ata maghanap pa sila ng bagong company di na rin po maihahabol...kaya wag na mag magparelease masasayang lang ang bayad na araw...tama ang kutob ni sir dave malabo un sinasabi nila...malamang diretso uwi na yan...maraming nabiktima ang bagong batas na ito...kahit gusto pa nung kumpanya ang isang EPS worker pero nakalimutan at nahuli sila sa pagaapply ng renewal ay wala na sila magagawa...kasi nga un ang bagong batas...31days before sojourn period dapat nakapagapply na ikaw ng extension...Sana mali ako at puede pa kau mahabol...pero kung magkakaganun man asikasuhin nyo na ung mga kelangan nyo ayusin tejikom,kookmin,samsung fire, booking etc. ...GodBless

knina pala tinanong ko ang sajang kc umikot sya sa area nmin cnvi ko sa kanya na ang alien card ,visa hagu o(5)nyeon kajji.?ang sagot nman nya yeah daw..sa tingin nu nagsavi kya sya ng totoo...pero yong langka na nauna samin umuwi last feb.5 nkabalik naman..march 5 rin bali 1 mnth vaction..pareho lng ba ang batas ntin sa mga ibang lahi..?

ung langka +3yrs un kelangan nya tlga magexit for atleast a month, lumang batas pa ung inabot nya..sau di ka na umabot sa lumang batas kaya +1yr 10mos ikaw at di mu na kelangan magexit, yan ang bagong batas..san ba location mu try mu search dito ung number na pinakamalapit na immigration center sa inyo http://www.hikorea.go.kr/pt/index.html mas maganda cguro mag leave na ikaw at puntahan mu para lang makasiguro kaw...pero diskarte mu kung gusto mu tumawag na lang...ipakausap mu sa mga chingu mung korean jan... alam mu kc ung kasama namin 1month before naasikaso nila...sila ang nagdala sa immigration ng kanilang papel at alien card nitong march 24 lang...may tatak sa likod para sa taon 2011 sana totoo ang sinasabi ng inyong employer mas maganda kung gusto nyo pa magwork at magtagal pa dito para kumita ingat GODBLESS

yung 3 to 1 month requirement to process the re-employment application hindi na po yan bago... yan talaga ang original procedure during the start of re-employment system... but kahit less than 1-month nalang natitira as long as willling ang isang employer to re-remploy his EPS worker, pwede po yan... my 2-closed friends who have experienced the same situation before would prove my answer...
by the way, meron ka ba kakilala na nadedeny sa labor dahil less than 1 month na sila nakapag-apply ng re-employment? if meron, pakibigay po ang number para maitanong natin kung ano talaga ang reasons...

galing sir dave...tlaga bang pede ihabol nung company ung re-employment khit less than 1month na natitira at willing ung employer...andami kc nito sa simbahan last January,February and March kaya marami ng nakauwi...andami pa ring nalito khit luma na requirement s ng application for re-employment...dahil lahat mismo ng Foreign worker assistance dun ang nagsabi na Immigration mismo ang tumatangging magbigay dahil di nasunod ang policy(31 days before) kasi nga akala rin nung iba ay AUTOMATIC ung 5yrs... ito ay kahit gusto pa nung employer ang EPS worker pero sa kapabayaan ng employer o nakalimutan mai-porcess...idinulog ko na ito noon sa Thread ng "5yrs soujorn period approved"...pero kung ganun pala at pede maihabol...sa inyo ko na lang pakokontakin...pero sayang tlga...marami tlga nadale khit luma na pala ang requirements na ito...pero ngaun si chancai na lang muna...malamang wala na ung mga binabanggit ko lalo na iyong iba... kc last Dec ko pa ata idinulog un e...tatlo kasi ung malapit na kaibigan ko din na nakauwi na dahil wala na nga raw magawa...CHANCAI...un naman pala pede kahit less than 1month...pkidisregard na lang ung sinabi ko tungkol dito at sa pa-parelease...pede pala ingats salamat sir dave more power GODBLESS

just talked labor office representative this afternoon... tinawagan ko para maclarify itong issue na ito kasi nakakalito nga... baka hindi uniform ang implementation ng different local labor offices... below is their answer...
Rationalization of application period for reemployment (Effective April 12, 2010, according to Article 14(2) of the enforcement regulation of the said law)
- In order for an employer to re-employ a foreign worker, the employer have to apply for it 45 or 15 days before the termination of first 3 year sojourn period.
Examples of how to apply the reemployment application period:
1) Applying for reemployment before 15 days of the termination of first 3 year sojourn period...
- An employer has to apply for reemployment before 15 days of the termination of first 3 year sojourn period, when his/her worker has worked for at least 3 months as of the completion date (Ex. In cased of a worker whose first 3 year sojourn completion date is June 15,2010, when he/she started his/her work before March 15, 2010)
-> Sa madaling salita, if ikaw po ay nakapagtrabaho ng company more than 3-months, pwede ka pa i-process ng reemployment (1-yr & 10-mos) kahit 15-days nalang bago magend ang 3-yrs mo dito sa Korea... (or from 90-days to 15-days)
2) Applying for reemployment before 45 days of the termination of first 3 year sojourn period...

MABUHAY ka SIR DAVE....hayyyy dami ng timaan...chancai...so ayan pede ka pa may 2weeks ka pa...applicable sau ito kasi APRIL12 implementation...kung kelangan kausapin ng masinsinan at makiusap ng todotodo gawin mu...makakabuti siguro sabihin mu rin na wala ka balak magbakasyon i-renew ka muna kamo...buti nga't medyo binago na ulit...nkakalungkot lang tlga para sa mga nauna na nalito hayyyy...

sa case ng friend na kasama ko dito sa company, ma-end yong first 3 years niya sa July 2010 at sabi ng sajang nila hindi na daw sila bibigyan ng extension. ano kaya pwede nilang magawa to avail the extension?.......... need advice please. thanks.

this is my opinion and advice about sa friend ng kasama mo...
if ayaw siyang i-reemploy tapos ayaw din i-release, malabo po na makakavail siya ng another 1-yr and 10-mos sojourn...
pero meron siyang 2 little chances na pwedeng gawin...
1) kung merong violation ang current employer niya related sa salary or any labor law violations, pwede siyang magfile ng petition sa labor office at gawing dahilan na magpaparelease siya pero kelangan na as soon possible gawin nya kasi wala na siyang time... July matatapos ang sojourn niya di ba? sa current policy kasi, dapat maiprocess na ng employer ang reemployment ng isang EPS worker 90 ~ 45 days bago mag-end ang 3-yrs if the worker has only working in the company for less than 3-months... so considering irelease siya at makakita ng new employer pero im sure less than 3-months na yan before end of his 3-yrs... so need po ihabol ang reemployment application niya before 45-days...

bossing pede nyo cguro ipaliwanag sa amo nya kung bakit na kelangan irenew ung kebigan mu(tulad ng kelangan nyo pa ang kumita dito sa Korea pra sa pamilya) cguro sapat na ang makiusap pra mahabag ang amo...paliwanag nyo din kung bkit kelangan agad ma-i-release kung di tlga mkuha sa pkiusap ang renewal....tutal wala nman atang binanggit ung amo na di rin pede or ayaw ng amo na i-release ung friend mu db? (para me time p sya mkakuha ng employer na magaasikaso sa kanya ng change of workplace at 1yr 10mos. re-employment) pra isang lakad na pinagsabay na...dont get me wrong alam ko naman para sa ikabubuti ng lahat...baka kc pag naumpisahan ung ganun e gayahin ng ibang employer at manggipit ng mga irerenew...pede naman cguro i-renew lang then magpapa-release pra di makadagdag sa knila ng manpower...pinakamatindi na cguro na i-offer mu na ikaw magaasikaso at magbabayad ng processing I think it will be fair enough...diskarte mu pa rin...

wala naman daw siya nakikita na violation ng company with regards sa sahod or sa mga benefits. kaya yong last option ni dave, ang best suited to his situation. ang makiusap na lang sa sadjang niya. he will be seeking the help of migrant center staff to speak to his sadjang in his be half. hindi kasi niya kayang makipag-usap in hangul and hindi rin marunong mag-english yong sadjang niya.

Dave, is the policy (re: extension renewal) you have just explained above applicable only for EPS Workers? How about for other migrant workers bearing other visa classification such as E-3, E-7, etc.?
