good day!
Based po sa mga info na nabasa ko dito sa site , nalaman ko po na may mga violations ang company nmin.Bigyan ko po kau ng konting background tungkol sa problema nmin...
Na-hire po ako last March 2,2009,ang monthly salary ko ay 850,000won/month,overtime pay na 5,000/hour.Ang working hours ay Monday-Saturday 9:00am-6:00pm.Pero sa contract na pinapirmahan sa akin ang monthly salary na nakalagay is 904,000won.Ang total working hours ko ay 48hours/week na 44hours/week lang dapat.This month daw,according sa Manager nmin,may pagbabago sa working time nmin.Every other Saturday mawawalan na kami ng pasok.Pero ang kapalit namin nun,Monday to Thursday ang magiging working hour nmin ay 9:00am to 7:00pm,tapos Friday 9:00am to 10:30 pm,all considered as regular working time(walang OT).Sana po maintindhan nyo ang pagkaka explain ko...pero kung di po masyadong klaro,inform nyo na lang po ako.
Hihingi po ako ng advice sa inyo kung ano pong pwede kong gawin.Kung pupunta po ba ako sa Labor,papansinin kaya nila ang complaints ko?
Saan po ako pwedeng pumunta para matulungan ako sa problem ko???Please advice po...

kabayan,
if your employer has less than 20 regular workers, you must belong to 44-hrs workweek system... that means, your salary must be 904,000won per month (226 x 4000won)... and working Monday ~ Friday (9AM ~ 6PM with 1-hr lunch break) plus 4-hrs working Saturday as regular working hours... total of 226-hrs.

yung work mo during Sat. (9AM ~ 6PM), yung 4-hrs must be considered as OT already... and OT charge must be 6,000won/hr... so your monthly gross salary must be 904,000won + (No. of OT-hrs x 6000won)...

yun namang changed of working hours currently implemented by your company maybe due to the effects of Global Financial Crisis, in my opinion okay lang yung magwork kayo from 9AM ~ 7PM Monday to Thursday (plus 1-hr a day in lieu of Saturday regular work na 4-hrs)... Pero yung Friday, if you work from 9AM ~ 10:30PM, yung 4.5-hrs should be treated already as overtime work...

so, in your statement, i can confirm na hindi po tama ang ibinigay na sahod by your current employer... i suggest you should talk to your employer first about your concern... but if ayaw pa rin magbigay ng tamang sahod, and if willing po kayong maghanap nalang ng ibang employer at magpaparelease, you can directly visit the Labor Office to file a petition...

huwag po kayo matakot kung sasabihin ng employer or tatakutin kayo na pauwiin ng Pinas... hindi po yan pwede mangyari kasi there is a Korean Law protecting our rights as foreign workers in Korea...

by the way, make sure to keep your "payslip" as well as "daily time record" kung meron to serve as proof sa petition mo...

sir dave gud evening!
may nabasa napo kasi akong topic dito about dun sa current na minimum wage ngayong 2009,un pong galing mismo sa MOL (English & Korean).pwede po ba ulit makahingi nun para ma-iprint ko.Yun po kasi ang gagamitin namin na proof once na nagreklamo kami sa company nmin about sa salary namin.Di ko na po kasi mahanap ung topic na yun...please!thanks!

hello rmribus,
under EPS, daily basis po talaga ang salary... but pwede po kayong maging monthly basis depending on your employment contract agreement na pinirmahan but yung salary ninyo must not be lower than the minimum wage per hour if totalized according to actual hours worked...

please take not that if monthly basis po kayo, even wala po kayong work during official holidays, meron pa rin kayong sahod...
