pinapatanong po..
sa feb next year po, 3 years na po siya, sabi ng amo niya rehire daw po siya.. gusto po sana ng misis niya December siya umuwi.. yun na yung 1 month vacation after 3 years sojurn.. pede daw po ba yun..

granting na hindi pa ma-approve at ma-implement ang additional 2-yrs sojourn to the existing 3-yrs to make it a total of 5-yrs, pwede po siyang mag-request sa amo niya na i-advance yung rehiring niya... that means na, hindi nalang niya tatapusin ang 1-yr contract of his 3rd year sojourn in that company...

but take note, he should ask the approval to his employer first... if ayaw pumayag, wala po siyang magagawa kasi may contract po silang pinirmahan na 1-yr talaga... maki-usap nalang siya ng mabuti sa amo niya...

pero granting ma-approve/ma-implement na ang additional 2-yrs sojourn before February next year, hindi pa siya kailangan i-rehire at umuwi ng Pinas for 1-month... pwede siya uuwi pero as vacation leave under the approval of his employer...

kung siya po ay nakapagwork sa company with 5 or more regular workers for one year or more, he/she is still entitled to receive a "toejigeum" according to standard "toejigeum" formula despite he/she will not finish his/her one year working contract...

yung "kukmin" naman, he/she can avail for it as long as matatapos na ang 3-years sojourn granting hindi pa ma-approve ang additional 2-years...

kung siya po ay nakapagwork sa company with 5 or more regular workers for one year or more, he/she is still entitled to receive a "toejigeum" according to standard "toejigeum" formula despite he/she will not finish his/her one year working contract...

yung "kukmin" naman, he/she can avail for it as long as matatapos na ang 3-years sojourn granting hindi pa ma-approve ang additional 2-years...
